PREFACE
This report is an outcome of the Internship Training Programme of Amity Law
School, Amity University, Madhya Pradesh, Gwalior, for the students of V semester.
The initial portion of the report consists of a description of the organization under
whose guidance this internship has been successful. The main constituents of the
project are the report of my work at office of Adv Sachin Gupta (M.P. High Court,
Gwalior Bench) during the internship, the research on related issues and the weekly
report of my work. I have tried my best to do justice with my activities and put it in
black and white with the same effort as I did during the internship.
In this report I have tried to describe in detail all the necessary activities and work I
have done during the period of one month. Thus, as you go ahead the report will
reveal minute details of the work that I have done in my summer internship program.

BRIEF ABOUT THE ORGANIZATION

I have been a legal intern in the office of Adv. Sachin Gupta (M.P. High
Court, Gwalior Bench), he is practicing advocate from past 10 years, who
dealing not only in the case of civil and criminal nature but also case related
to all over India jurisdiction i.e., Supreme Court also.
His office ensures the needy gets the right amount of help with limited
expenses. He is really a help-oriented person. His guidance and thoughtful
planning have indeed helped me to understand the true meaning of various
aspects of law and society. Law as subject is multi-dimensional as every
other subject such as social, economic and psychology are inter-related which
is truly reflected from his work and office.
He has 7 juniors and 4 sub-junior advocates practicing under him. This
organization had a very systematic way of approaching the work dividing
them to assigned person having specialization in that field.

BRIEF ABOUT THE REPORTS SUBMITTED (IF ANY)
AND THE WORK UNDERTAKEN

This report is the outcome of the compulsory period of one-month internship


program designed by Amity University, to allow their students to get a fruitful
insight of all the practical aspects and necessary implication and application of
bare written laws.
This report consists of my day-to-day activity undertaken during this period of
one month. And it consists of my personal and professional experience including
all the necessary key knowledge things which I have learned and taken forward
along with me via this period of internship.
Besides my activity it does consists of some case studies and other related matters
of work and discussion which I have observed through my daily visit to my
organization and court.
This report by far is the true replica of my day-to-day activity and experience I
had over period of one month in this organization.

GENERAL OBSERVATION

1. It is quite evident that it is not possible to learn the process of law within the short
span of 30days. But on average, I learned the basic process of filing the case
sending application, notice, summon and taking dates.
2. I learned about writing notice and procedure to follow in the case of Sec138 of NI
Act.
3. The pendency of case, the observation has shown to me that it due to rigid
traditional system of procedure to followed in hearing od cases and judging them.
4. The legal profession is not only about how well you can speak or how well you
score but it is about how better you can interpret and make people understand
your point.
5. The system of justice is money oriented; most of the decisions are influenced and
given under the curve of power and money.
6. The environment is more diversified and inclusive for all the employees.

EXPERIENCE DURING THE TRAINING

This period of internship was truly a fruitful insight of practical application of law and it
interesting to learn the process of how in actuality the court works. Drafting of
application affidavit, learning accurate language to be used in for different section to
applied in the cases. The most interesting fact about law is nothing is crime until proved
even a rapist can be declared a victim with the strong application of mind, common
sense, and legal knowledge. Professionally, this internship taught me one major thing law
as a profession is equally ethical and equally unethical, we are going to make money out
of problems of people and another major learning is justice is expense and it is rarely
happening to common men.

A habit which makes us different from other professions is no retirement age lawyers are
like wine the more we ferment our self with heat of books and opinion the authentic we
will be able to deliver in the court of law. The written laws are not the boundary else they
are factors of toys to interpret the different component of functioning.

Issues to which I felt to discuss with my senior was the independence of judiciary, which
a very commonly discussed question but itself not solved, what I found beside the
external influence the lower unit of administration that is guard to protection for common
men and make them avail the insight of justice what if the corruption starts from there
which is the fact.

Telling the case which came to the office.

Facts:

The middle-aged lady name Avani complained about the sexual harassment done against
her by the high caste rich men of her village, police refused to register the complaint
against the man, later that evening they came and arrested her without any women
constable, she was physically, mentally, and sexually harassed by the sub-inspector for
two days and told to shut her mouth. She is brave lady came to sir’s office and sir made

This is difficult for a common to avail the justice when the guard of society are them self
at position to commit crime.

introduction session. I along with my co-
interns were assigned to visit the district court
and made a rough detail about how many
courts room are there in district courts of
Gwalior and remember which judge is
preceding upon which court.
Secondly, we were given task to pick-up copy
(nakal) of the documents demanded by the
senior. Rest we are given files to read and
prepare the opposite side of the given file.

2. 04/07/2023 2 Case Briefing and The Second day of the internship was case
evidence
briefing day, I was aside the task to make thee
submission
note of story and point of problems the client
told to the senior. And brief him what I
understood adding his points and thought I was
made to narrate the story to typist and made
him prepare the document to be sent to the
post. Later, I went to hear proceeding od
POCSO case naming : State of MP v. Vishnu
Dutt.
3. 05/07/2023 3 Drafting and The third day was same as last two, I was asked
application
to write the application Sec317 of CrPc in the
case of Aditi Singh v. Murli Singh. Later, I
correct the application of which brief were
prepared by me. Later, we learned the details
and procedure of filing case under section 138
of Negotiable Instrument Act that case of

dishonor of cheque. Case of Shree sita ram
PVT. V. Gopal Das Verma.

4. 06/07/2023 4 Reading This day I only read evidence act, and read
cross examination how relevancy can be the
question which can be the turning point in any
case. Than later I did research on what is
marital rape how it is present in the present
law.
5. 07/07/2023 5 Visit to High Court For the very first time we went to learn how
the case if filed in high court of Madhya
Pradesh. This was an appeal case in the case of
divorce a decree of interim maintenance was
passed no step was taken to fulfil it. Later, I
read evidence act and major related cases and
judgement.

6. 08/07/2023 6 Dummy This day we were told to prepare a case note

upon a case of section 138 of NI act, and we
all interns were asked to follow complete
procedure a small trial moot court was
arranged by the sir for all the interns. We
prepare notice, bounce memo, cheque, than
facts of section 138 of NI act.

2. 11/07/2023 8 Visit to SC/ST We visited the court of Pradom Kumar(J), how

is senior ADJ residing upon the bench of C/ST
court. It was judgement day but due to so
reason the judgement was not given that day.
Later, we went for the hearing of Shri Samya
Devi Pvt v. Neeru gupta filled under section
138 of NI Act.
3. 12/07/2023 9 Court Visit After reaching the office the firstly I checked
today’s cases in the case dairy. A little less
number of cases were assigned today
compared to the previous day. Later, my
supervisor order me to go inside the ADJ
court and observe. I went inside the ADJ
court i.e. Additional District Judge with Sir
and the other assistants & interns.
Later, we read and discussed on the topics of
Evidence Act.
4. 13/07/2023 10 Drafting of Notice Today, all the interns were assigned to draft the
notice in the case of Aarti v. State of MP the
women naming Aarti was arrest without
warrant and kept in custody for 2 days was
mental, physically and sexual harassed by the
sub-inspector of datia thana. Therefore a notice

was to be sent to police station, SP office and
women right council Bhopal, National Human
right council Bhopal. It was challenging task
but lot of fun.
5. 14/07/2023 11 Bail filling All the interns were directly called to court,
one of our senior advocate was assigened by
the sir to make us all undergo the bail filling
procedure. How bail bond is prepared what is
process of getting the bail.
Later, I prepared the application of sec 317 of
CrPc. And read on topics of evidence
6. 15/07/2023 12 Court visit We visited High court in case of bail order. And
then went for the hearing of case in sec409 of
ipc that is criminal breach of trust, along with
this all the interns were assigned the task to
learn Hindi drafting keyboard and was
assigned a task to translate hindi affidavit into
English. Later, we read commentary upon
evidence law.

This activity was quite an lengthy task but it

and understand our interest.
2. 18/07/2023 14 Court visit and In the morning we all visited to court

the notes which prepared were discussed with
all the points we were able to make and sir
made us understand how we need to find the
points of defects in the case to prepare our
defence.
3. 19/07/2023 15 HMA Read and analysed the facts and details of the
Case Analysis.
case file of Shri Sarthak Singh
Sikarwar V/S Smt Gudiya & Others. This
was the case of family court registered under
Section 13 of Hindu Marriage Act 1955.

Brief facts of the case:


Mr. P and Miss. D were married as per the
Hindu rituals. After few years, Miss. D started
to behave rude, violent and insensitive
against Mr. P and tortured him mentally and
physically. Later Mr. P discovered that
bride’s family hide the truth that it was her
second marriage and her first marriage

dissolved because her mental condition was
not fit. Also, she was depressed at the time of
her marriage with Mr. P.
Husband filed a divorce suit for which the trail
is still in process.
4. 20/07/2023 16 Glimpse of CPC I learned very basics of CPC i.e.
SUMMON ORDER: The summon is issued by
the court to appear in the court to defend it.
The intimation which is sent to the other party
or defendant is called Summons. The
provisions related to summons are given in
Section 27-32 and Order V of CPC.
Learned and read about difference between
decree and order.
5. 21/07/2023 17 SP office visit. Today sir took us to get a glimpse of SP office
in city canter. Later we me SSP of Gwalior Mr.
Amit Sanghi. Later we visited High court to
hear proceeding in the court of Justice Arya.
And later for the day we read files and learned
basic concept of evidence.
6. 22/07/2023 18 Client counselling Today I and my friend vedansh who was a co-
intern along with me were made to help sir
throughout the day. I learned and keenly
analysed how the art of counselling holds one
of the most important part in client dealing and
getting cases.

of India.

various lawyers of Supreme Court learned
about the difference with practice in local court

Gwalior.
5. 28/07/2023 24 Visit to Family I went to take date and file the application

Sec317 of CrPc in the case of Manju Rani v.
Vinod Mor to the family court. Later I read
their case and got to know how sometime
delaying the witness can lead in our favour.
6. 29/07/2023 25 Case analysis I read the case file of State v. Santanu Yadav,
were he was being trial of rape case. It was
really an interesting case later I read and learn
new concept of Evidence Law.

SUMMARY OF LEARNINGS (WITH MINIMUM 2 CASE LAWS OBSERVED
/LEGAL CONCEPT LEARNT DURING INTERNSHIP)

The whole internship period was a really creative, innovative and learning experience. I
personally experienced my personality growth on several levels. Interacting with different
Advocates and Judges gave me a lot of motivation and confidence. Working with the people of
my own kind was new as well as exciting to me. In this one month I learned how to read case
files, how to draft and file affidavits and applications in court, how to note dates of the cases
and maintain diary. I also learned the basic procedure of a trail in both Civil and Criminal cases.
Observed the actual working of the court. Analysed the arguments and the judgments of many
cases. In a nut shell it was an amazing experience filled with a lot of fruitful opportunities and
learnings as my supervisor was really supportive and friendly. I hope work with him again in
the future. Even today, we continued with the case file reading
task which was given to us yesterday. Today I read

FACTS OF THE CASE:

• On 27/11/2016 Applicant and her family

were returning from a family wedding at

around 1:30am via National Highway.

• Applicant’s family were traveling in a jeep

no. MP**- ** - ****.

• Their jeep was hit by truck driver Mr. X of

truck number RJ** - ** - *****.

• In the accident applicant’s only son Mr. R

died on the spot due to severe injuries and

another person was injured.

• Mr. R of age around 23 years was the only

bread earner of the family.

• Mr. R was earning 2,64,000 p.a. i.e. 25,000

per month.

• Demand:

1,32,000 x 39 years = 51,28,000/-

Interest rate = 40,00,000/-

Last rituals expenses = 50,000/-

Mental stress of family = 2,00,000/-

Case filing charges = 20,000/-

TOTAL EXPENSES = 94,18,000/-

This was a case of HIT AND RUN Motor

Vehicle Accident. The liability to pay all the

damages occurred to the applicant lies on the

National Insurance Company. The casualty

was a young and only source of income of the

applicant’s family.

Hence the demands are as per the income

and reasonable causes.
