RESOLUTION URGING ALL MINISTRIES TO OBSERVE AND COMPLY WITH THE
RULES AND PROCEDURES ON LAND USE CONVERSION OF AGRICULTURAL
LANDS WITHIN THE BANGSAMORO REGION

WHEREAS, the Constitution in Sec. 4, Art. XIII, mandates the just distribution of
all agricultural lands, subject to such priorities and reasonable retention limits that the
Congress may prescribe, taking into account ecological, developmental or equity
considerations and subject to the payment of just compensation.
WHEREAS, the term agricultural lands refers to "lands devoted to or suitable for the
cultivation of the soil, planting of crops, growing of fruit trees, raising of livestock, poultry or fish,
including the harvesting of such farm products, and other farm activities and practices performed by
a farmer in conjunction with such farming operations done by a person whether natural or juridical,

and not classified by the law as mineral, forest, residential, commercial or industrial land."
WHEREAS, Section 65 of RA 6657 provides that Conversion of Lands. — After
the lapse of five (5) years from its award, when the land ceases to be economically feasible and
sound for agricultural purposes, or the locality has become urbanized and the land will have a
greater economic value for residential, commercial or industrial purposes, the DAR, upon
application of the beneficiary or the landowner, with due notice to the affected parties, and
subject to existing laws, may authorize the reclassification or conversion
WHEREAS, the Bangsamoro Administrative Code Section 3, Chapter 1, Title I, Book
VI provides that the MAFAR shal exercise exclusive authority to approve or disapprove
conversion of agricultural lands for residential, commercial, industrial, and other land uses as
may be provided for by law;
WHEREAS, Titlw Vi Chapter I Section 2. Mandate.- The Ministry of Human
Settlements and Development shall act as the primary agency for the management of housing,
human settlement, and urban development in the Bangsamoro Autonomous Region. It shall be
the main planning and policy-making, regulatory, program coordination, and performance
monitoring entity for all housing, human settlements, and urban development concerns. It shall
develop and adopt a regional strategy to immediately address the provision of adequate and
affordable housing to all inhabitants in the Bangsamoro Autonomous Region.
NOW, THEREFORE, be it
RESOLVED, as it is hereby resolved by the Bangsamoro Transition Authority to
appropriate funds in support to the implementation of Executive Order no. 75 Series of 2019
within Bangsamoro Region through the Ministry of Agriculture, Fisheries, and Agrarian Reform
to ensure fast and just land distribution to qualified farmer beneficiaries.
RESOLVED, FURTHER, to urge the Bangsamoro Government through the Ministry of
Agriculture, Fisheries, and Agrarian Reform to provide an update on the status of all
Government Owned Lands already covered by the Executive Order No. 75 Series of 2019 as
well as other GOL yet to be covered within the Bangsamoro Region.
RESOLVED, FINALLY, That a copy of this resolution be furnished to the Office of the
Chief Minister and the Ministry of Agriculture, Fisheries, and Agrarian Reform of the
Bangsamoro Autnomous Region in Muslim Mindanao, for their information.
