OBJECTIVE

 Personal Objective
I have very little knowledge of practical aspects of courts, as it was my
first internship. During my internship I learned lot of practical aspects of
courts and learned many practical things, earlier I was not aware of all
these things. I learned drafting, to file civil suit in court,
 PROFESSIONAL OBJECTIVE
To gain practical knowledge, during my internships I learnt so many
practical knowledge-like cases reading, drafting legal document and
judgement reading, how to deal with the bail applications and different
procedure of the trial made during the criminal cases and also understand
that how to hear the different types of cases and also how to pass the
numerous orders in number of cases.
 ACADEMIC OBJECTIVE
This internship helps me to gain my degree and it will be help me in
future to make my future in the field of law. Before this internship I have
only little bit practical knowledge but after my internship I have more
practical knowledge in the criminal field i.e., procedure that how the
statement of the accused is recorded during the trial also learn that in
what conditions court grant the pardon to the accused and also learn the
credibility of the statement recorded under section 161 of the Crpc.

Today I came to the Advocate office of MR. ANAND KUMAR


JAISWAL . I had been asked to report to the office at 09:00 am sharp
on my first day. I was asked to give a short introduction and was
explained some basic rules to which I was supposed to adhere to, after
which sir explained the basics of law.
Where he gives his brief description and tell us what kinds of case he
deals and to which courts he works . And I seen how he deals with his
clients and how to maintain an advocate office .

It was an great experience for me to understand the thinks such as


handling the clients and maintain office .

Today, I listen
and ors, case no.170/15 a girl was kidnapped by the father of a boy who
wanted to marry her but couldn't as the girl was already engaged to another
person, the girl was found by police personnel during the night of kidnap
only as the father of the girl had a intuition that only the boy's family would
do such a thing, the case is registered under 363, 366 IPC.

I saw the proceedings in the case of Megha vs. Ritik .
. After sometime of her marriage she tortured so much that she afterwards
she decided to go back her paternal home. In court she filled a case of
domestic violence against his husband and in- laws.

Under section 12 of domestic violence act 2005. Court order the Ritik to give
maintenance under section 125 of CRPC to Megha because Megha was a
housewife. Afterwards court sends them for mediation but mediation was
unsuccessful because both parties cannot come to the solution. At
last court gave the last chance to ritik to keep her wife respectfully and don’t
tortured her for unlawful demand and court fixed the date to present on court
after 15 days to give report how they are living.

Today I again came to the high court Gwalior and visit double bench
court room where we see the working of double bench . Then advocate
tell me the first stage of filling the case that we have to prepare a case
then have to submit in the filling department of the court from where
automatically it reaches to the desk of judge .

Today I learned how to fill Vakalatnama.
In Vakalatnama you have to write name of petition and respondent of the
case. Then detail for whom behalf you are fighting the case. At the last you
have to write your Enrollment No. of bar council, your address of office, your
ph. no. and your full sign. And stamp as required .

sir taught me more briefly about the writs.

Facts of Case :
On 07. 10. 2015 Sajal with some people came and threatening of killing him,
and tell him to give all the money, gold and jewelry. They take all the money
and jewelry from his house. They all take him with them and dacoity 10 other
house of that area.

This case is related with the case of cheque dishourned under section 138 of N.I
( Negotiable Instrument )Act .
My advocate on behalf of yogendra singh bhadoria present a bail application
under section 437 of CRPC.

Today, Sir told me to read the case of VD Bhanot V. Savita Bhanot to know
whether the cases which are filled for domestic violence before the
commencement of the protection of woman from domestic violence act 2005
will be govern by this act or not. After reading the case, I came to know that
Supreme court ordered in this case that the action is maintainable even if it
was done before coming into the force of act. Because the Legislature’s intent
to include those women who are victim of domestic violence before coming
into the force of act. This was clear from the definition given of the terms
“aggrieved person” “domestic relation” in the act.

On this day, I had seen the statement of 164 of CRPC. In 164 statements
every person are send out of the court. Expect judge and plaintiff. And
plaintiff gives her statement and after she gives her statement court asked her
that you are giving your statement without any fear or force. So, by this it
clear’s that she was giving her statement with her wish, not by fear and force.

There was a girl name neelam. She had given a statement of 164. She tells in
her statement that she was sexually harassed by his neighbor’s son 2 to 3
times. And, he threatened her that if she will disclose this fact to any one he
will cause death to that girl.

Today sir told me about the provisions of rape and what punishment will be
given for the rape(section 375 IPC) conviction(section 376 IPC) and if there is
no rape only sexual assault is done by the defendant then by the virtue of
section 354 of IPC the case can be transferred from rape to sexual assault only.

Today I hear the proceeding of Justice Rohit Arya court room no.2 division
bench proceeding were going on in which one case was going on of section 302
murder case. Fact of the case was that three people came on a bike and shot one
person with a gun

Facts –
This case is related with the family matter of divorce in which sangeeta wants
maintance with Rahul after divorce rather than having a good earning . As she
was a officer of women and child development department . so to proof in court
that while having good earning demanding for maintance in wrong and to
protect our client . My sir file a RTI under section 2(f) of RTI ACT . in women
and child development department. To take the details of sangeeta to proof in
court.

At this day, I am present in the court seeing the chief and cross
examination in two cases. I also came to know about the confession. There
are two types of Confession:

 Judicial Confession: It is given in front of the Judge.


 Extra Judicial Confession: It is given in front of the other party and

not in the front of the Judge.

The confession which is given by the accused person in the front of the
lawyer/advocate is not admissible, before the court of law. There are three
types of witness:

1) Fully Reliable witness: The statement given by these statements


are fully admissible in the court.

2) Partly Reliable witness: The statement given by these statements


are fully admissible in the court.

3) Not Reliable witness: The statement given by these statements are


not admissible in the court.

In Ordinary courses, there are three types of Witness: Child Witness: The
child witness is those witness who below the age of 18 years. The child never
gives statement on oath. The child witness is fully reliable witness and it is
admissible in the court. Normal Witness: The Normal witness is those
witness who above the age of 18 years. They also give statement on oath. The
statement given by them is admissible in the court Chance Witness: These
are those witnesses who are actually seen the happening of the offence in a
particular place.

Today, I went to district court with my advocate where he taught me how to
take a judgement copy of disposed cases from the court . And what is the
procedure that we have to follow to take decision copy of case .

Today, I went to my advocate office sharp 9:00 clock where he taught me the
procedure of taking fees for the dismissed cases from M.P.E.B (Gwalior). As
he was a M.P.E.B department Advocate . To take fees for department advocate
has to submit case details such as – judgment copy and department specified
amount bill .

Today , as my sir was busy with some important work so he told me to go to
office and read a case where I read a case of family matter related to dowry.
Sonu vs sammi mehandradtta
Charges – section 498A , 294 , 506, 34 of IPC & Section 4 of Dowry
Prohibition Act , 1961
Facts – After 3 days of marriage sonu’s husband and his in laws started rude
behavior with sonu and tourched her to bring money from his house to purchase
a flat . amount 15,00,000 rs when she denied for money sonu’s husband and in
law started abusing her and beating her badly and snatched all stridhan from her
which she gets during her marriage . and after two days she left to his parental
home . Than sonu complaint to mahila police station and registerd a FIR under
section 154 of CRPC . related to matter of dowry .

Today I again read a case of a criminal matter related to SC/ST Act
Daramveer vs Raj
Charges- section 341, 323, 506 of IPC & SC/ST Act
Facts – Daramveer was an mechanic and Raj was an shopkeeper of autoparts .
both have their separate shop infront of each other . one day morning one
custumer came to daramveer shop for repairing of motorbike for repairing he
required clutch wire . so to purchase that wire he went to raj shop and ask for
clutch wire on credit for which raj has denied because that was morning time .
As raj denied daramveer started shouting on him than raj said don’t shout or
fight with me I will not give to u parts on credit . than also he didn’t stop and
started abusing raj than after 10 to 15 minute shouting both started beating each
other . than after this daramveer filed a FIR in nearest police station of SC/ST
Act .

Today , I again read a case of criminal matter related to accident and drink and
drive matter .
Charges – section 279 , 427, 294, 34 & section 185 of Motor Vehicle Act , 1988
Facts – Sanjay and ravi was travelling with a (innova crysta) car while drinking
alcohol . sanjay was driving the car . and met an accident with manoj rai who
has recently purchase a new car name (aura ) manoj car was parked to roadside
and from back touched the car . than manoj suddenly call the police and
registerd an FIR under section 154 of CRPC . for rash driving , drink and drive
as police taken medical of sanjay and ravi . and abusing the manoj in public .
And confiscate the car of sanjay and . Arrest the sanjay and Ravi on the spot.

Today, I went to court with my sir who taught me about the concept of early
hearing . which means when the next hearing of case in long and we want
urgent bail or want to show any proof to court . so in that condition advocate
can apply an application for early hearing mentioning the valid reason for early
hearing .

As this was my last day at the internship I had to prepare a worksheet wherein I
had to write all the tasks which I had worked upon during the course of my
internship. Sir took some time to ask me some questions pertaining to the things
that I had learnt during the internship gave me feedback about my performance
as an intern and wished me luck.

Conclusion

My internship at High Court,Distirct Court , Family Court Gwalior, Madhya


Pradesh was a really fruitful experience which taught me diverse things and
practical knowledge.

Overall the part which helped me the most was the enriching experience of
seeing the different kinds of work which could be done by the advocates and
also learn to how to use their knowledge practically and sir also teach us how to
draft writ petition which will definitely help me for my future endeavors as
well.
