1. Introduction

The Multi Commodity Exchange of India Limited (MCX), India’s first listed exchange, is a state-
of-the-art, electronic commodity futures exchange that facilitates online trading. MCX has
multi-layer architecture trading and network hardware which has maximum scalability based
on market demand.

2. Objective
The objective of this RFP is to get proposal from Bidders (Original Equipment Manufacturer
(OEM)/ System Integrators (BIDDER)) for procurement of the Nutanix HCI SOC Infra node
upgrade for Monitoring tool Infra in DC and DR as per BOQ mentioned in Annexure-I.

3. Service Level Agreement (SLA) and Scope of Bidders:

System Integrator (BIDDER) : 24 X 7 - Onsite, On-call support.


: L1-L2-L3 Level
: Response time: 10 min.
: Resolution time: 4 hrs.
: Support period - 5 Years

➢ Scope : Delivery, successful deployment, node configuration, cluster configuration

1. Uptime: 99.99% on monthly basis.


2. The Bidder hould keep setup updated with latest stable software version, service
packs, bug fixes, hot fixes, patches, patching for the observations arise out of
Vulnerability assessment exercise etc. related to the product. Prior approval of MCX
to be taken for the activity. Engineer should be arranged for the activity. Reports for
the same need to be submitted on quarterly by Bidders.
3. The BIDDER should arrange engineer for activities as and when require during support
period at MCX Locations.
4. The Bidder should have OEM certified and experienced (L2/L3) engineers.
5. The BIDDER should share service contact details with escalation matrix.
6. The BIDDER should share the back to back (OEM) contract details / copy, original
software licenses copies, etc. (If applicable).
7. Supply of the material should within 4 Weeks
8. Support during testing of new appliance prior implementation
9. Support during go-live at PDC & DRS
10. Ongoing support & maintenance for support period.
11. Any hardware upgrade or modifications activity related to infrastructure. Details of
hardware changes to be recorded under change management.

➢ Delivery : Within 4 to 6 weeks from PO date

➢ Documents: Bidder shall provide detailed Installation Manual and provide technical
support during Installation of the Product.

➢ Delivery Locations: As specified in Annexure I.


➢ Penalty:
❖ Delivery/Installation Delay - If bidder unable to deliver and/or complete the
installation as per agreed time frame, then penalty applicable will be :
• 0.25% of PO value for first week post breach in delivery time frame.
• 0.5% of PO value for second week post breach in delivery time frame.
• 0.75% of PO value for third week post breach in delivery time frame.
• 1% of PO value for fourth and subsequent weeks post breach in delivery time
frame.

If Bidder unable to deliver the complete material as per PO, within 8 weeks post
agreed delivery time frame, then MCX reserves the right to terminate the PO /
contract.
PO value/amount inclusive of taxes.

Note : Penalty applicable for delayed delivery will be combined penalty of all weeks till delivery
is made.

4. Bidder’s Eligibility / pre-qualification Criteria

1. Bidder may be a Private/ Public / LLP Indian Company under Indian Laws. Bidder
shall submit the Certificate of Incorporation along with the Technical Bid in
respect of this requirement.
2. Bidder should be minimum 3 years old and have provided similar services to at least
5 Govt. / Public Sector Companies /corporates.
3. Bidder must be in the business of building functional and non-functional test suits
and well versed in working with the technology development teams and business
users.
4. Bidder should have the domain knowledge in the areas of capital market, financial
trading and exchange related businesses for at least last 5 years.
5. Bidder should have required ISO & other certification.
6. Bidder should have fully functional service continuity site / plan.
7. Bidder should have Income Tax PAN and should have submitted IT returns for the
last 3 years.
8. Bidder should be registered with appropriate authorities under Employees
Provident Fund and Employees State Insurance Acts or any other labor authorities
including under the contract labor. Not applicable to BIDDERS based outside India.
9. Bidder should have registration under shops & establishments act.
10. Bidder should furnish three reference sites, the references should testify about the
performance.
11. Bidder engaged with MCX / attending the MCX premise should comply with all the
required statutory norms. Service Provider should adhere to all applicable laws, rules
and regulations in carrying out the Services.
12. Bidder personnel visiting the MCX premise should be insured in all aspects by
vendor.
13. Bidder shall ensure that its personnel will adhere to the MCX code of conduct,
processes and policies while at MCX’s premises.
14. Bidder shall be responsible for compliance of all statutory provisions relating to
minimum wages, Employees Provident Fund, Employees State Insurance, service tax
and any other laws/ taxes/ acts/ rules etc. governing the matter/ issues etc.
15. Bidder shall also be liable for depositing all taxes, levies, cess etc. on account of
service rendered by it, to the concerned tax collection authorities from time to time
as per extant rules and regulations on the matter. Not applicable to BIDDERS based
outside India.
16. Bidder shall observe the highest standard of ethics during the MCX procurement
process and Execution of the PO / service / support / contract
17. Bidder should ensure jurisdiction must be in India and as per Indian Law.
18. Bidder should have not black listed or debarred by any government organization
or/and by MIIs or/and by international similar institutes.

5. Implementation terms and conditions


• BIDDER/OEM should provide high level implementation design architecture to MCX
team considering best practices.
• Detailed implementation plan must be submitted post project kick-off meeting with
well-defined scope.
• BIDDER/OEM must adhere to the scope defined in implementation SOW.
• Implementation must be completed within mentioned time window as per SOW.
Penalty shall be levied upon BIDDER in case implementation will not get completed as
per SOW and within time window.
• Establishing and providing uninterrupted performance throughout the
implementation and afterwards will be the responsibility of BIDDER and OEM.
• MCX has sole rights to change the SOW in case of any additional configuration
requirement raised by management.

6. Location of services:
• Multi Commodity exchange of India limited Mumbai (DC) & Gift City- Gandhinagar,
Gujarat (DR)
7. Acceptance: -

The solution shall be considered accepted based on following points:

• Two weeks testing period will be used by MCX technology team to check product
functionalities post successful deployment. Acceptance of solution shall be based on
test period results. If the solution experiences no failure and function8 according to
the requirement of RFP, as determined by MCX, then the solution shall be considered
accepted.

8. Payment terms:

20% of PO value on delivery of material


70% of PO value on successful installation and sign off from MCX
Balance 10% of PO value against BG valid till warranty period.
Note: Bidders required to sign Agreement/Legal document with the Exchange. Until unless
Agreement is not signed, payment will not be processed.

9. Notification :
MCX may in its absolute discretion apply selection criteria specified in the document for
evaluation of proposals for short listing / selecting the eligible Bidder. MCX is not obliged
to provide any reasons for any such acceptance or rejection as evaluation process in
entirely internal.

Submission of proposal notifies deemed acceptation of terms as mentioned in this RFP


by Bidder.

The Exchange reserves the right to amend or modify the contents of RFP at any time
before date of bids submission. The decision of the Management Committee of MCX shall
be final

For any query, Bidder should contact within 3 days from the date of RFP uploaded on MCX
Website.

Post confirmation from bidder and receipt of expression of interest, the MCX team will evaluate
the responses received. Eligible bidder will receive the details about participating in e-bidding
process, through MCX authorized e-bidder. Techno commercial proposal to be submitted
Proposal will contain Configuration, Technical details, Eligibility criteria feedback, etc. along
with commercials, payment terms, other charges, Delivery, etc and should be password
protected and password to be shared when requested from MCX personnel.

11. Confidentiality: The RFP document is strictly confidential and is not to be disclosed,
reproduced, published in any manner, transmitted, or otherwise made available by the
Recipient to any other party. MCX may update or revise the RFP document or any part of
it at its sole discretion. The Recipient acknowledges that any such revised or amended
document received by it, shall be subject to the same terms and conditions as this original
and subject to the same confidentiality undertaking. All Information pertaining to the
Exchange obtained by the Solution Provider as a result of participation in this RFP /
project is confidential and must not be disclosed without prior written authorization
from the Exchange
12. Termination Clause: If the product / solution / services are not found to be satisfactory or
if any non-compliance in product / service with respect to RFP or breach of delivery terms,
SLA, uptime then MCX reserves the right to terminate the contract / Purchase Order (PO)
giving notice to the bidder. Bidder should refund the payment done by MCX, if any.
If delivery / installation not completed within 6 months of PO date, MCX reserves right to
terminate the PO. Bidder should refund the payment done by MCX, if any.
