CA 103 - Therapeutic Modalities

DEFINITION OF TERMS
PRISON - refers to a penal establishment under the control of the Bureau of Corrections
and shall include the New Bilibid Prison, the Correctional Institution for Women, the Leyte
Regional Prison, and the Davao, San Ramon, Sablayan and lhawig Prison and Penal Farms;
COMPETENT AUTHORITY - shall refer to the Supreme Court, Court of Appeals, Regional
Trial Court, Metropolitan Trial Court, Municipal Circuit Trial Court, Sandiganbayan, Military
Courts, House of Representatives, Senate, Commission on Elections, Bureau of
Immigration and the Board of Pardons and Parole;
INMATE - refers to a national prisoner or one sentenced by a court to serve a maximum
term of imprisonment of more than three (3) years or to a fine of more than one
thousand pesos (P1,000); or regardless of the length of the sentence imposed by the
court, to one sentenced for violation of the customs law or other laws within the
jurisdiction of the Burau of Customs or enforceable by it, or for violation of immigration
and elections laws; or to one sentenced to serve two (2) or more prison sentences in the
aggregate exceeding the period of three (3) years, whether or not he has appealed. lt shall
also include a person committed to the Bureau by a court or competent authority for
safekeeping or similar purposes. Unless otherwise indicated, “inmate” shall refer to a
"detainee".
DETAINEE - is a person who is confined in prison pending preliminary investigation, trial,
or appeal; or upon legal process issued by competent authority;
DEATH CONVICT - refers to an inmate in whose death penalty imposed by a Regional Trial
Court is affirmed by the Supreme Court en banc,
BUREAU - refers to the Bureau of Corrections;
DIRECTOR - refers to the Director of the Bureau;
DEPARTMENT - refers to the Department of Justice:
SECRETARY - refers to the Sectary of Justice;
SUPERINTENDENT - refers to the one in charge of a prison;
GUARD - refers to a member of the custodial force of a prison;
BOARD - refers to the Board of Pardons and Parole;
CARPETA - refers to the institutional record of an inmate which consists of his
mittimus/commitment order, the prosecutor’s information, and the decision of the trial.
Court, including that of the appellate court, if any;
PRISON RECORD - refers to information concerning an inmate’s personal circumstances,
the offense he committed, the sentence imposed, the criminal case numbers in the trial
and appellate courts, the data he commenced service for sentence, the date he was
received for confinement the date of expiration of his sentence, the number of previous
convictions, if any, and his behavior or conduct while in prison
MAXIMUM SECURITY STATUS - refers to a security category that indicates highly
dangerous or high-security risk inmates, who are determined by the institutional
classification board as requiring a high degree of control and supervision.
MEDIUM SECURITY STATUS - refers to a security category that indicates intermediate
security risk inmates, who are determined by the institutional classification board as
requiring a moderate degree of control and supervision.
MINIMUM SECURITY STATUS - refers to a security category that indicates low-security risk
inmates or those determined by the institutional classification board as requiring a
minimal degree of control and supervision.
THIRD CLASS INMATE - one who has either been previously committed for three (3) or
more times as a sentenced inmate, except those imprisoned for non-payment of a fine
and those who had been reduced from a higher class.
SECOND CLASS INMATE — a newly arrived inmate demoted from first class; or one
promoted from the third class.
FIRST CLASS INMATE - one whose known character and credit for work while in detention
earned an assignment to this class upon commencement of sentence; or one who has
been promoted from the second class.
ACT - refers to R.A. 10575, entitled "An Act Strengthening the Bureau of Corrections
(BuCor) and providing Funds Therefor," otherwise known as "The Bureau of Corrections
Act of 2013."
ADMISSION - refers to the manner of receiving a national inmate, a detainee, or convicted
person in a prison facility committed by courts or other Competent Authority to serve
sentence for a certain period or for temporary confinement.
BASE PAY - refers to a fixed amount of compensation for regular work rendered,
designated in the Salary Schedule for Uniformed Personnel for all ranks computed on a
monthly or annual basis, excluding fringe benefits and other allowances.
BUREAU OF CORRECTIONS or BuCor - refers to the central office, headed by the Director
General of Corrections, which has control and supervision over the prison and penal
farms.
CLASSIFICATION - refers to the manner of categorizing inmates according to certain
parameters, such as security risks, crimes committed, age, and health, among others.
COMPETENT AUTHORITY - refers to the President of the Republic of the Philippines,
Supreme Court, Court of Appeals, Sandiganbayan, Regional Trial Court, Metropolitan Trial
Court, Municipal Trial Court, Municipal Circuit Trial Court, Shari’a Court, Military Courts,
and other courts of competent jurisdiction provided for by law.
DOJ - refers to the Department of Justice.
INMATE - refers to a person, also called a Person Deprived of Liberty (PDL), confined in a
national prison to serve a sentence or for safekeeping.
IRR - refers to the Implementing Rules and Regulations of R.A. No. 10575.
NATIONAL INMATE - refers to an inmate sentenced by a court to serve a term of
imprisonment of more than three (3) years or to pay a fine of more than one thousand
pesos (P1,000); or an inmate who, regardless of the length of the sentence imposed by
the court, has been sentenced for violation of customs law or other laws within the
jurisdiction of the Bureau of Customs or enforceable by it, or for violation of immigration
or election laws; or to one sentenced to serve two (2) or more prison sentences that, in
their aggregate, exceed the period of three (3)years, whether or not said inmate
appealed. It shall also include a person committed to the Bureau of Corrections by a
Competent Authority for temporary confinement or for similar purposes.
REFORMATION - refers to the rehabilitation component of the BuCor’s present
corrections system. It shall refer to the acts that ensure the public (including families of
inmates and their victims) that released national inmates are no longer harmful to the
community by becoming reformed individuals prepared to live a normal and productive
life upon reintegration to the mainstream society.
SAFEKEEPING - refers to the custodial component of the BuCor’s present corrections
system. It shall refer to the acts that ensure the public (including families of inmates and
their victims) that national inmates are provided with their basic needs, completely
incapacitated from further committing criminal acts, and have been totally cut off from
their criminal networks (or contacts in the free society) while serving sentence inside the
premises of the national penitentiary. These acts also include protection against illegal
organized armed groups that have the capacity of launching an attack on any prison camp
of the national penitentiary to rescue their convicted comrade or to forcibly amass
firearms issued to prison guards.
SECRETARY - refers to the Secretary of Justice.
SENIORITY AND LINEAL LIST (SLL) - refers to a document containing the names of all
officers in the active corrections service, arranged by grade and in accordance with their
relative seniority for each regular component, and by the service to which they are
appointed.
TIME-IN-GRADE - the period of active non-commissioned or commissioned service
rendered by an officer in a certain rank.
ANGER MANAGEMENT – a specialized group activity discussing issues to control anger.
ANNOUNCEMENT - information given to all residents.
ATTITUDES – the general condition of the TC family as a whole, including incidences,
positive and negative.
BANS - a behavior shaping tool to prohibit a resident to a specific area, activity, verbal,
another client.
BIG BROTHER - an older member of the community tasked to provide guidance
to the newly committed residents.
BOOKED – logged an incident to the Coordinator of the Day.
CARDINAL RULES - the principal guiding rule observed by all residents in a TC Community
with heavier corresponding consequences.
COERCION - the use of internal and external sources to heighten dissonance on
the client and magnify his choices and the specific consequences of his choices.
COMMUNICATION – a department which oversees the daily census, entry,
news and other information to be disseminated.
COMMUNITY - the residents of the TC Family.
COORDINATOR - the highest position attained by a resident in a TC Hierarchy, who works
with the staff in running the house, implementing rules. With corresponding status, a
resident has an authority over the other residents.
COORDINATOR OF THE DAY – assigned coordinator (resident) to oversee and
address the incidents, attitudes of the house through the use of behavior shaping
tools – talk to, dealt with, haircut.
COUNSELOR - staff member position who assists the residents’ needs
DAILY STRUCTURE - list of day-to-day activities
DEPARTMENT HEAD - a ranking resident next to the coordinator in the TC Hierarchy
assigned to oversee, and monitor tasks to be done in a particular department.
DISSONANCE - the time period of admitting, or denying before coming up with a decision.
DIRECTOR - the highest staff facility officer (Warden) who has the direct command to both
residents and staff.
DORMITORY – a cell where the residents stay while in confinement.
ENCOUNTER - a group process utilized to vent out concerns, anger, and hurt feelings
ENCOUNTER BOX - box used to receive slips being dropped.
ENTERTAINMENT and RECREATIONAL ACTIVITY - an activity in the TC community aimed
to aid residents in treatment.
EVALUATION – an assessment done anytime during the treatment
EXPEDITING TEAM – a department that serves as police of the community to ensure
order among residents
EXPULSION - the ejection of one from the community because of his/her serious offense.
FRIEND - a resident who has the closest regard to the other resident.
GENERAL MEETING - a behavior shaping tool addressing serious infraction of a resident.
GENERAL WORKER – the lowest position in the TC hierarchy
GROUNDS - pertains to lawns, pathways, and landscape
HAIRCUT - a behavior-shaping tool consisting of a five-man panel that addresses a
resident’s infraction.
HIERARCHICAL STRUCTURE – the chain of command of residents in TCMP.
HOUSE – pertains to the jail facility.
HOUSE RULES – are day to day standards that need to be followed inside the jail facility to
ensure the smooth and orderly flow of operation.
HOUSEKEEPING TEAM – a department that maintains the cleanliness of the facility.
INFRACTIONS - a violation of the House Rules of the TC Family.
LEARNING EXPERIENCE – a form of sanction that aid residents realize the value of
correcting infractions.
MORNING MEETING - a daily ritual addressing attitudes of previous days, performed to
start the day right.
PEERS – friends of the same entry period.
PRE-MORNING MEETING- the activity preceding the Morning Meeting that discusses
attitudes of the house and eliciting theme of the week and word of the day.
PULL – UP – verbal reprimand done during the Morning Meeting.
RESIDENTS – terms used for inmates who are part of the TCMP community.
REPARATION - refers to the process and result of remedying the damage or harm caused
by an unlawful act.
SENIOR RESIDENT – a member of the TC community having the position such as Static
Group leader and its Assistant and In Charge of various special services groups.
STAFF – refer to jail personnel.
STATIC GROUP – a group composed of residents known as a permanent support group.
TALK TO – a friendly reminder for resident violators.
TC FAMILY – refers to all residents of the TC community.
UNWRITTEN PHILOSOPHY – refers to a guiding value which residents reflect and hold on.
VIOLATOR – a resident who commits an act in violation of the TC/Jail Rules.

DEFINITION OF TERMS - AS USED IN THE BJMP MANUAL, THE


FOLLOWING TERMS ARE DEFINED:
ALCOHOLICS - those inmates who suffer from alcoholism or those engaged in the
improper compulsive intake of alcohol which may result in physical, social and behavioral
problems.
BISEXUAL - are those inmates who have a sexual attraction or sexual behavior toward
both males and females, and may also encompass sexual attraction to people of any
gender identity or to a person irrespective of that person’s biological sex or gender.
CARPETA - otherwise known as “inmate record or jacket”, contains the personal and
criminal records of inmates, documents related to his/her incarceration such as but not
limited to: commitment order, subpoenas, personal identification, orders from the court,
and all other papers necessarily connected with the detention of an inmate.
CHILD OR CHILDREN IN CONFLICT WITH THE LAW (CICL), also known as “Youth Offender”
- a person under eighteen (18) years old who is alleged as, accused of or adjudged as
having committed an offense under the Philippine laws.
CHIEF CUSTODIAL OFFICER - is the personnel in-charge in the overall supervision of all
custodial functions.
CITY JAIL - is a facility or a place of confinement for those inmates who are sentenced
with a penalty from (1) one day to three (3) year imprisonment.
CLUSTERING OF JAILS - the designation of a municipal or city Jail as a facility for one or
more adjacent municipalities in order to maximize the utilization of personnel and other
resources. The “host” city or municipality is named as a district to accommodate inmates
from the municipalities clustered to it.
COMMITMENT ORDER - a written order of the court, or any other agency authorized by
law to issue, entrusting an inmate to a jail for the purpose of safekeeping during the
pendency of his/her case.
CONTRABAND - any article, item, or thing prohibited by law and/or forbidden by jail rules
that would pose as security hazards or endanger the lives of inmates.
CONJUGAL VISITATION – refers to the visit by the wife for a short period, usually an hour,
more or less, to her incarcerated husband during which they are allowed privacy and are
generally understood to have sexual contact.
DETAINEE - a person who is accused before a court or competent authority and is
temporarily confined in jail while undergoing or awaiting investigation, trial, or final
judgment.
DISTRICT JAIL - is a facility or a place of confinement for inmates coming from a city or
clustered municipalities who are waiting or undergoing trial or serving sentence of one (1)
day to three (3) years.
DRUG DEPENDENTS - are those inmates who have a psychological craving for habituation
to and abuse of or physiologic reliance on a chemical/drug substance.
DRUG USERS - are those inmates who take substances/drugs that can alter their body and
mind works.
ESCAPE-PRONE INMATES - are inmates who are likely and have the tendency to escape
from the jail facility.
GAY - is a male homosexual inmate, who experiences romantic love or sexual attraction to
fellow male inmates.
HIGH RISK INMATES IN BJMP JAILS - are those considered as highly dangerous or with
high probability of escaping or being rescued because of the gravity of the crimes they are
accused of or have a propensity for being troublemakers or initiators of jail riots and
disturbance and who require a high degree of control and supervision. Particularly
included herein are those charged with heinous crimes, such as murder, terrorism, kidnap
for ransom, violation of R.A. No. 9165, the imposable penalty for which is from life
imprisonment to death, etc. These also include those who have a record of escaping from
jails, recidivists, habitual delinquents, and those with severe personality or emotional
disorders that make them dangerous to their fellow inmates or the jail personnel.
HIGH PROFILE INMATES IN BJMP JAILS - are those who are not necessarily charged with
heinous crimes but are prominent figures in society or public figures whose cases have
drawn public interest.
INFIRMED INMATES - are those inmates who are physically or mentally weak for a
prolonged period of time specifically caused by age or illness.
INMATE - is the generic term used to refer to a detainee or prisoner.
INMATES WITH DISABILITY - are those inmates who have an impairment that may be
physical, cognitive, mental, sensory, emotional, developmental, or some combination of
these.
INMATES WITH OTHER NATIONALITIES - are those inmates who are foreign nationals.
INSTRUMENT OF RESTRAINT - a device, contrivance, tool or instrument used to hold
back, keep in, check or control inmates; e.g., handcuffs.
JAIL - is a place of confinement for city and municipal detainees/prisoners, any fugitive
from justice, or person detained awaiting or undergoing investigation or trial and/or
pending transfer to the National Penitentiary, and/or violent, mentally ill person who
endangers him/herself or the safety of others, duly certified as such by the proper
medical or health officer, pending transfer to a mental institution.
JAIL AIDE – is an inmate who requires less supervision than other inmates. Although
he/she may be assigned special tasks, he/she has no special privileges, and is not allowed
to work alone nor exercise any authority over other inmates.
JAIL INCIDENT -any untoward or uncommon actions, events, or conditions such as jail
break, riot, noise barrage, stabbing or assault upon personnel that occurs in jail and
perpetrated by any person, which may or may not have followed or depended upon
another action of grave or serious consequences such as escape, injury, death, fire, flood,
earthquake, or other calamity which affects the jail.
JAILBREAK - the escape from jail by more than two (2) inmates by the use of force, threat,
violence or deceit or by breaching security barriers such as by scaling the perimeter fence,
by tunneling and/or by other similar means or by burning or destructing of the facility or a
portion of the facility with or without the aid of jail officer or any other person.
JAIL ESCAPE - it is an act of leaving from jail of an inmate through unofficial and illegal
ways or without any legal order from the authorities.
JAIL WARDEN - person charged with the overall operational and administrative control of
jail.
ILLEGAL CONTRABAND - are those that are unlawful in themselves and not because of
some extraneous circumstances (i.e. dangerous drugs, weapons, potential weapons,
explosives).
LESBIAN - is a female homosexual inmate, who experiences romantic love or sexual
attraction to fellow female inmates.
MENTALLY ILL - are those inmates who suffer from mental illness and are afflicted with or
exhibiting irrationality and mental unsoundness.
MITTIMUS ORDER - a warrant issued by a court bearing its seal and the signature of the
judge, directing the jail or prison authorities to receive inmates for the service of
sentence.
MUNICIPAL JAIL - is a facility or a place of confinement for those who are sentenced with
a penalty for a term not exceeding six (6) month imprisonment.
NUISANCE CONTRABAND - are those that may not be classified as illegal under the
Philippine laws but are forbidden by jail rules i.e. cellphones, money or other
commodities of exchange such as jewelry, appliances, and gadgets, excessive wearing
apparel and sleeping paraphernalia, intoxicating liquors, cigarettes, pornographic
materials, gambling paraphernalia and other products that are considered as instruments
for vices since they threaten the security, fire safety, sanitation of the facility, and the
orderly activities of the jail.
OFFENDER - refers to a person who is accused of violating or transgressing laws and
ordinances passed by competent authorities in the Philippines.
OFFICER - in general, the term officer shall refer to all uniformed personnel of the BJMP;
when referring to rank, however, the term officer shall refer to those holding the rank of
jail inspector and above.
PENOLOGY - a branch of criminology dealing with jail management and administration of
inmates.
PREGNANT INMATES - a female inmate bearing a developing embryo, fetus, or unborn
offspring within her body. Prisoner - an inmate who is convicted by final judgment.
PROVINCIAL JAIL – is a facility or a place of confinement for inmates who are sentenced
with imprisonment from six (6) months and (1) one to three (3) year imprisonment.
PROVINCIAL JAIL ADMINISTRATOR - refers to the official duly designated to head the
BJMP Provincial Jail Administrator’s Office and to oversee the implementation of jail
services of all district, city, and municipal jails within its territorial jurisdiction.
REFORMATION - means amending or improving by changing an inmate's behavior or
removing his or her faults or abuse and removing or correcting an abuse a wrong or error.
REGIONAL DIRECTOR - refers to the official duly designated to head the BJMP Regional
Office, to oversee the implementation of jail services within his/her jurisdiction covering
provincial jail administrator’s offices, district, city, and municipal jails, and to ensure the
enforcement of laws and regulations related to the functions his or her office as
mandated of him or her.
REGIONAL OFFICE- means an office, which has administrative and operational control
over its provincial jail administrator’s offices, district, city and municipal jails.
REHABILITATION - a program of activity directed to restore an inmate’s self-respect and
sense of responsibility to the community, thereby making him/her a law-abiding citizen
after serving his/her sentence.
SAFEKEEPING - refers to the temporary custody of a person for his/her own protection
from the community he or she comes from, and for the community he or she comes from.
SENIOR CITIZENS INMATES - are those inmates who have reached sixty years old, or those
who have retired from work, and those who generally belong to the "old age" bracket.
SEX OFFENDERS - are those inmates who committed crimes involving sex, including rape,
molestation, pedophilia, sexual harassment, and pornography production or distribution.
SEXUAL DEVIATES - inmates who have a type of mental disorder characterized by a
preference for or obsession with unusual sexual practices, such as pedophilia,
sadomasochism, or exhibitionism or inmates whose sexual practices are socially
prohibited.
SUICIDAL INMATES - are those inmates who have a tendency to commit suicide or harm
themselves.
TRANSGENDER - are those inmates whose gender identity or gender expression does not
match their innate sexual identity.
TRANSFER - the delivery, notwithstanding his/her or their appeal, of an inmate or
inmates sentenced to more than three (3) year imprisonment, from any BJMP manned jail
to any of the Bureau of Corrections (BuCor) prisons or penal farms or the delivery of an
inmate/s from BJMP-manned jail to another jail facility
