CONCLUSION AND SUGGESTIONS

The first case of COVID-19 was recorded in India on the 30 th January. This was the time when
several countries globally had already reached a height in terms of recorded number of cases.
China being one of the acknowledged perpetrators of the widespread of the virus shares its
boundaries with India. The tourism base and students studying abroad base is also high in India.
Moreover India is a country of 1.3 billion people where travelling and globalization is a daily
notion for the masses. The situation that we as a country are facing right now was inevitable but
the remedial measures that were opted by the government post the lockdown and its miserable
impact on the migrant workers could have been planned in a better and definitive manner.

The facilities that have been formulated by the government eventually whether are getting
executed in a proper manner till date, still remains a matter of concern. Evidently, there have
been evident examples of lack of responsibilities such as tickets being charged in the Shramik
trains, People not getting adequate amenities, Police brutality and sheer arbitrariness being
allegedly visible through several media reports. The SC orders to the central and state
governments on 26th May regarding proper execution of their policies in order to cater to the
needs of masses is the biggest evidence in front of us

Moreover, in order to pass any law or order, the constitutional validity of it has to be checked
and it is evident from the aforementioned facts that the MHA order had been unconstitutional
and the mere fact that it had not been challenged anywhere is not an evidence enough to make it
constitutional since people’s unawareness regarding laws and state of affairs has to be given due
consideration too. The MHA order served as an atrocity towards the most vulnerable section of
the society as their fundamental rights had been clearly violated and the State is the one to be
blamed for that since the positive obligation lies upon the State to ensure that rights conferred
within Part III are protected in regards to every citizen.

It is not denied that social distancing and curtailment of the COVID-19 pandemic is something
that is to be disregarded completely, but while ensuring the goals of public health and greater
common good, the government must definitely not disregard the rights of a different section
altogether.
Lastly, this paper is not an attempt to overtly criticize the acts of the government or to prove that
they have been inefficient, but the fact lying ahead of it is that the State actions were
unnecessarily delayed and resulted in indirect oppression of the vulnerable classes. Though the
inadequacies have led to definite damages, rectification on the ground level could be ensured by
assuring that these migrants are now getting their basic amenities.

Several accessible fair price shops and ration shops should be opened in villages and remote
areas in order to ensure that the Government facilities are being availed by the vulnerable people.
One Nation, One Ration Card scheme must reach out to all the states. Lack of awareness is
another dogma that is quite visible in case of migrant workers, therefore their sensitization
should be conducted in order to make them aware of the government related schemes and
policies. Several properly used databases must be opened in order to track the fleet of movement
of these migrant workers. The government must ensure that they are being provided relief funds
so that they are not burdened with lack of income. Lastly, the sweeping orders must be executed
properly to ensure that none of the landlords are asking for rents from these workers who are
already at a loss and none of the workers should be removed from their respective jobs leading
them to face unemployment. To conclude, the government though late, but has taken some great
initiatives and formulated some great policies regarding the migrant workers but the only thing
that they need to ensure now is that the policies are getting executed in a proper manner on the
ground level with proper coordination and responsibility.
