AFFIDAVIT OF WITNESS
I, DR. JOSEFINA VILLEGAS MARIANO (herein Dr. Mariano), Filipino, of legal age
and with residence at 7th Street, Villegas Subdivision Park, Malakas, General
Santos City after having been duly sworn in accordance with the law, hereby
depose and state that:
2. On March 15, 2023, Dr. Mariano received a report in the Facebook page
of A HEART FOR PAWS GENSAN from Dane Vane that a dog was
butchered and slaughtered by FILJANE FERNANDEZ INTAWON and
EUGENE JAY PAÑALES CABUNILAS;
4. Dr. Mariano (and Elaine Jane Bongolto Lasquite) inquired with Kagawad
Mascardo about the alleged “dog slaughtering” that happened in
Barangay Conel. Dr. Mariano was informed by the said Barangay
Kagawad that CINDY ASPILLA PARBA on an earlier date, went to the
Barangay Hall to file a report. The contents of the report which was read
by the Barangay Secretary, states that CINDY ASPILLA PARBA decided to
have the dog (“IMU”) slaughtered by Respondents’ FILJANE FERNANDEZ
INTAWON and EUGENE JAY PAÑALES CABUNILAS because it was injured
by a speeding vehicle;

5. Dr. Mariano (and Elaine Jane Bongolto Lasquite) requested from
Barangay Kagawad Mascardo to schedule a mediation proceeding with
the intention of investigating further into the unlawful acts (“dog
slaughtering”) committed by FILJANE FERNANDEZ INTAWON and
EUGENE JAY PAÑALES CABUNILAS;
6. On March 20, 2023 at 2 o’clock in the afternoon, Dr. Mariano (and Elaine
Jane Bongolto Lasquite) attended the first mediation proceeding that
was presided by the Honorable Punong Barangay Luciano O. Palma of
Barangay Conel. Present were several Barangay Kagawad and Barangay
Officials. During the mediation, CINDY ASPILLA PARBA voluntarily and
spontaneously admitted to Punong Barangay Palma that she was the
owner of the dog (“IMU”) and that she instructed FILJANE FERNANDEZ
INTAWON and EUGENE JAY PAÑALES CABUNILAS to slaughter the said
dog because it was injured by a speeding vehicle. CINDY ASPILLA PARBA
decided to have it killed because she has no more use of the dog. Dr.
Mariano also witnessed FILJANE FERNANDEZ INTAWON and EUGENE JAY
PAÑALES CABUNILAS despite being accused of slaughtering the dog
(“IMU”) in the presence of many attendees during the mediation
proceedings, kept silent and did not deny the said accusation. Thereafter,
FILJANE FERNANDEZ INTAWON, and EUGENE JAY PAÑALES CABUNILAS
voluntarily and freely ADMITTED TO HAVE KILLED AND EATEN THE DOG
(“IMU”). Consequently, CINDY ASPILLA PARBA, FILJANE FERNANDEZ
INTAWON, and EUGENE JAY PAÑALES CABUNILAS BEGGED FOR
FORGIVENESS for conspiring and agreeing to slaughter the dog (“IMU”).
These were also witnessed by those present during the mediation
proceeding;
7. On March 24, 2023 at 2 o’clock in the afternoon, Dr. Mariano (and Elaine
Jane Bongolto Lasquite) attended the second mediation proceeding
conducted by the Honorable members of the Lupong Tagapayapa of
Barangay Conel namely Generoso Caliza, Aldin Codiniera, and Harlinda
Halinon. Present were Barangay Kagawad Samuel Madrideños, and the
Barangay Officials. During the mediation, CINDY ASPILLA PARBA, FILJANE
FERNANDEZ INTAWON, and EUGENE JAY PAÑALES CABUNILAS begged
AGAIN for forgiveness. They also offered to donate items to the A HEART
FOR PAWS GENSAN and to render community service and to make a
public apology during the scheduled March 25, 2023 Barangay Assembly.

Dr. Mariano also witnessed CINDY ASPILLA PARBA wrote an apology
letter where she, FILJANE FERNANDEZ INTAWON and EUGENE JAY
PAÑALES CABUNILAS voluntarily, knowingly, and expressly acknowledged
committing the unlawful acts as substantiated by their signature.
Thereafter, CINDY ASPILLA PARBA, FILJANE FERNANDEZ INTAWON and
EUGENE JAY PAÑALES CABUNILAS showed their respective competent
evidence of identity. These were also witnessed by those present during
the mediation proceeding;
