License Conditions:-

1. General Conditions
1. The license is valid for one (1) calendar year from the date of issue, and upon expiry, application for renewal shall be made at least thirty (30) days before expiry date
of the current license and must be accompanied by the prescribed fees
2. The licensee shall not transfer or otherwise divest any rights, powers or obligations conferred or imposed upon him by the license without the consent of the Energy
and Petroleum Regulatory Authority;
3. The licensee shall ensure replacement of the license if lost, defaced or destroyed subject to the satisfaction of the Energy and Petroleum Regulatory Authority. The
licensee shall pay twenty per cent of the license fees for such replacements.
4. The licensee shall ensure at all times that the license (s) is displayed in prominent position on the premises in respect to which it is issued;
5. The licensee shall notify the Energy and Petroleum Regulatory Authority in writing of any accident or incident at its premises causing loss of life, personal injury,
damage to property, damage to the environment, explosion, spill, fire or other incident or accident immediately and in any case not more than 48 hours after the
occurrence of such an accident or incident;
6. The licensee shall provide the Energy and Petroleum Regulatory Authority with full access to all of its records, documents, sites, and assets as and when required.
2. Specific Conditions
1. The licensee shall purchase petroleum products only from Oil Marketing Companies licensed by the Energy and Petroleum Regulatory Authority;
2. The licensee shall sell petroleum products that meet the relevant Kenya Standard (s);
3. The licensee shall not sell petroleum products to persons operating petroleum businesses without valid licenses from the Energy and Petroleum Regulatory Authority
or its appointed agents;
4. The licensee shall adhere to the petroleum prices published by the Energy and Petroleum Regulatory Authority and in particular full remittance of the retail margins
as per the Energy (Petroleum Pricing) Regulations 2010.
5. The licensee shall not offer for sale locally, petroleum products meant for the export market.
6. The licensee shall at all times adhere to Environment Health and Safety standards and regulations;
7. The licensee shall at all times during the license period, comply with all applicable laws and regulations, standards and codes of practice;
8. The licensee shall not engage in any activities that are intended or likely to disrupt or interfere with competition, including but not limited to, cartel like arrangement
and creation of artificial shortage of petroleum products; and
9. The Energy and Petroleum Regulatory Authority shall take appropriate action against the licensee in the event of breach of any of the conditions stated herein or any
contravention to the Petroleum Act 2019 and regulations therein.
