(conse 200%) You are further notified that pursuant to the provisions of Section 16-8A-7 of the Code for the Abatement of Dangerous Buildings, the undersigned, as officers charged with the administration and enforcement of said Ordinance, have inspected the building described above and have determined that itis a dangerous building that constitutes an immediate danger to the life, ib, health, property, or safety ofthe public within terms. Cf Ogden City Code Sections 16-8A-6 and 16-84-10 by reason of the following: 16-846: B7. Whenever any portion thereof has wracked, warped. buckled, or settled to such an extent that walls or other structural portions have materially less resistance to Winds or earthquakes than is requited in the case of similar new construction. Tho five-story building has been rough framed, and all five stories constructed. There are numerous structural deficiencies throughout the building witnessed on October 2, 2023. There are deflecting and sagging floor joists, non-code compliant structural connections, framing members bowing due to bearing weight overtoad, gravity load stress, and roof trusses tilting, leaning, and no longer vertical in position. The building structure is not constructed as required by the regulations of this jurisdiction or the approved construction plans issued with the building permit on December 8, 2021. Therefore, the structure is in violation of the Utah State and Ogden City adopted 2018 International Building Code. This condition constitutes an immediate danger to the life, limb, health, property, or safoty of the public because if any of the structural support members fail completely due to continual stress and weight overload, the building will collapse, which will put pedestrian and vehicular traffic and adjacent property on 25% street at risk of being hit or buried in the building construction debris. 16-8A-6: B13. Whenever any building or structure hes been constructed, exists, or is ‘maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by the building regulations of this jurisdiction, as specined in the Building Code, or of any law or ordinance of this State or jurisdiction relating to the condition, location, or structure of buildings The five-story building has all exterior walls rough framed with standard framing lumber and was not constructed using fire retardant treated framing lumber as noted and required on the jurisdiction approved construction plans Issued with the building permit. Therefore, all exterior walls of all stories are in violation and do not meet the Utah State adopted 2018 International Building Code requirements identified in Chapter 6, Chapter 7, and Chapter 23. This condition constitutes an immediate danger to the life, limb, health, property, or safoty of the public because if an accidental or intontional fire were to occur, duo to the amount of standard nontreated wood framing installed throughout the building, it would be difficult or impossible to extinguish. Due to this building's (asrsa.n0exs proximity to other buildings, the fire would spread to adjacent properties. The five-story building has been rough framed, and all five stories constructed. Thore are numerous structural deficiencies throughout the building witnessed on October 2, 2023. The most significant deficiencies are deflecting and sagging floor joists, non-code compliant structural connections, framing members bowing due to weight bearing overload, gravity load stress, and roof trusses tilting, leaning, and no longer vertical position. The building structure is not constructed as required by the regulations of this jurisdiction or the approved construction plans issuod with the building permit on December 8, 2021. Whenever any building or structure which, whether or not erected in accordance with all applicable laws and ordinances, has in any non-supporting part, ‘member, or portion less than 60%, or in any supporting part, member, of portion less than 66% of the: a) strength, b)fire-resisting qualities or characteristics, or c) ‘weather-resisting qualities or characteristics required by law in the case of a newly Constructed building of like area, height, and occupancy in the same location The building has numerous structural deficiencies witnessed on October 2, 2023. The supporting members are required to be at 100% of strength in newly constructed buildings, and supporting members in the structure are deflecting, sagging, have non-code compliant structural connections, framing members bowing due to weight overload, gravity load stress, and roof trusses tilting, leaning, and no longer vertical in position. The complete list of structural deficiencies witnessed on October 2, 2023, are: 1. The entire south side of the building has several structural floor joist systems deflecting and sagging due to unsupported structural loads from the loads transferred fram the raof and floor lavels above 7. The entire south side of the building has numerous non-bearing 2 x 6 frame wall systems deflecting and sagging due fo unsupported structural loads from the roof and floor levels above, 8. Structural floor joist hanging in face-mount hangers with no other support or attachment to structure, 9. All structural bearing floor joists appear to have the bottom flange of joist cut, notched, and narrowed to fit hangers that were not the correct width of the floor joist flange. 10. Numerous structural steel! beams have wood structural LVL beams without property installed wood pack-outibuld-out to make code compliant bearing Connection fram wood beams to steel beams and numerous steel beams have ‘wood structural LVL beams that appear to have only nails installed to make the bearing load connection. There are few ifany structural bolts installed to connect the pack-outs, Numerous locations have structural framing members with incorrect hangers Used at the roof and the roof sheathing was cut out and notched to allow space for the wrong hangers; the roof rafter in this condition has no positive lateral load resisting connection. 12, Several structural stee! beams have floor joists mounted to a wood ledger board fit inside the steel beam flange without any load bearing connection to the steel beam other than a make-shift wood post fiction bearing on the steel beam bottom flange. 19. Numerous locations have structural bearing floor joist flange and web cut out and removed portions due to plumbing piping installation, Cutting the flange and web is a violation of joist manufacturer engineer's design and installation instructions. 14. structural wood beam is installed next to a steel beam without proper ‘connection to the steel! beam. 16. There are some structural steel! beams without positive connections made to the wood post they bear on. 16. This condition constitutes an immediate danger to the life, imb, health, property, or safety of the public because the situation has created a condition of an abandoned building and construction site for more than six months with standard framing lumber rather than fire retardant treated lumber. The building has a lack of sufficient fire-resistive construction and has been determined to bo a significant fire hazard by the Fire Marshal and Fire Ch 16-8A-6: B19. Whenever any building or structure, or portion thereof, is vacant or open and: 1a, One or more of the doors, windows, or other openings are missing or broken; b. One of more of the doors, windows, of other openings are boarded up or secured by any means other than conventional methads used in the design ofthe building or permitted for new type, unless boarded in accordance with an approved vacant building plan pursuant to article B of this chapter; or 6. In such condition that it constitutes an attractive nuisance or hazard to the public. The five-story building has been rough framed, and all five stories constructed. On October 2, 2023, numerous and significant structural deficiencies throughout the bullding caused the existing stop work order, issued March 29, 2023, regarding building code violations to remain in place. There Is currently no known or sulinitted structural remedy ( each of the structural deficien outlined in this notice. This condition constitutes an immediate danger to the life, limb, health, property, or safoty of the public because the building and construction site have been abandoned for moro than six months, creating an attractive nuisance. Because the building is deemed a structural hazard with a significant risk of collapse, people are at risk of being hit or buried in the building construction debris. YOU ARE HEREBY ORDERED to: (1) Obtain the proper demolition permit and commence to completion the demolition of the building no later than fifteen days from the date of this notice; or (2) Present plans to Ogden City to repair the building and abate all dangerous Conditions. These plans must be feasible and should include structural shoring, fe protection, and a structural as-built remedy. Pursuant to Ogden Code Section 16-84-10, the building ‘must be repaired "in accordance with the current bullding code or other current code applicable to the type of substandard conditions requiring repair: Pursuant to Ogden Code Section 16-8A-8, the period of time for securing permits and ‘completing this work is 60 days. The work under any building permit issued for this work ‘must begin within 30 days of obtaining the permit and "must be prosecuted to ‘completion with reasonable diligence.” PLEASE NOTE: The building shall be demolished: a. Atthe option of the building owner; b. Ifthe owner fails to repair the building within 60 days; ©, Ifthe owner fails to adequately secure the building against entry or has failed to comply with the requirements of Ogden Code Section 16-88-1 et seq. of 4. Ifthe owner fails to submit feasible plans to repair the building within 60 days. (On Match 22, 2022, the first building inspection was requested for footing inspection, approved plans required 3 party special inspection be done by an independent agency as noted on approved plans (On May 10, 2022, a request was made by General Contractor (GC) for underground plumbing inspection. On November 29, 2022, Dove Rich, representing owner Mike Watson, emailed me a site visit observation report dated November 22, 2022, from Utah licensed structural engineer Adam J. Huff which specifically noted 14 structural deficiencies and code violations inthe as-built S-story building including photographs. The report ‘also outlined 14-16 plan and calculation design issues. The email fom Doug Rich sated that the owner wanted me to confidentially meet him atthe building todo an inspection. {explained per building code requirements, I ‘would need the permit holder's permission to enter the building for inspection purposes therefore Makers Line ‘would need to invite me and be present o grant entry [was then contacted by Mike Watson directly. On December 9, 2022, I emailed the explanation, legal permit holder and who can request inspections based on the Utah state adopted building code On January 25, 2023, request was made by GC for exterior shearwal inspection, inspection result noted “Due tothe number of structural deficiencies observed while on site fora window flashing inspection, the ‘engineer of record needs to inspect the building per design and approved plans and provide detailed repair instructions for needed corrections.” On February 8, 2023, request was made fora balcony ftaming inspection, report noting “need plan” to inspect. (On March 20, 2023, I was requested by General Contractor to meet on site to discuss changes they wanted 0 make to electrical, mechanical, and plumbing installations that would rest in changing the approved plans sed with the building permit. T arrived on north side of baiting. The meeting was being held on 2 floor south side. A I entered the north side ofthe building to wal tothe meeting, T immediately noticed the exttior ‘all framing was not fire-retardant treated lumiber as required in the approved constuction plans and Utah adopted 2018 Intemational Building Code. During the mecting I spoke to Owner representative, Mike Watson, and GC Makers Line represenative Shane Wayment regarding the changes after whic I informed them of the code violation, 1 observed inthe building regarding no fire-retardant treated lumber being used pe plan inthe ‘exterior walls of the entire building, It was all framed with standard non-treated framing lumber and beams, ‘On March 29, 2023, | sorved a stp all work onder on the project until an acceptable remedy of code violations is achieved and approved by the Ogden City Chief Building Official On April 18, 2023, new altemative method remedy plans were submited by the owner's architect fr plan review resulting in numerous itemized correction comments bth structural and non-siructral deficiencies corrections dated May 2, 2023 & May 3,2023. The corrections report was sent back othe owner's architect. ‘The structural deficiencies noted in the 3° party structural deficiencies report dated November 9, 2022, from 2549 Washington Boulevard, St 240 Open, UF 801 msencity com Doug Rich were added to the ety plan review based on the photographic evidence and written statements on the report, those items were numbered, listed, and referenced on the city plan review corrections report, On August 22,2023, revised altemative method remedy plans were submitted by the owner's architect for City plan review resulting ina lack of remedy/resolution inthe revised construction plans. Chad Robinson, A new structural submittal to remedy corrections repost comment #16 was sealed by Mr. Robinson, not Mr, Burkhart. The numbering ofthe structural responses from Professional Engineer Chad Robinson to each number on the corrections report did ‘not fllow the numbering sequence, due to this Makers Line was contacted and a request was made for permission to enter the building to see and compare the responses to match up the response number sequen. (On October 2, 2023, I met Makers Line representatives, owner's representative, architect of record Ryan P. ‘Mackowiak, and the engineer of record, 8. Chad Robinson at the building and was granted access to inspeet for nd match up to remedies response submitted from Mr. Chad Robinson with the out of sequence numbering. ‘The following itemized structural deficiencies I witnessed in the as-built framed and constructed building were ‘not present when I was inside the building on March 20, 2023, and have occurred over the past six months. 1. North side roof trusses were obviously leaning out of vertical plamb position, this condition is termed “truss racking failure” and isa significant structural problem 2. There were numerous locations with no structural hold down anchors from the building foundation to attach and anchor the framing members to the conerete foundation, 3. ‘There are numerous locations throughout the main level with structural steel columns resting on the floor without the structural connection nts and washers iastalled on the connection bolts, 4. Corridor joist faming not propery attached to ledgers and what looked like friction holding one sce of the joist which eaused the corridor to have at least @ one-inch slope across rather than being level. 5. ‘The entire main level towards the southside ofthe building has 2x 6 frame walls with the framing studs bowing due to unsupported loads transferred from the roof and floor levels above without structural bearing support in any of the walls running from east side of building fo west side of building. 66. The entire south sie ofthe building has several structural flor joist systems deflecting and sagging due ‘to unsupported structural loads from the loads transferred from the roof and floor levels above, 7. On the entre south side of the building has numerous non-bearing 2 x 6 frame wall systoms deflecting and sagging due to unsupported structural loads from the roof and floor levels above. 8. Structural floor joist hanging in face-mount hangers with no other support or allachment to structure, 9. All structural bearing flor joists appear to have the bottom flange of joist eu, notched, and narrowed to fit hangers that were not the correct width ofthe floor joist flange. 10, Numerous structural steel beams have wood structural LVL beams without property installed wood ‘pack-out/build-out to make code compliant bearing connection from wood beams to steel beams and ‘numerous steel beams have wood structural LVL beams that appear to have only nails installed to make ‘the bearing load connection. ‘There are few if any structural bots installed to connect the pack-outs 11 Numerous locations have structural framing members with incorrect hangers used atthe roof and the ‘oof sheathing was cut out and notched to allow space forthe wrong hangers, the roof rafter in this condition has no positive lateral load resisting connection. 12, Several structural steel beams have floor joists mounted to a wood ledger boat fit inside the sec! berm flange without any load bearing connection tothe stel beam other than a make-shift wood post friction ‘beating onthe steel beam bottom flange. 1.
