Notice of appointment/termination of an Engineer is to be: accompanied by a supplementary form in the proforma given in D.G.M.S. eireular 8 of 1968, © Signing of notice of appointment of Agent. Notice of appointment should be signed by the owner and not by the manager or the agent, ‘{8.4. Appointment of agent—(1) The owner of a mine shall submit in writing to Chief Inspector and the Regional In- Spector, statement showing name and designation of every berson authorised to act on behalf of the owner in respect of management, control, supervision or direction of the mine. (2) The statement shall also show the responsibilities of every such person and the matters in respect of which he is authorised to act on behalf of the owner. (3) Every such person shall be deemed to be agent for the mine or group of mines, as the case may be, in respect of the responsibilities as specified in such statement. (4 The statement aforesaid shall be submitted within one month from the date of coming into force of the Coal Mines (Amendment) Regulations 1985, in the case of mines already opened, or reopened as the case may be, and in other cases within one month from the date of opening or reopening of the mine. (5) Any change, addition or alteration in the names or other particulars of the aforesaid statement shall be reported in writing to the Chief Inspector and the regional inspector thin seven days from the date of change, addition or alter, 9. [Board of Mining Examinations—(1) For the pur- pose of these regulations, there shall be constituted a Board of Mining Examinations (hereinafter referred to as ‘the Board’) (2) The Board shall consist of the Chief Inspector, who shall be and five members possessing technical qualifications in mining, and (a) having practical experience in coal mines, or (b) serving in an institution imparting education in mining engineering at the degree or equivalent level, or (© engaged in mining research, to be appointed by the Central Government : Provided that the Board shall be so constituted that it shall include at least three members possessing qualifications laid down in clause (a) and at least one member possessing Qualifications laid down either in clause (b) or in clause (c). (3) Every member (other than the Chairman) of the Board shall hold office for a period of three years from the date of the notification appointing him a member of the Board or until his successor is appointed and takes charge whichever is later Provided that— (i) a member may at any time resign his offic (i) a member appointed under clause (b) of. sub- regulation (2) shall cease to hold office upon his ceasing to serve in any such institution, as is referred to in that clause; iii) @ person appointed to fill a vacancy caused by reason of the death, resignation or by reason of cesser of office under sub-clause (ii), of a mem- ber, shall hold office for the remaining period 1. (5) A member of the Board (other than the Chairman) shall receive such remuneration as the Central Government may fix. Examinations and examiners—(1) Certificate shall be granted to candidates after such examinations and in such form as the Board may specify. *{Provided that the Board may, subject to the conditions specified in the bye-laws, exempt any person “{ —_] from ap- pearing at the examination or part thereof for the grant of a certificate referred to in regulation 12.] (2) The examination shall be held at such times and at such centres as may be fixed by the Board, and shall be con- ducted by examiners appointed by the Board. No. G.S.R. 614(B), dated 30.7.1966. 1968, EXAMINATION AND CERTIFICATES OF COMPETENCY AND OF FITNESS (3) The examiners so appointed shall be subject to the orders of the Board in respect of all matters relating to the conduct of the examinations, and shall receive such remunera- tion as the Board, with the sanction of the Central Govern- ment, may fix. (@ '[The Board may make bye-laws as to the procedure for, and the conduct of the examinations] and as to the grant- ing of certificate of competency and of fitness as required un- der these regulations, and shall so far as may be practicable, provide that the standard of knowledge required for the grant of certificates of any particular class and the standard of medi- cal fitness shall be uniform throughout the territories to which these regulations extend. (5) Every bye-law made by the Board under this regula- tion shall be published in the Official Gazette; and no such bye-law shall have effect until three months after the date on which it was so published. 14. Submission of application—(1) Application for an examination conducted by the Board shall be made to the Board not less than 60 days prior to the date fixed for the ex- amination and on a form supplied for the purpose. (2) Notice regarding the date and place of examination for the Manager's Surveyor's and Overman's certificates shall be published under the order of the Board in such periodicals as the Board may direct, not less than 60 days prior to the date fixed by the Board for receiving applications. © Certificate of experience. The certificate of exper ence must.be in the prescribed form and signed by Man- ager and not by Production Manager/Ventilation Of ficer/Safety Officer etc. Manager's signature must be dated by the manager with the seal of his office. Capac: ity, nature of work done, place, experience and dates of commencement and termination of training must be clearly indicated. Candidate must sign at the specified place. For the purpose of awarding a Second Class (exemption) Certificate to a candidate having a foreign degree in mining, out of the requirement of two years’ experience, atleast one year should be post graduate practical experience, including atleast six months’ post-graduate approved experience in Indian mines, (BME- 22.8.1986) 5, Decisions of the Board of Mining Examination regarding Scheme of Examination, 1. (a) Candidate cannot be permitted to change the scheme of examination opted by him. (b) A candidate can change the scheme of examination for a subsequent examination. (c) If a candidate has passed in any subject/subjects, he will be’ given credit for the same in the subsequent examination (as per byelaws). (@) Any candidate may take the advantage of any concession in the period of training/service required for appearing in any examination and still appear in all the Papers for that examination. For clearing an examination in stages, three consecutive examinations means three consecutive exami- nations conducted by the Board, In the 5th year, the cai date ceases to enjoy any exemption, (BME- 20.10.1976) 3.
