W6/250/Pt 1/2784, dated 07.04.12. ‘The issues mentioned by East Coast Railway in their letter under reference have been examined in Board's office and it is advised that the recently issued Freight Marketing Policy Circular No, 01 of 2012, vide letter no, 99/TC(FM)/26/1/Pt.-1I, dated 30.01.2012, is quite comprehensive and all the earlier instructions on the subject have been superseded through this circular of 30.01.12. Railway should take necessary action accordingly However, the points raised by East Coast Roilway are clarified as under ‘A. As per Para 3 of FMPC No, 01 of 2012, the charges, as to be taken from the Party for the deposit work, have been prescribed in terms of provisions of Engineering Code only and are with respective applicability for the deposit work, as to be executed by Railways, by the Party under Railway's supervision or by the Party through Railway's copproved consultants and there is no ambiguity wr-t. provisions of Engineering Code, However, these charges shall be collected from the party in stages as mentioned in Engineering Code. 8, Para 3 of FMPC No. Ol of 2012 is quite clear, Railway may decide the Executing ‘Agency, for the deposit work alongwith its supervision depending on nature of project.
