APPLICATION FOR HEARING DATE FOR MOTION ON NOTICE DATED 26/10/2022


AND FILED 27/10/ 2022 IN APPEAL NO. CA/MK/201/2022 BETWEEN UNITED
BANK FOR AFRICA PLC V OYEINTEKE GLOBAL NETWORK NIG LTD.

We are Counsel to United Bank for Africa Plc (UBA), the Appellant in the above-
referenced appeal. On the 24th June 2022 the trial Court delivered Judgment
against the Appellant (UBA) and ordered it to pay the sum of N725, 345,372.77
(Seven hundred and Twenty-five Million, Three hundred and forty-five
thousand, three hundred and seventy-two naira, seventy-seven kobo) only, to
Respondent/Respondent in its account domiciled with Appellant.

Consequent upon the foregoing, Appellant immediately filed a Notice of appeal


and Motion for stay of execution dated 24 th June 2022 respectively in a bid to
prevent the execution of the Judgment pending the outcome of its appeal at
the Court of Appeal. Appellant have also filed its brief of argument and a
motion to regularize the time within which to compile and transmit Record of
Appeal against the judgment of the trial court.

The said motion seeking to regularize the time within which Appellant can
compile and transmit Record of Appeal filed in the registry of this court is yet
to be heard as no date has been assigned for its hearing

However, we kindly wish to notify you that the trial court has unfortunately
refused to stay further proceedings in respect of the suit despite the fact that
Appellant have notified it of the pendency of the Notice of Appeal and motion
for stay of execution by serving same on it. It is on the basis of this fact that
we as a matter of urgency apply for date for hearing of our motion dated 26 th
October 2022 and filed 27th October 2022 seeking to regularize the record of
appeal already compiled and transmitted so that this Court of Appeal will be
completely seised of the jurisdiction to entertain this matter.

We humbly ask for the shortest possible date for hearing of our application as
any continuous delay in hearing of the application may irreparably harm the
best interest of our client. We will be most grateful if our humble request is
treated with utmost sense of urgency by giving it prompt consideration.

Please find attached a copy of the said Motion for your kind attention.
