CONTRACT OF LEASE OF REAL PROPERTY

KNOW ALL MEN BY THESE PRESENTS:

This Contract of Lease made and executed by and between:

LEONARD HOFSTADTER, of legal age, single, Filipino, and


resident of Poblacion Zone 18, Baybay City, Leyte and hereinafter
referred to as the “LESSOR”,

-and-

SHELDON LEE COOPER, of legal age, single, Filipino, and a


resident of Brgy. Bitanhuan, Baybay City, Leyte and hereinafter
referred to as the “LESSEE”,

-WITNESSETH-

Whereas, the LESSOR is the owner of a parcel of land, located


at Brgy. Ampihanon, Baybay City, Leyte on which the residential
structure owned by the LESSEE is erected;

Whereas, the LESSOR agrees to lease unto the LESSEE and the
LESSEE accepts to lease from the LESSOR, the said portion of
residential structure owned by the LESSEE particularly described as
follows:

“A parcel of residential lot located at Brgy. Ampihanon,


Baybay City, Leyte, with an area of two hundred (200)
square meters, covered by Original Certificate of Title No.
0278 issued by the Register of Deeds of the Province of
Leyte, declared for taxation purposes in the name of
Leonard Hofstadter under Tax Declaration No. 99-12012-
00150, designated as Cadastral Lot No. 1548 CAD-141-E,
Assesor’s Lot No. 20 with Market Value of two hundred
thousand pesos (P200,000.00) Philippine currency,
bounded as follows: East by Lot 279, South by Lot 189,
North by Lot 072, and West by Lot No. 019.”

The LESSEE acknowledges to have inspected and received


possession of the leased premises, herein above specifically described,
in good and tenantable condition, the LESSOR hereby lets and lease
unto the LESSEE, who hereby accepts the lease of the premises;

NOW THEREFORE, for and in consideration of the above
premises and covenant provided below, the LESSOR hereby leases the
above-mentioned property to the LESSEE who accepts it, under the
following terms and conditions:

1. LEASED PREMISES – This lease is hereby constituted on the


above-mentioned property of the LESSOR.

2. RENTAL RATE: - The monthly rental rate for the leased


premises shall be in PESOS: FIFTEEN THOUSAND PESOS
(P15,000.00), Philippine Currency, one (1) month advance and
one (1) month deposit, all rental payments shall be payable to
the LESSOR.

3. TERM OF LEASE AND RENEWAL - The lease contract shall be


for a period of twelve (12) months, to commence on October
1, 2023 up to September 30, 2024 renewable upon mutual
agreement of both parties hereto upon such further terms,
conditions and stipulations as they mutually agreed upon. The
renewal must be made and completed before the expiration of
this contract.

4. UTILITIES – Expenses for the electricity, water, telephone


services and other incidental utilities unique to the LESSEE and
rendered in his favor shall be for the LESSEE’S exclusive account.
Any and all utility bills for the account of and in favor of LESSEE
must be settled in full and accordingly by the LESSEE upon
termination of lease contract. The outgoing LESSEE shall furnish
the LESSOR copies of last bills and receipts showing compliance
to this paragraph.

5. RULES, REGULATIONS, ETC. – The LESSEE shall comply with


any and all reasonable rules and safety regulations which the
LESSOR or its duly authorized representatives may from time to
time promulgate.

6. ASSIGNMENT AND SUBLETTING - The LESSEE shall not


Assign, Sublease, Mortgage, Pledge or otherwise transfer this
Lease, or any interest therein, either voluntarily , involuntarily,
or by operation of law, and shall not sublease the Premises or
any part thereof, or any right or privilege appurtenant thereto,
for whatever reason and under whatever circumstance.

7. TERMINATION OF LEASE – Immediately upon termination of


lease, the LESSEE shall voluntarily vacate the premises within
thirty (30) days in the same clean, good and tenantable condition

in which the LESSEE received them, excluding all occupants,
excluding all occupants furniture, appliances and other movable
effects of any kind other than improvements, alterations or
conditions without reimbursements whatsoever to the LESSEE
and to surrender the keys of the premises unto the LESSOR.

8. RETURN OF THE PREMISES – Upon the expiration of this


lease or any renewal or extension hereof, the LESSEE shall,
without any need of prior notice or demand, written or otherwise,
peacefully vacate the leased premises and without controversy
restore possession thereof to the LESSOR or his agent, in the
same condition as it was at the time of the delivery, save what
has been lost or impaired by the lapse of time or ordinary tear
and wear or fortuitous event.
