APPLICATION FOR ISSUE OF DISTRESS WARRANT

AGAINST THE RESPONDENTS

MAY IT PLEASE YOUR HONOUR

I, the Applicant above named beg to states as under :-

1. That I had filed the proceeding against the Respondents

under section 12 of Protection of Women From Domestic
Violence Act 2005 and also filed an Application under
section 23 of Protection of Women From Domestic Violence
Act for interim relief.

2. I say that this Hon’ble Court and that the Hon’ble Court
vide order dated 24/8/2012 is pleased to allow the
Application for interim as under:-
ORDER

i. The Opponent no.1 directed to give interim

maintenance of Rs. ………../- per month to the
Applicant from the date of filing of the main
Application till final decision of the main Application.
ii. The Opponents are directed not to dispossess the
Applicant and her two Children …………….
 iii. Opponent shall not subject the Applicant to any kind
of harassment or domestic violence.
iv. Other relief will be considered at the time of final
hearing.
v. Copy of the Order be given free of cost to Applicant.

3. I say that the Respondent no.1 though is having sufficient

income he had failed and neglected to make the payment
of maintenance Application since ………………to ……… i.e. for
11 months amounting to Rs………………/- and that myself
and my children are at the verge of starvation and thus
this shows that Respondent no.1 had showed utter
disregard to the order of the Hon’ble Court.

4. I say that the Respondents have not appeared before the

Hon’ble Court and that the Hon’ble Court vide order dated
01/10/2012 is pleased to allow the Application for distress
warrant against the Respondents. Respondents had
showed utter disregard to the order of the Hon’ble Court.

5. I say that thus the Respondents knowing well that the

order is passed by the Hon’ble Court and Respondent no.1
purposely and intently failed and neglected to make the
payment of interim maintenance to the Applicant and
passing threats of life to her and thereby breached the
order of the Hon’ble Court which amounts to contempt of
Court.

I therefore pray that the Hon’ble Court may kindly be

pleased to:-

a. Application may kindly be allowed;

b. issued of distress warrant against the Respondents.

c. The Respondent no.1 be ordered to pay Rs…………/- being

the arrears of maintenance to the Applicant.
d. Such other and further relief be granted to and in favour of
Applicant to meet the ends of justice.

For this act of kindness the Applicant shall ever pray.
