Alumno: Diego Israel Pérez Méndez Matricula:22500405 Para poder responder la pregunta detonante tenemos que saber que es el caso avena el cual consistió en la Condena del sistema judicial estadounidense en contra de 51 mexicanos sentenciados a pena de muerte sin el amparo y la protección del sistema consular mexicano, así como lo marca la convención de Viena sobre relaciones consulares, por lo tanto, el gobierno mexicano inicia un litigio. La corte internacional de justicia da el fallo sobre la reconsideración de sentencias por el sistema judicial estadounidense el 31 de marzo del 2004.

México y conforme a lo estudiado en este curso, ¿constituye el caso Avena una intervención, injerencia o intromisión indebida de México y de la Corte Internacional de Justicia en la jurisdicción nacional y en los asuntos internos de los Estados Unidos de América? El artículo 36 de la CVRC consagra el denominado derecho de acceso y de notificación consular, en beneficio de ciudadanos extranjeros detenidos o arrestados y que se encuentra integrado a la normativa internacional de los derechos humanos. Por lo tanto, no se constituye una injerencia o intromisión indebida de México.
