Relevant Facts:

• Petiotioners, Juan J. Syquia & Corazon C. Syquia, Carlota C. Syquia, Carlos C. Syquia & Anthony
Syquia were the parents & siblings, respectively, of the deceased Vicente Juan Syquia.
• On March 5, 1979, they filed a complaint against private respondent, Manila Memorial Park
Cemetery, Inc. for recovery damages arising from breach of contract & quasi-delict.
• The trial court dismissed the complaint.
• The memorial was instructed to transfer remains at new plot in the same memorial.
• Plaintiff-appellants discovered that the concrete vault had a hole approximately 3 inches in
diameter.
• Water drained out of the hole, because of that plaintiff became agitated.
• Water flooded the remains, a) the interior walls of the concrete vault showed evidence of total
flooding. b) the coffin was entirely damaged by water. c) the entire lining of the coffin and
remains are damaged & soiled

Issue:

• Whether or not the memorial should pay for damages.

Ruling:

No, since in the contract there was no mention that the coffin is waterproof, aside from that the father
himself, Juan Syquia that said area had to be constantly sprinkled with water to keep the grass green and
that water would eventually seep through the vault. The hole was also put there to prevent the coffin to
float and the grave will be filled with water and the digging would cave.
