A massive terror assault at dawn
on Saturday when the arguably
most protected and alert nation
was observing a major holiday
left at least 100 Israelis dead and
900 others injured. In its retalia-
tory strikes, Israel killed at least
198 people and wounded 1,610 oth-
ers in the Gaza Strip, the Pales-
tinian health ministry claimed.
The day began with a massive
wave of attack from the Hamas
outfit that controls the Gaza Strip.
It fired thousands of rockets
while its terrorists parallelly in-
filtrated the heavily fenced bor-
der at several locations by air,
land and sea.
Israeli Prime Minister Ben-
jamin Netanyahu said they were
at war. “We are at war. In war, one
needs to be level headed. I call on
all citizens of Israel to unite in

TAMIL Nadu is staring at an
acute water shortage for agricul-
ture. A draft report ‘Sustainable
Land Use Policy’ prepared by the
State Planning Commission has
pegged the shortage of water for
crops at 4,646 tmcft (thousand
million cubic feet) by 2050, which
is equivalent to nearly 50 times
the storage capacity of the Met-
tur dam.
This means that agriculture,
which accounts for 13% of the
state economy, may have to un-
dergo a perceptible change in
terms of crops, land use, use of
water, and productivity. The re-
port has asked the government to
encourage cultivation practices
such as off-season tillage, the sys-
tem of rice intensification, the
sustainable sugarcane initiative,
crop substitution, and micro-irri-
gation techniques.
What is more worrying is that

drowned in a water sump on the
premises of a government pri-
mary school at Nagarajapuram
near Thondamuthur in Coimbat-
ore city on Friday. The school was
closed for holidays but did not
have a compound wall and resi-
dents claimed the sump had been
left uncovered.
The deceased, identified as
Guganraj from Vellingiri Street,
went to the school premises, me-
tres from his home, on Friday
around 3.30 pm to play with his
friends but went missing. He was
a Class 1 student at a private
school and his parents, Karthik
and Karthika, are daily wage la-
bourers. Once they realised he
was missing, his parents and rel-
atives mounted a search and
found him in the water sump
around 7 pm. He was rushed to a
private hospital where he was de-
clared dead. Although the par-
ents took the body and prepared
for cremation, Thondamuthur
police convinced them to allow a
postmortem exam at Coimbatore

THE GST Council on Saturday decided to not levy tax on
millet flour when sold in loose, but it will attract 5% tax
when sold in prepackaged and labeled form, Union finance
minister Nirmala Sitharaman said.
Extra Neutral Alcohol (also known as raw alcohol),

TWELVE people were charred to death when a ma-
jor fire broke out at a cracker shop-cum-godown at
Karnataka’s Attibele, about 10 km from Hosur in
Tamil Nadu on Saturday. All the victims are said to
have hailed from TN.

Road when the fire broke out at
3.30pm. Four people, including the
shop’s owner, sustained burns. The
condition of one person is critical.
The bodies were charred beyond
recognition but the remains of Vedi-

Akash, Prakash, Adikeshavan and Elambarandhi
could be identified.
Traffic on the highway was disrupted for more
than five hours due to the blaze, with a pile-up
stretching for over 6 km. Nine fire tenders were
pressed into service and some fire tenders from TN

shan was deeply moved and decided
to become an educator for them.
After training and gaining expe-
rience in the field, he founded Ca-
runnai with his own earnings and
donations from organisations like
Rotary Club of Cosmos, Rotary
Club Central, and Integra Software
Services. His wife Revathi also
joined him on this mission, further-
ing the cause by becoming a special-
ist in audiolo g y and speech
therapy.
“We concentrate on things that
make the children happy. Many
have a liking for sports, some
like to paint and others mu-
sic. We encourage them in
the activities and gradually
take the training forward.
We give tokens to encourage
good behaviour. Children are
also taken to nearby tourist
spots. These are some techniques
which we employ for children with
disabilities,” says Ganeshan.
The educators at Carunnai create
tailored teaching plans, collaborat-
ing closely with parents and sup-
port staff. They identify each stu-
dent’s strengths and consult with
parents to better understand their
needs. Through this holistic ap-
proach, students develop essential
skills, including reading, writing
and financial literacy.
The school is now home to over 85
students, including eight orphans.
Daily activities include domestic
skills training, academics, and
training in social skills. Physiother-
apy, speech therapy, visual stimula-
tion, and psychiatric therapy are
provided as needed.

Since his retirement in 2021, he
has dedicated his time to train-
ing the athletes.
“Though I could not pursue a
career in sports, I had enough
knowledge and decided to train

sist those in need and fulfils

ments to make sure that

WITH the catchment areas re-
ceiving very less quantity of
water during the southwest
monsoon, only 469 out of the
total 14,314 irrigation tanks un-
der the Water Resources De-
partment (WRD) in the state
have reached their maximum
capacity. As on Saturday, a stag-
gering 3,422 (24%) tanks have
gone completely dry.
Despite the state’s systematic
channels designed to link
waterbodies, storing water has
proven to be a challenge this
year. The WRD maintains 1,551
tanks in the Chennai, Tiruval-
l u r, C h e n g a l p a t t u , a n d
Kancheepuram districts. A sen-
ior official of the department
said he hopes the northeast
monsoon will improve the wa-
ter level in the tanks.
Meanwhile, farmers said
there is an urgent need to re-
store the tanks in the state.

the Federation of Cauvery Del-
ta Farmers Association, told
TNIE, “Neither the farmers
nor the government are well-
versed in water management.
Historically, the state has nu-
merous tanks, lakes, and link-
ing channels. During the rainy
season, excess rainwater would
flow into nearby lakes and
tanks through designated
channels.”

room on Friday. Police said the deceased
left a suicide note blaming a male faculty,

CM to move Cauvery

Chennai: CM MK Stalin will move
a resolution on the Cauvery issue
in the state Assembly on Monday,

IN fresh attacks at mid-sea in
days, 12 fishermen from the dis-
trict were assaulted and robbed
of their equipment allegedly by
Sri Lankan nationals in three
separate incidents off Kodiyaka-
rai coast since Friday night.
In one incident, fishermen A

S Sathiyaraj (32) and G Kodilin-
gam (53) – all from Vellapallam in
Vedaranyam taluk – put out to
sea from Vellapallam in a motor-
ised boat on Friday afternoon.
They were fishing a few nautical

imere when three unidentified
people confronted the fishermen
around 8.30 pm. Some of them
boarded Manian’s boat and as-
saulted the fishermen with weap-
ons. In this, Manian and Kodilin-
gam sustained injuries on the
hands and legs, sources said.
The assailants also seized
equipment such as fishing nets,
GPS and transceiver besides the
fish catch weighing around 600
kilograms before leaving the
spot, they added.
The fishermen, who returned
to Vellapallam on Saturday
morning, availed of treatment at

Nilgiris tiger deaths not alarming: NTCA report
Expert panel says information about tiger movement is inadequate and more detailed monitoring is necessary

THE National Tiger Conserva-
tion Authority (NTCA), in a re-
port, has said the recent deaths
of tigers, including of tiger
cubs in Nilgiris in Tamil Nadu,
were not alarming in the con-
text of current population size
growth and dispersal dynamics
in the landscape. However, the
report noted that information
on tiger movement is inade-
quate and more detailed moni-
toring is necessary.
The biodiversity-rich areas
of Mudumalai Tiger Reserve
(MTR) and Nilgiris forest divi-
sion were recently in the news
as 10 tigers had died within 40
days, raising several concerns
including of poaching. This
prompted the NTCA to send a
team to the area to conduct a
detailed field appraisal and
submit a report. A team con-

regional deputy director, Wild-
life Crime Control Bureau
(WCCB) and Doki Adhimallai-

“Deaths of these tigers are not
alarming in the context of cur-
rent population size, growth
and dispersal dynamics in the
landscape but unnatural causes
such as poisoning and previous
incidents of poaching are indi-
cator of what may be expected
in the landscape and according-
ly, the management should gear
up for preventive actions.”
As per official data, there
were 76 tigers in TN in 2006.
The number rose to 306, accord-
ing to the 2022 estimation. At
the same time, the number of
tigers in MTR increased from
51 in 2006 to 114 in 2022.
As part of recommendations
made in the report, Murali
said: “Given increasing popula-
tion growth of tiger in the land-
scape and the complex land-us-
es, specifically in the Nilgiris
forest division where informa-
tion on tiger movement is inad-
equate, it is important to put in
place detailed monitoring in-
volving M-STtIPES modules
and intensive camera-trapping
of the region. All-year around
Continuous Camera Monitor-
ing System (CCMS) using one-
sided camera traps or use of
other advanced GSM or local
network-based technolog y
would be required to obtain
movement of tigers on a week-
ly basis and to track any possi-
ble threats due to retaliatory
killing and/or poaching.”
“There is a need to establish
an informant network in the re-
gion, with involvement of local
NGOs, including the ones who
are raising concerns of poten-
tial poaching risk. It is impor-
tant to investigate further on
the recent tiger sightings across
the human dominated area...,”
the report said.
The report said the death of
two tigers was clearly a case of
poisoning, a retaliatory killing.
The forest department acted ar-
rested the accused. “However,
this need to be taken with cau-
tion as this region i.e. Emerald
Forest of Avalanche, Ooty has
previous records of poachers
operating here. Information
from the agency reveals that a
gang of notorious poachers
from north India are settled in
the landscape and speak the lo-
cal language.”
The other eight tiger deaths
were attributed to natural caus-
es, including infighting, aban-
donment by mother. In the case
of mortality of four cubs, in
Chinna-Coonoor area of Nilg-
iri forest division, the report
said: “In the wild, at the age of
two-three months, cubs start to
feed on the kill made by the
mother... if the mother is inex-
perienced, prolonged prey hunt
and other unknown causes can
make the mother to desert the
cubs. These four cubs were per-
haps left unattended by the
mother for a longer duration
and hence died because of star-
vation, dehydration,” the re-
port said.
Chief Wildlife Warden Srini-
vas R Reddy said the forest de-
partment has taken a number
of steps to identify the mothers
of tiger cubs. “Camera traps
were set-up in 68 locations. Six
teams are conducting searches.

lected and sent for DNA analy-
sis to identify the probable

has insisted that the land
available for water conserva-
tion should be maintained and
protected from the growing
threat of conversion into other
land use purposes.
“The supply-demand gap will
continue to increase if the gov-
ernment does not look at the is-
sue in a different way,” says Prof
S Janakrajan, president, South
Asia Consortium for Interdisci-
plinary Water Resources Stud-
ies. “Though the rainfall pattern
has changed, the state has yet to
look at rainfall accounting, wa-
ter budgeting, and water ac-
counting. This could help in pro-
viding crucial data on how much
rainwater is being utilised by
the state while how much is let
into the sea,” he says
According to the report,
there is a decline in the area ir-
rigated by canals and tanks,
which has, in turn, led to a rise
in the area irrigated by wells.
The extreme dependency on
groundwater is likely to re-
duce its availability fur-
ther and increase the
cost of water extrac-

water tables, encroach-
ment of irrigation chan-
nels, decline of commu-

erosion, and excessive use of

divide Tamil society. Now the entirety of Tamil
politics is based on the Brahmin and non-Brahmin
divide. If a caste census if taken, every caste will

can have a caste census to know the population of
each caste. But quotas should be given only to the

Coming close on the heels of the Karuvannur coop-
erative bank frauds, news of a crisis in the Then-
nala cooperative bank in Malappuram is shocking.
More cooperative banks in the state could be in
trouble. It is an outright abuse and calls for deter-

commercial banks in the garb of cooperative credit
societies. They should be urgently brought under

cord haul of medals at the Asian Games in China.
India capped an extraordinary Saturday, claiming
gold in the compound events, kabaddi, cricket and
badminton to cross the 100-medal mark. India had
pocketed 70 medals in the last edition in Indone-
sia, including 16 gold, 23 silver, and 31 bronze med-
als to post their best-ever performance. So this
year is a big achievement. However, we have a long
way to go before we can match strides with China,
Japan and South Korea.

in the wake of Chief Minister
Ashok Gehlot objecting to Vice
President Jagdeep Dhankhar’s
frequent visits to the state.
Dhankhar has been in Rajas-
than for two days and visited
Sri Ganganagar, Hanuman-
garh, and Jodhpur, the strong-
hold of Gehlot, on Saturday.
This comes after his earlier vis-
it to Sikar on Friday.
Dhankhar has slammed

THE Sikkim government will
probe the “substandard” con-
struction of Chungthang dam
that was washed away by the
flash floods and punish the cul-
prits, CM Prem Singh Tamang
said on Saturday.
Built by the previous govern-
ment, the Chungthang dam is
part of the 1,200 MW Teesta
Stage III Hydro Electric Project.
Tamang told journalists that
loss of lives and damage to
properties downstream was
due to the dam’s collapse.
“After the cloudburst over
Lhonak Lake, the Chungthang
dam suffered the highest dam-
age, causing maximum losses
downstream. The force of wa-
ter could have been controlled
if the dam had been built well
by the previous government,”
the CM said. He said the gov-
ernment would get the dam’s
collapse investigated by a cen-
tral agency. “We had such a dis-
aster because of two-three peo-
ple. They will have to be
punished,” Tamang said.
He said the government’s top
priorities were rescuing the
missing people, clearing debris,
and restoring water, electricity
supplies and road connectivity.

Sukhpal Singh Khaira in an NDPS
case of 2015 by Punjab Police, a
video has gone viral which has been
also shared by the Punjab BJP chief
Sunil Jakhar. In the old video, chief
minister Bhagwant Singh Mann, who
was earlier AAP MP from Sangrur is
allegedly accusing the then Akali

Bureau recently had to face some

Macron on Saturday said he
strongly condemns the terror-
ist attacks that are currently
striking Israel. “I express my
full solidarity with the victims,
their families and their loved
ones,” he said.
The US condemned the at-
tack by “Hamas terrorists”
against Israel. “The United
States unequivocally condemns
the unprovoked attacks by Ha-
mas terrorists against Israeli
civilians,” a White House state-
ment said. US President Joe Bi-
den on Saturday war ned
“against any other party hos-
tile to Israel seeking advantage
in this situation.”
A senior adviser to Iran’s su-
preme leader Ayatollah Ali
Khamenei expressed support
for the attack, calling it a proud
operation. “We support this op-
eration,” Yahya Rahim Safavi
said, quoted by ISNA. At a par-
liament session on Saturday,
Iranian lawmakers chanted
“Down with Israel,” and “Wel-
come Palestine.”
Saudi Arabia’s foreign minis-
try said, “The Kingdom calls
for an immediate halt to the es-
calation between the two sides,
and protection of civilians.”
The UN’s human rights chief
Volker Turk said, “I call for an
immediate stop to the violence,
and appeal to all sides...to de-
escalate to avoid bloodshed.”
EU chief Ursula von der Ley-
en unequivocally condemned
the attack carried out by Ha-
mas terrorists against Israel.
“It is terrorism in its most des-

TWO 6.3 magnitude earthquakes killed dozens of people

in western Afghanistan on Saturday, the country’s nation-
al disaster authority said.
The United Nations gave a preliminary figure of 320 dead,
but later said the figure was still being verified. Local au-
thorities gave an estimate of 100 people killed and 500 in-
jured. “So far, more than 1,000 injured women, children, and
old citizens have been included in our records, and about
120 people have lost their lives,” Herat province disaster
management head Mosa Ashari said.
Mohammad Abdullah Jan said four villages in the Zenda
Jan district in Herat bore the brunt of the
quakes and aftershocks. Dozens of houses
have been damaged.
The United States Geological Survey
(USGS) reported the 6.3 magnitude trem-
blors. It said the epicentre was 40 kilome-
tres northwest of Herat city. There was an
aftershock with a 5.5 magnitude. A map on
the USGS website indicates seven earthquakes
in the area. Crowds of residents fled buildings in the city
at around 11.00 am (0630 GMT) as the quakes began, lasting
just under three hours.
The World Health Organisation in Afghanistan said it
dispatched 12 ambulance cars to Zenda Jan to evacuate cas-
ualties to hospitals. “As deaths & casualties from the earth-
quake continue to be reported, teams are in hospitals assist-
ing treatment of wounded & assessing additional needs,”
the UN agency said on X.
Telephone connections went down in Herat, making it
hard to get details from affected areas. Videos on social me-
dia showed hundreds of people in the streets outside their

Senior-level exits at Wipro
One of the major exits that
happened in the industry is
that of Wipro. Last month,
Wipro announced it is appoint-
ing Aparna C Iyer as chief fi-
nancial officer. Aparna suc-

from Wipro, and joined as CFO
at Cognizant. Wipro has been
witnessing many senior level

IT hiring to drop
In the past one year, top IT

hospital costs with 8% interest,
along with penalties for defi-
cient service.
More recently, as Kolkata bat-
tles with an epidemic of den-
gue, medical insurance claims
of many patients have been re-
jected because the insurance
companies opined they did not
require hospital admission.
This is despite several court
rulings that the decision wheth-
er hospitalisation is required
rests solely with the treating
doctor and not with the insur-
ance company.
Countering the trend of in-
surers stepping into the shoes
of the doctor, a recent decision
by the Surat District Consumer
Court rapped Star Health & Al-
lied Insurance for rejecting

It is not that we don’t have a
consumer redressal mecha-
nism. The Insurance Regulato-
ry and DevelopmentAuthority
(IRDA) Act, 1999, has set up an
autonomous body to protect the
interests of policyholders and
to regulate and ensure the or-
derly growth of the insurance
industry. The regulation proc-
ess has a sophisticated fast-
track redressal process where
state-wise Ombudsmen receive
and settle disputes in a time-
cause of the hassle and costs
involved. Hidden ‘exclusions’
in the policy terms or failure to
disclose health conditions at
the time of buying a policy are
used to reject claims.
For instance, Care Health re-
jected a claim of `45,000 of a
patient for an ‘intra-vitreal in-
jection procedure’ at the Reli-
ance HN Hospital, Mumbai for
‘age-related’ macular degenera-
tion of the eyes. The grounds:
eye degeneration is usually
caused by diabetes which was
an ‘excluded’ item in the policy.
This is despite a hospital diag-
nosis that the patient’s condi-
tion had nothing to do with
diabetes.
Forbes Advisor says there
were 513 million Indians with a
health or life insurance cover
in 2021 or 37% of the popula-
tion. With the introduction of
gover nment insurance
schemes, this has lifted to about
70%, but 400 million today still
have no access to health insur-
ance. IRDAI data meanwhile
shows it is a booming industry
with the gross premium on
health insurance collections
more than doubling from
`20,096 crore in FY2015 to
`58,237 crore in FY2021.
At the same time, the biggest
deterrent to universal insur-
ance was the high premiums
that continue to climb even as
services are poor. A recent
study by policybazaar.com
showed 43% of respondents
who hadn’t purchased a health
policy was because of the ‘high
premium’, while 32% said they
didn’t have sufficient funds. De-
spite all the recent talk by the
government of making health
insurance a universal cover, it
still remains a distant dream.

18% GST on corporate guarantee by parent co to subsidiary TVS to make BMW’s

THE Goods and Services Tax
(GST) Council, Chaired by Fi-
nance Minister Nir mala
Sitharaman, on Saturday, rec-
ommended that the parent
company’s corporate guaran-
tee to its subsidiary for a bank
loan will attract 18% GST.
However, if a director pro-
vides a personal guarantee for
a loan from a bank or any
financial institution to
their own company, no GST
will be applicable.
This newspaper was the first
to report that the Council will
come up with the clarification
on this issue.
Revenue Secretary Sanjay
Malhotra clarified during a
press conference that when a
corporate guarantee is given
by a director to their company,
the value of the service will be
deemed as zero, hence no tax
will be levied. This exemption
is applicable when no consid-
eration is paid by the company
to the director directly or indi-
rectly for providing the per-
sonal guarantee to the bank or
financial institution. In
such cases, the open
market value of the
transaction or supply
will be treated as zero,
resulting in no tax
liability.
However, the taxable
value of the supply of a corpo-
rate guarantee provided be-
tween related parties, such as
a parent company and its sub-
sidiary, will be calculated as
1% of the amount of the guar-
antee offered or the actual con-
sideration, whichever is
higher.
On this, Abhishek A
Rastogi, founder of
Rastogi Chambers,
feels that there could
be tax cascading in cer-
tain cases and the provi-
sions may be challenged in
courts.
“It may lead to absurdity in
cases wherein the actual con-
sideration charged is much
less than 1% of the guarantee
amount. The basic structural
framework of GST for valua-
tion of services gets defeated
when the services are valued
at predetermined percentages,
and not on the actual amount
of consideration,” said Rasto-
gi. The Council also recom-
mended an extension of upper
age of the President of the
GST Appellate T ribunal
(GSTAT) to 70 years from
67 years.

HILE the grand opening of the
Ram Temple in Ayodhya in the
presence of saints from all tra-
ditions and leaders of all castes,
is less than four months away, a
new era of caste politics has just
dawned with the Nitish Kumar-
led Mahagathbandhan government releas-
ing the caste survey report for Bihar. It was
technically a survey, not a census, since the
Centre alone is legally empowered to do the
enumeration.
Released on the politically significant Gan-
dhi Jayanti day, the report made Bihar the
first state in the country to share its caste
based population data. The survey put the
population of the backward castes, including
the OBC and the extremely backward castes
(EBC) in Bihar at a massive 63.13% of the
state's 13.07 crore population.
Of the 63.13% backward castes, the OBCs
constitute 27.13% and the EBCs 36%. As ex-
pected, the Yadavs (the dominant OBC seg-
ment to which RJD patriarch and ex-CM Lalu
Prasad belongs) constitute 14.27%, while the
Kurmis (current CM Nitish Kumar’s caste)
form merely 2.87%. With Muslims constitut-
ing 17.70% of the total population, the Mus-
lim-Yadav (MY) equation—the RJD’s prime
base—is the most formidable combination in
the state.
The Scheduled Castes (SCs) comprise
19.65% and the Scheduled Tribes (STs) 1.68%
of the population. The total share of the up-
per castes in the politically crucial state
stands at 15.5%, of which the Bhumihars
(Union minister Giriraj Singh’s caste) and
Brahmins constitute an identical 3.66%, the
Kshatriyas (Rajputs) 3.45% and the Ka-
yasthas 0.6%. Hindus constitute 82% and
Christians 0.0576%.
The Bihar legislature had unanimously re-
solved to conduct a caste survey twice within
a year, first in February 2019 and later in Feb-
ruary 2020. In August 2021, an all-party dele-
gation, which included the BJP, called on
Prime Minister Narendra Modi in Delhi and
requested him to conduct a nationwide caste
census. But, the Centre said the request was
not in line with the government's existing
policy. Subsequently, the Bihar government
issued a notification in June 2022 for conduct-
ing a caste survey across the state and allo-
cated `500 crore from its contingency fund
for the exercise.
Elsewhere in India
Just a day after the survey data was released,
Nitish Kumar announced a 10% quota for
people belonging to the economically weaker
sections in the state judicial services and
state-run law colleges and universities. It was

Shinde on June 21 last year
dropped a bombshell by initiat-
ing a coup against the parent
party led by Uddhav Thackeray,
who was also the chief minister
of the then ruling three-party
Maha Vikas Aghadi (MVA). Shinde first
herded 12 party MLAs to Surat via Thane-
Palghar and then flew to Guwahati, with the
logistical support of the BJP, where 34 more
Sena MLAs joined him. They claimed Ud-
dhav had lost their support as he had be-
trayed the Sena’s core ideology of Hindutva.
After trying to mollify them, the Uddhav
group initiated disqualification proceedings
against 16 rebel MLAs, including Shinde, and
sent them show-cause notices on June 25.
The next day, the Shinde group moved the
Supreme Court against the disqualification
notices arguing that Deputy Speaker Narhari
Zirwal - who was officiating as the Speaker -
had no right to hear the petitions. The post
of Speaker had been vacant since February
2021. The Shinde faction also invoked the
principle of natural justice to claim that the
eight-day notice given by Zirwal for their re-
sponse was not enough. On June 27, a vaca-
tion bench of the Supreme Court comprising
justices Surya Kant and J B Pardiwala issued
an unusual order giving 12 days of breathing
time to respond to the June 25 notice. The
normal period for replying to a disqualifica-
tion notice is seven days. The Shinde group
then issued a notice for the Deputy Speaker’s
removal from his post.
Parallelly, the Shinde camp informed Gov-
ernor Bhagat Singh Koshyari of their with-
drawal of support to the MVA and the latter
ordered a floor test on June 30. The Uddhav
faction challenged the floor test before the
SC, citing the pending disqualification pro-
ceedings. But the court on June 29 refused to
stay the floor test, stating its result would
anyway be subject to the final outcome of its
hearings. Sensing he would lose by a wide
margin, Uddhav resigned as chief minister
without facing the trust vote. Shinde was
sworn in as the new chief minister while
BJP’s Devendra Fadnavis took oath as his
deputy the following day.
On August 22, a three-judge bench referred
the matter to a five-judge bench. The Consti-

seen in political circles as a calculated at-
tempt to appease the upper castes, who are
an integral part of the BJP’s base across
the country.
The Mahagathbandhan government
strategically held back data on the eco-
nomic status of various castes com-
piled in the report. It intends to share it
during the winter session of the state
legislature.
If Bihar stole the thunder, the BJD-
ruled Odisha may not be far behind. It is
expected to announce the findings of its
survey on the backward classes—that be-
gan in May this year—anytime now. Its re-
port is said to have quantified Odisha's BC
population as 46%. Pressure is now mount-
ing on the Congress government in Karna-
taka, particularly from within the Congress
itself, to make the report public of the state’s
caste census commissioned by the then Sid-
daramaiah-led Congress government in 2015.
Odisha is the fifth state to complete a survey/
empirical assessment of its OBC population,
after Bihar, Madhya Pradesh, Maharashtra
and Haryana.
First census
While the first census in India began in 1872,
the first complete decadal census was done
in 1881. All the subsequent census exercises
included caste data till 1931. Enumerating
caste was dropped from the 1941 census re-
portedly due to administrative and financial
issues as England was involved in World War
II. In the 1931 headcount, the OBC population
nationally was around 52%.
In 2010, the then Congress-led UPA-II con-
ducted a separate socio-economic caste cen-
sus. While the raw data pertaining to various
castes was reportedly handed over to the Un-
ion ministry of social justice and empower-
ment, it was never made public by the subse-
quent BJP government since it claimed it
was flawed.
Timing, significance and fallout
Bihar's caste survey report was made public
days after most Opposition parties, including
the Congress—while debating on the legisla-
tion that gives 33% reservation to women in
Y Chandrachud began hearing the case on
February 14.
Shinde’s coup
The Shinde group staked its claim over the
party name arguing they were the real Shiv
Sena because they had the support of most
of its lawmakers in the Assembly and in Par-
liament and moved the Election Commission
of India (ECI). Since Uddhav was way short
in the Sena disqualification saga
of lawmakers, he showed his clout to the ECI
by collecting affidavits of support from the
party's cadre. He submitted over 8.5 lakh
membership documents and 2.62 lakh affida-
vits of party office bearers, to demonstrate
his grip over the Sena. However, the ECI on
February 17, 2023 allotted the name Shiv Sena
and the party symbol of bow and arrow to the
Shinde faction.
Tenth Schedule
In his disqualification petition, Uddhav cited
the Tenth Schedule of the Constitution that
serves as a deterrent to party hoppers. In
1967, Gaya Lal, an MLA in Haryana, changed
his party thrice in a day - from Congress to
Chhattisgarh CM Bhupesh Baghel on Saturday
accused the BJP of being against reservation, and
asked why the Union govt was not carrying out the
decennial census which has been due since 2021

Janata Party, going back to the Congress but
later again defecting to the Janata Party - all
within the space of nine hours. This prompt-
ed Atal Bihari Vajpayee to coin the famous
phrase, ‘Aaya Ram, Gaya Ram’ for turncoats
who destabilise governments. The anti-defec-
tion law was added to the Constitution in 1985
to prevent defections and eliminate political
corruption. The law defines a defector as one
who voluntarily leaves his party or disobeys
the leadership’s directions on a
vote in the House of Commons.
Such legislators stand disqualified
under the Tenth Schedule.
Uddhav faction's position
The Uddhav Sena claimed that the
Shinde camp’s actions—disregard
for the party Whip, the appoint-
ment of a new Deputy Speaker, the
call for a floor test, and claims of the rebel
majority— were all acts of defection. They
argued that the floor test called by the Gover-
nor was illegal and that by doing so, he rec-
ognised a split in the party. They also sought
reconsideration of the SC verdict in the Na-
bam Rebia case (2016), which held that a
Speaker could not initiate disqualification
proceedings against members of the House
if there is a pending notice for his own re-
moval. The Uddhav faction argued that the
2016 verdict gave those facing defection an
easy tool to halt proceedings by merely filing
a notice for the Speaker’s axing.
As for the Shinde faction, it argued that
they were the real Sena and not defectors. In
Maharashtra Congress president Nana Patole said
region-wise meetings will be held to strengthen the
party organisation in various regions of the state in
an aim to target the ruling Shiv Sena-BJP combine

hul Gandhi, while addressing a rally in
OBC-dominated Shajapur district of Madhya
Pradesh, promised a nationwide caste cen-
sus, if voted to power at the Centre.
Welcoming Bihar’s caste survey report,
Rahul pitched for Jitni abadi utna haq (rights
proportional to population). It drew a sharp
attack from Prime Minister Narendra Modi,
who asked if welfare benefits to Muslims
should be restricted since they constitute
just 17.7% of the population. In another anal-
ogy, he said the forthcoming delimitation of
Lok Sabha constituencies would sharply re-
duce the number of seats for the South, based
on proportional representation if the overall
strength of the House remains constant. Is
the Congress okay with it, he wondered.
Caste census is among the 11 poll guaran-
tees of the grand old party in the poll-bound
MP, which as per the May 2022 state back-
ward class report, has 48% OBC population.
But well placed sources put the total
OBC voters around 52% in the
state. Among the other poll-bound
states, Rajasthan reportedly has
over 50% OBC
population.

They saw the Governor's decision to order a
floor test as kosher as he had enough reasons
to believe Uddhav had lost the majority in the
House. Unsurprisingly, they quoted the Na-
bam Rebia verdict chapter and verse to say
the Speaker cannot conduct disqualification
proceedings if a petition to sack him/her is
pending.
Supreme Court order
The unanimous 141-page judgment of the
Constitution bench said the then Governor's
decision to seek a trust vote, which led to the
resignation of Uddhav, was illegal. But the
court also said it could not reinstate Uddhav
as CM because he had resigned instead of
facing the trust vote. The court said it cannot
ordinarily adjudicate petitions for disquali-
fication under the Tenth Schedule, adding
the Speaker must take the call within a rea-
sonable period.
On the right to appoint a Whip, the SC said:
“To hold that it is the legislature party which
appoints the Whip would be to sever the figu-
rative umbilical cord which connects a mem-
ber of the House to the political party. It would
mean that legislators could rely on the politi-
cal party for the purpose of setting them up
for election, that their campaign would be
based on the strengths (and weaknesses) of
the political party and its promises and poli-
cies, that they could appeal to the voters on
the basis of their affiliation with the party,
but that they can later disconnect themselves
entirely from that very party and be able to
function as a group of MLAs which no longer
owes even a hint of allegiance to the political
party.” Both the Whip and the Leader of the
party in the House can only be appointed by
the political party, the SC ruled.
Role of Speaker
As for the Whip issued by Uddhav faction
MLA Sunil Prabhu in his capacity as Chief
Whip of the Shiv Sena, to vote against the
rebels, experts opined that Speaker Rahul
Narwekar had no choice but to disqualify the
16 MLAs who violated the fiat. P D T Achary,
former Secretary-General of the Lok Sabha,
said, “The Speaker has no other option ex-
cept to disqualify the MLAs from the Shinde
faction because the Supreme Court said that
the Whip can be issued by the political party,

bled the guiding principles of the caste-based
parties that emerged out of Lohiaite social-
ism and Ambedkarite politics after the Man-
dal Commission report's implementation
during V P Singh's watch as PM. The slogan
also mirrors BSP founder Kanshi Ram's Jiski
jitni sankhya, utni uski hissedari (the greater
the community’s numbers, the greater its po-
litical representation) slogan.
It’s not just non-NDA parties that are clam-
ouring for a national caste census. Even NDA
partners like Anupriya Patel-led Apna Dal
(S) want it in BJP-ruled UP.
In MP, the Congress’s pitch for caste census
and OBC quota within women's reservation
is understandable, since the BJP has been the
biggest beneficiary of the OBC vote bank
there. The BJP's last three CMs were OBC
leaders — Uma Bharti, Babulal Gaur and
Shivraj Singh Chouhan. Besides, one of the
CM probables (among the seven fielded by
the BJP in the polls now) is Prahlad Singh
Patel, a powerful OBC Lodhi caste leader.
Clout of backward politics
In MP, half of whose population comes from
the OBC segment, 26% of the legislators (32
BJP and 28 Congress) are backward caste
politicians. After a mini-cabinet expansion
in August, 13 out of 34 ministers (38%) are
OBC leaders. In Bihar, the EBCs have long
been cultivated by Nitish Kumar as his prime
support base. In local dialect it is hence popu-
lar as panch foran (five spices that are crucial
for making a tasty curry) without whom no
majority government can be formed.
According to former All India secretary of
Congress’s student wing National Students
Union of India (NSUI) Ratnakar Tripathi,
“While Mandal-1 focussed more on caste
based reservation in education and jobs,
Mandal-2 is more about political influence,
particularly of the OBCs and EBCs/MBCs,
in the Hindi heartland.”
UP-based senior journalist Ajay Rai put it
in perspective. “Forced by the disintegration
of the larger Hindu vote due to the Mandal-1,
the RSS-BJP intensified the Temple Move-
ment in Ayodhya in the early 1990s. But three
decades later and months ahead of the grand
Ram Temple opening in Ayodhya, which will
certainly be used by the BJP to turbocharge
its Hindutva card, the INDIA bloc seems to
have smartly come out with a pre-emptive
strike through the Bihar caste survey. Subse-
quent demands for caste census appear to be
an astute move to counter the saffron and na-
tionalism agenda with caste based political
agenda in the Lok Sabha polls.”
An MP-based senior bureaucrat hailing
from Bihar, however, said the post-Bihar
caste census developments could even lead
to pushing the SC to lift its 50% quota cap,
which would do disservice to meritocracy.

For his part, Narwekar welcomed the SC
decision but sat on it for over a year. The Ud-
dhav faction on July 4 this year moved the SC
seeking expeditious disposal of the disquali-
fication pleas by the Speaker.
Bench press
The Supreme Court on September 18 directed
the Speaker to spell out the timeline within
a week for adjudication of the disqualifica-
tion petitions. Referring to its May 11, 2022
direction that the matter be decided within a
reasonable time, it said the Speaker has to
honour the dignity of the Supreme Court and
abide by its verdict. Since the Speaker is a
tribunal under the Tenth Schedule, it makes
him amenable to the court's jurisdiction, the
bench added.
Speaker finally acts
After the Supreme Court whiplash, Speaker
Narwekar flew to Delhi to consult legal ex-
perts and then served notices on all 54 MLAs
from both factions to explain their position.
The question then was whether all disquali-
fications petitions should be clubbed or heard
individually. Uddhav’s Sena demanded club-
bing because all petitions are of similar na-
ture and hearing one by one would mean
wasting time while the Shinde faction insist-
ed on hearing them one by one.
The timeline
The Speaker set October 13 as the date by
which both parties would file additional docu-
ments and citations over clubbing of hear-
ings. On November 6, both parties will suggest
which issues should be taken up for the club-
bing hearing. The process of filing evidence,
documents, affidavits, pleas, verification and
arguments would go on till November 23.
There are 38 petitions against 54 Sena MLAs.
Since Narwekar is Shinde's man, he can be
expected to settle for individual hearings to
drag the process on. Cross-examination will
begin on November 23 and shall be held twice
a week. It is expected to go on for months. Nar-
wekar could deliver his verdict by December-
end or the first half of January, if he does not
add a new twist to buy more time.
The clock for Chief Minister Shinde is tick-
ing. And Ajit Pawar is waiting impatiently to
step into his shoes.
