Orcales, ORDINANCE Numbered 60 (Series of 2022) AN ORDINANCE CREATING THE CITY DISASTER RISK REDUCTION MANAGEMENT OFFICE AS A DEPARTMENT IN THE CITY GOVERNMENT OF BAGUIO. Explanatory Note Republic Act No. 10121 {An Act Strengthening the Philippine Disaster Risk Reduction and Management System, Providing for the National Disaster Risk Reduction and Management Framework and Insititionalizing the National Disaster Risk Reduction and Management Plan, Appropriating Funds Therefor and for Other Purposes, otherwise known as the “Philippine Disaster Risk Reduction and Management Act of 2010”, mandates the creation of local disaster risk reduction and management offices at the provincial, city, ‘municipal and barangay levels. ‘The National Disaster Risk Reduction and Management Council (NDRRMC)-Department ofthe Interior nd Local Goverment (DIL) Departinen of Budget and Managemest (DBM).Civi Service Commission (CSC) Joint Memorandum Circular No. 2014-01 provides the Implementing Guidelines for the establishment of local disester risk reduction and management (DRICM) offices or Barangay DRRM Committees (BDRRMC3) in local government units. Mainstreaming of the DRRM in all the processes principally requires the institutionalization and organization of is structures, in all levels of government nationwide where local DRRM plans and policies will be developed, and where implementation of action s and measures pertaining to all aspects of DRRM will be initiated, ‘The City Disaster Risk Reduction and Management Office (CDRRMO) was initially established under the City Administrator's Office and subsequently transferred in 2019 under the City Mayor's Office equivalent to a division of a city department. TO Ordinance Numbered 60, Series of 2022, page 2. Recognizing the city’s fragile environment and vulnerability to hazards, together with its functional roles, among others, 28 a major tourist destination, a prime education center, the center for trade, business and commerce, and is the seat of the government in the Cordillera Administrative Region, the existing CDRRMO set-up could not fully and efficiently perform all the tasks and functions as stipulated in Republic Act No. 10121 and its implementing guidelines. NOW, THEREFORE, on motion Hon. Bagbagen, Hon. Cosalan and Hon. Fianza, duly seconded, BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD (CITY COUNCIL) IN SESSION ASSEMBLED THAT: GENERAL PROVISIONS ARTICLE 1 PRELIMINARY PROVISIONS SECTION 1. TITLE. ~ This Ordinance shall be known as the “City Disaster Risk Reduction and Management Office Ordinance in the City of Baguio”. SECTION 2. DECLARATION OF POLICY. - It is hereby declared the policy of the City Government of Baguio to, as follows: Uphold the poople’s rights to life and property by addressing the root causes of vulnerabilities to disasters, strengthening the city’s institutional capacity for disaster risk reduction and management, and building the resilience of the local community to disasters including climate change impacts; Adhere to and adop: the universal norms, principles and standards of humanitarian assistance and the global effort on risk reduction as a concrete expression of the city's ‘commitment to overcome human suffering due to recurring disasters; Incorporate internationally accepted principles of disaster risk management in the creation and implementation of local sustainable development and poverty reduction strategies, policies, plans and budgets; 4. Adopt a disaster risk reduction and management approach that is holistic, comprehensive, integrated, and proactive in lessening the sociocconomic and environmental impacts of disasters including climate change, and promote the involvement and participation of all sectors and all stakeholders concerned, at all levels, especially the local community; ©. Develop, promote and implement a comprehensive Local Disaster Risk Reduction and Management Plan (LDRRMD) that aims to strengthen the capacity of the local government together with partner stakeholders, to build the disaster resilience of communities, and to institutionalize the arrangements and measures for reducing disaster risks, including projected climate risks, and enhancing disaster preparedness and response capabilites at all levels; £ Adopt and implement a coherent, comprehensive, integrated, efficient and responsive disaster risk reduction program incorporated inthe local development plans adhering {0 the principles of good governance such as transparency and accountability within the context of poverty alleviation and environmental protection; g. Mainstream disaster risk reduction and climate change in development processes such a policy formulation, socio economic development planning, budgeting and ‘governance, particularly in the areas of environment, agriculture, water, energy, health, ‘education, poverty reduction, land-use and urban planning, and public infrastructure and housing, among others; hh, Institutionalize the policies, structures, coordination mechanisms and programs with continuing budget appropriation on disaster risk reduction at the local levels towards building a disaster-resilient nation and communities; i, Mainstream disaster risk reduction into the peace process and conflict resolution approaches in order to minimize the loss of lives and damage to property, and ensure that communities in conflict zones can immediately go back tothe normal lives during, periods of intermittent conflicts; 4, Ensure that disaster risk reduction and climate change measures arc gender-responsive, sensitive to indigenous knowledge systems, and respectful of human rights; k, Recognize the local risk patterns and strengthen the capacity of local government units for disaster” risk reduction and management through decentralized powers, responsibilities and resources at the local level; 1. Recognize and strengthen the capacities of local government units and communities in mitigating and preparing for, responding to, ae of disasters; Ordinance Numbered 60, Series of 2022, page 3. SECTION 3. DEFINITION OF TERMS. age the participation of civil society organizations (CSOs), the private sector and voluuicers “in the government's disaster risk reduction programs towards complementation of resources and effective delivery of services to the citizenry; Develop and strengthen the capacities of vulnerable and marginalized groups to mitigate, prepare for, respond to, and recover from the effects of disasters; Enhance and implement a program where humanitarian aid workers, communities, health professionals, government aid agencies, donors and the media are educated and trained on how they can actively support breastfeeding before and during a disaster and/or an emergency; and Provide maximum care, assistance and services to individuals and families affected by disaster, implement emergency rehabilitation projects to lessen the impact of disaster, and facilitate the resumption of normal social and economic activities. ARTICLE I DEFINITION OF TERMS The following words, terms and phrases as used in this Ordinance shall mean, as follows: a Capacity ~ a combination of all strengths and resources available within a community, society or organization that can reduce the level of risk, or effects of a disaster, Capacity may include infrastructure and physical means, institutions, societal coping abilities, && well as human knowledge, skills, tools, systems, processes, appropriate technologies and collective attributes such as social relationships, leadership and management. Capacity may also be described as capability; Civil Defense ~ disaster sdness and prevention activities, other than military actions, geared towards the reduction of loss of life and property brought about bY natural and human-induced disasters. Civil Defense may also be referred to as Civil Protection; il Society Organizations (CSOs) ~ non-state actors whose aims are neither to generate profits not to seck governing power. CSOs unite people to advance shared goals and interests. They have a presence in public life, expressing the interest and. values of their members or others, and are based on social, ethical, cultural, scientific, religious or philanthropic and other considerations. CSOs include non-government organizations (NGOs), professional associations, foundations, independent research institutes, community-based organizations (CBOs), faith-based organizations, people’s organizations, social movements, and labor unions; Climate Change ~ a change in climate that can be identified by changes in the mean and/or variability of its ties and that persists for an extended period typically decades or longer, whether due to natural variability or as a result of human activity; Contingency Planning ~ a management process that analyzes specific potential events cor emerging situations that might threaten society or the environment and establishes arrangements in advance to enable timely, effective and appropriate responses to such events and situstions; ster — a serious disruption of the functioning of a community ora society involving widespread human, material, economic or environmental losses and impacts, which exceeds the ability of the affected community or society to cope using its own resources, Disasters are often described as a result of the combination of: the exposure to a hazard; the conditions of vulnerability that are present; and insufficient capacity or measures to reduce or cope with the potential negative consequences. Disaster impacts may include loss of life, injury, disease and other negative effects on human, physical, mental and social well-being, together with damage to property, destruction of assets, loss of services, social and economic disruption and environmental degradation; Disaster Mitigation - the lessening or limiting the adverse impacts of hazards and related disasters. Mitigation measure encompass engineering techniques and hazard- resistant construction as well as improved environmental policies and public awareness; ster Preparedness — the knowledge and capacities developed by governments, professional response and recovery organizations, communities and individuals 10 ‘effectively anticipate, respond to, and recover from, the impacts of likely, imminent or current hazard events or conditions. Preparedness aclion is carried out within the context of disaster risk reduction and management and aims to build capacities needed to efficiently manage all types of emergencies and achieve orderly transitions from response to sustained recovery; Ordinance Numbered 60, Series of 2022, page 4. i, Disaster Prevention — the outright avoidance of adverse impacts of hazards and related disasters. It expresses the concept and intention to completely avoid potential adverse impacts through actions taken in advance such as construction of dams or embarkments that eliminate flood risks, land-use regulations that do not permit any settlement in high "sk zones, and selamic engineering designs that ensure the survival and function ofa critical building in any likely earthquake; ster Response ~ the provision of emergency services and public assistance during or immediately after a cisaster in order to save lives, reduce health impacts, ensure public safety and meet the basic subsistence needs of the people affected. Disaster response is predominantly focused on immediate and short-term needs and is sometimes called “disaster relief”; k. Disaster Risk the potential disaster losses in lives, health status, livelihood, assets and services which could occur to a particular community or a society over some specified future time period; 1. Disaster Risk Reduction ~ the concept and practice of reducing disaster risks through systematic efforts to analyze and manage the casual factors of disasters, including through reduced exposures to hazards, lessened vulnerability of people and property, wise management of land and the envizonment and improved preparedness for adverse events; m. Emergency — unforeseen or sudden occurrence, especially danger, demanding iate action; 1, Hazard ~ a dangerous phenomenon, substance, human activity or condition that may cane lose of life injury or other health impact, property Garage, lose of iveliioed and services, social and economic disruption, or environmental damage; ©. Rehabilitation — measures that ensure the ability of affected communities/areas to estore their normal level of functioning by rebuilding livelihood and damaged infrastructures and increasing the communities’ organizational capacity; p. Resilience - the ability of a system, community or society exposed to hazards to resist, absorb, accommodate and recover from the effects of a hazard in a timely and efficient manner, including through the preservation and restoration of its essential basic structures and functions; 4. Risk Assessment — a methodology to determine the nature and extent of risk by analyzing potential hazards and evaluation existing conditions of vulnerability that together could potentially harm exposed people, propery, services, velihood and the environment on which they depend. Risk assessments with associated risk mapping include: a review of the technical characteristics of hazards such as their location, intensity, frequency and probability; + Risk Management - the systematic approach and practice of managing uncertainty to ‘minimize potential harm and loss. It comprises risk assessment and analysis, and the implementation of strategies and specific control, reduce and transfer risk. Itis widely practiced by organizations to minimize risk in’ investment decision and to address ‘operational risk such as those of business disruption, production failure, environmental damage, social impacts and damage from fire and natural hazards; s. State of Calamity — a condition involving mass casualty and/or major damages to property, disruption of means of livelihood, roads and normal way of life of people in the affected areas as a result of the occurrence of a human-induced hazard; t Volunteer — individual/person or group who for reasons arising from their socio- developmental, business and corporate orientation, commitment or conviction, contribute time, eervice and resources whether ona fll-ime or parttime basis to aust and essential social development cause, mission or endeavor in the belief that their activity is mutually meaningful and beneficial to public interest as well as to themselves; u, Vulnerability — the degree to which a system is susceptible to, or unable to cope with the adverse effects of climate change, including elimate variability and. extremes, ‘Vulnerability may arise from various physical, social, economic and environmental factors such as poor design and construction of buildings, inadequate protection of assets, lack of public information and awareness, limited official recognition of risks and preparedness measures, and disregard for wise environmental management; and v. Vulnerable and Marginalized Groups — members of the society that face higher exposure to disaster risks and poverty including, but not limited to, women, chiléren, elderly, dfferently-abled people, and ethnic minorities, +[O Ordinance Numbered 60, Series of 2022, page 5. ARTICLE 11 CITY DISASTER RISK REDUCTION AND MANAGEMENT OFFICE. SECTION 4. CREATION, ~ There shall be a created department office of the City Government of Baguio and henceforth be called the City Disaster Risk Reduction and Management Ottice (CDRRMO) pursuant to Section 12 of Republic Act No. 1OLsl and Senn ee Implementing Guidelines. SECTION 5. Functions of the CDRRMO. ~The CDRRMO shall be responsible for setting the direction, development, implementation, and coordination of disaster risk reduction and ‘management programs, and shall perform the following functions and those that may be authorized by the City Disaster Risk Reduction and Management Council (CDRRMC): a, DRRM Research and Planning al. Design, program, and coordinate DRRM activities, consistent with the NDRRMC’s standards and guidelines; 2. Facilitate and support risk assessments and contingency planning activities at the local level; 3. Consolidate local disaster risk information which includes natural hazards, vulnerabilities, and climate change risks, and maintain a local risk map; a4. Conduct research and development initiatives on DRRM; a5. Formulate and implement a comprehensive and integrated Local DRRM Plan (LDRRMP) in accordance with the national, regional, and provincial framework, and policies on DRR in close coordination with the Local Development Couned c)s a.6. Prepare and submit to the Sangguniang Panlungsod (City Council) through the City DRRM Couneil and the LDC annual CDRRMO Plan and Budget, the proposed programming of the LDRRMF, other dedicated DRRM resources, and ‘other regular funding source/s and budgetary support of the CDRRMO:; 2.7. Maintain a database of human resource and their capacities, equipment, directories, and location of critical infrastructures. such as hospitals and evacuation centers; Serve as the Secretariat and executive arm of the CDRRMC; Recommend through the CDRRMC the enactment of local ordinances consistent with Republic Act 10121; 8.10. Prepare and submit, through the CDRRMC and the LDC, the report on the utilization of the LDRRMF and otiter dedicated DRRM resources to the local COA, copy furnished the regional director of the Office of the Civil Defense (OCD) and the local government operations officer of the DILG; and a.11, Involve the most vulnerable sectors (women, children, senior citizens, and PWD) in risk assessment and planning. a.12. Assist the BORRMCS in the formulation/updating of their Barangay Disaster Risk Reduction and Management Plan and Contingency Plan using. prescribed guidelines; and a.13, Render DRRM-related technical assistance to city departments and CDRRMC upon request >. DRRM Administration and Training ba. "Organize and conduct training, orientation, and knowledge management activities on DRRM at the local level; .2. Identity, assess and manage the hazards, vulnerabilities, and risks that may occur in their locality; b.3. Identify and implement cost-effective risk reduction measures and strategies; bd, Disseminate information and raise public awareness about those hazards, vulnerabilities, and risks; b.5. Take all necessary steps on a continuing basis to maintain, provide, or arrange the provision of, or to otherwise make available, suitably trained and competent | for effective civil defense and DRRM in its area; 6, Brgonize, train, equip and supervise the local emergency response teams and the accredited community disaster volunteers (ACDVs), ensuring that humanitarian aid workers are equipped with basic skills to assist mothers to breastfeed; 7. Within its area, promote and raise public awareness of, and compliance with Republic Act 10121 and legislative provisions relevant to the purpose of the latter, 8. Implement policies, approve plans and programs of the CDRRMC consistent with the policies and guidelines laid down in Republic Act 10121; and 9. Train the most vulnerable sectors (women, children, senior citizens, and PWD) in DRRM, especially in disaster preparedness, ¢. DRRM Operations and Warning cl. Operate a multi-hazard carly warning system, linked to DRR to provide accurate and timely advice to national or local emergeucy response organizations and to the general public through diverse mass media, particularly radio, landline ‘communications, and technologies for communication within rural communities, TiO Ordinance Numbered 60, Series of 2022, page 6. 02. 3. od, cS. c6. ce, C8. 39. Conduct continuous disaster monitoring and mobilize instrumentalities and entities of the LGUs, CSOs, private groups, and organized volunteers, to utilize their facilities and resources for the protection and preservation of life and properties during emergencies in accordance with cxisting policies and procedures; Develop, strengthen, and operationalize mechanisms for partnership or networking with the private sector, CSOs, and volunteer groups; Respond to and manage the adverse effects of emergencies and carry out recovery activities in the affected area, ensuring that there is efficient mechanism for immediate delivery of food, ‘shelter, and medical supplies for women and children, endeavor to create a special place where internally-displaced mothers can find help with breastfeeding, feed and care for their babies and give support to each other; Coordinate other DRRM activities; Establish linkage and/or network’ with other LGUs for DRR and emergency response purposes; Establish a city DRRM Operation Center; Give early waming to the most vulnerable sectors (women, children, senior citizens, and PWD) to respond to their needs; and Respond toand manage the adverse effects of emergencies and carry out recovery activities in the most vulnerable areas, especially for the vulnerable sectors (women, children, senior citizens, and PWD). SECTION 6. Composition and Structure. ~ The CDRRMO organizational structure below shows the BCDRRMO structure and its linkage to waming agencies, response offices, and Barangay Disaster Risk Reduction and Management Committees (BDRRMCS), volunteers, non- ‘government organizations and civil society organizations.
