The attention of the District Colector and D.M., Prakasam District is

indited to the ref.1st cited and a copy of Orders of the Hon’ble High Court
receided in reference 2nd cited is sent herewith to the District Collector,
Prakasam District. It is informed that the Hon’ble High Court of AP dide
orders, dt. 23.06.2023, in WP No.10304 of 2018 has held that

“It is noticed that the counters by the respondent/ State of Andhra

Pradesh, are not on record. The learned Godernment Pleader has written
instructions, asking him to seek time. This Court notices that W.P.No.8177
of 2011 is fled in the year 2011 and till date counters are not fled by the
Godernment of Andhra Pradesh. In W.P.No.10304 of 2018 also no counter
is fled.
Sri Challa Gunaranjan, learned counsel points out that there is a
judgment of the Hon’ble Telangana High Court, with regard to the
attachments of these properties and that the attachments hade in fact
been raised in the fnal order. Sri J.Bhaskara Rao, learned Standing counsel
for the E.D., is directed to clarify if any appeal has been fled against the
said order, since the same pertains to the properties indolded in these
Writs also.
List these matters fnally on 14.07.2023, for counters of the
respondent. It is made clear that, if the steps are not taken to fle the
counters, the right of the respondent will be forfeited. In the Court’s
opinion, they had more than adequate time to secure the records and to
fle their counters.“

2. The District Collector, Prakasam is directed to fle counter

afdadit on behalf of Godernment also, within the stipulated time and to

adoid further legal complications in the matter, immediately.
