Lease Agreement

The Resident __________________________________________________________________________


and Norhart agree to the following terms.
1. Home
Norhart agrees to rent to the Resident the Home located at
Legacy Pointe Apartment, 290 9th Ave SW # , Forest Lake, MN 55025

2. Term
This lease will start on ______________ and end on ______________ (the Expiration Date). The
Expiration Date will automatically extend for one-month periods until either party provides a written
notice at least 60 days before the Expiration Date. The rent may be increased at each extension.

3. Rent

1. The Resident agrees to pay Norhart $________ on the first day of each month.
2. The Resident will pay a late fee equal to 8% of the overdue rent payment as of noon the fourth
day of the month. The Resident will pay $30 for each returned payment.
3. Payments will be applied first to the security deposit then to other fees and lastly to the rent.
4. Each Resident is individually responsible for paying the full amount due and must pay rent
through the Expiration Date even if the Resident moves out or is evicted.
5. Acceptance of less than the full amount due does not waive Norhart’s right to recover
possession of the Home including filing eviction.
6. If resident has a returned payment, Norhart may request future payments be made via
certified funds. Cash is not accepted.
7. Payment via ACH is free to residents and highly encouraged. The following convenience fees
are charged to residents: Credit card fees 3.75%, Debit cards $6.95 per transaction. Checks
$1.00 per check or money order.
4. Security Deposit
The Resident agrees to pay a $________ security deposit. Norhart may keep all or part of the security
deposit for damage to the Home or other money owed. Deposit waiver fees are non-refundable.

5. Utilities
The Resident agrees to pay for the following utilities.

The fee is calculated by prorating the building’s total utility cost either by the usage amount if known
or otherwise by the number leased units plus a $5.00 monthly service fee. The cost of on-site water
and power generation will be calculated using the same rate charged by the local utility company.
Upon resident request, management will provide a copy of the actual utility bill for the building.
6. Move Out
The Resident agrees to:

1. Provide a 60-day written move-out notice.


2. Move out by noon on the Expiration Date.
3. Return the Home in the same condition it was received except for reasonable wear and tear.
4. If resident fails to fully complete the lease for any reason, resident will repay any promotions,
specials, or concessions provided and management may escalate the remainder of the lease.
7. Smoking
Smoking and vaping is allowed outside in designated areas only. The Resident will pay $200 per
violation. Smoking cannabis is not allowed to be smoked anywhere in the community.
8. Renter’s Insurance
The Resident must maintain a renter’s insurance policy. The Resident will pay a $30/month penalty for
non-compliance. Norhart is not responsible for damage or loss of personal possessions.

9. Pets
All pets except _________________________________________ are not allowed in the Home. For each
violation, Resident will pay a fine of 200% of the monthly pet fee times the number of months since the
move-in date. DNA samples are required from each dog. The Resident agrees to clean up after their pet
and will pay $300 for each violation. All pets require appropriate licenses.

10. Eviction
If the Resident violates any term of this lease then Norhart may terminate this lease immediately. The
Resident will pay $200 per eviction filed and will pay Norhart’s attorney and eviction costs.

11. Community Rules


The Resident agrees to the community rules. Each violation may result in a fine up to $500. Norhart may
make reasonable changes to the community rules if notice is given to the Resident.

12. Miscellaneous Terms

1. Only the people listed as Residents may live in the Home. The Home will not be subleased.
2. The Resident agrees to keep the Home in good condition and not make any alterations.
3. The Resident agrees to pay for the costs to remedy any violation of this lease.
4. Norhart may enter the Home for business purposes including providing tours to new residents.
5. The Resident indemnifies and holds Norhart and their affiliates harmless from liability arising
from the Resident or Resident’s guest use of the community amenities.
6. Norhart does not guarantee the speed or reliability of the internet. Norhart may terminate or
throttle any internet user that causes harm to the community internet.
7. Resident agrees to not act, or allow guests to act, in a loud, unruly, or thoughtless manner.
8. Norhart is a paperless company. Resident agrees to consent for electronic notices as proper
notificiation.
9. If the Home is destroyed or unlivable, Norhart may terminate this lease.
10. Norhart, located at 1081 4th St SW #400, Forest Lake, MN 55025, is the agent authorized to
accept legal notices and demands.

Community Rules
We have one rule:

Be kind. Be good.

Be Kind

Being kind means to your neighbors well. For example:

• Say hi to your neighbors!


• Believe your neighbors have good intentions because they usually do.
• Do not be too noisy especially between 10pm and 7am.
• Be mindful of your children.
• Keep your pets on a leash and do not let them act aggressively toward others.
• Use your Home and community services only for personal residential use.
• Be somebody’s reason they smile!

Be Good

Being good means to keep the property in good condition. For example:

• If you spill or drop something, clean it up. Anything left out may be thrown away.
• Dragging items down the hallway leaves burn marks in the carpet. Please do not do it.
• Do not walk through the hallways with dirty or greasy shoes.
• Please do not store items or repair vehicles in the underground parking.
• Disallow dangerous activities like grilling on your deck or using kerosene heaters.
• Follow the posted signage and notices.
• Only park in the parking lot if you have a valid parking permit. Otherwise you may be towed.
• Cooperate with any pest control efforts.
• Let us know right away if you discover any maintenance issues.

Other Authorities

Other authorities like cities and homeowner’s associations have own rules you should follow. They may
issue penalties. One common rule is limits to on-street parking. For example, Forest Lake does not allow
overnight street parking. Gateway Green Townhome Association does not allow any street parking.
