RULES:

Vicarious liability is defined as "someone who does an act through another


executes the act as if it were done by himself." It is first decided by the
notion of "respondeat superior," which states that a superior is
responsible for a subordinate's improper act committed while on the job.

There are essentially three aspects that must be taken into account in
order to prove vicarious culpability on the part of a person - The
fundamentals of vicarious responsibility include a certain form of
connection, as well as a wrongful act committed by a subordinate during
the course of employment.

Superior subordinate- It is a relationship in which one party is in a higher


position than the other and has the authority to give orders to the latter.
This partnership can also be classified as a 2-master servant relationship
or a relationship between independent contractors.

An independent contractor (contract for service) is a situation in which


one party in a higher position directs a subordinate to complete a task.
The superior, on the other hand, does not have the power to regulate the
inferior's actions while performing such labour. In this instance, superior
is not accountable for any actions taken by inferior while doing the task.
