On 18.09.2023 at approximately 22:09, I, Kartik Agarwal residing at 69, Brahmpuri


Road, Jaipur, do hereby lodge this First Information Report (FIR) against Mr. Rajat
Kumar, a resident of T-33, Nathupur, Gurugram, on the grounds of the following:

Section of the Law Applicable: Section 504 of the Indian Penal Code (IPC) -
"Intentional Insult with Intent to Provoke a Breach of Peace."

Narration of the Incident:

On the specified date and time, I, Kartik Agarwal, residing at 69, Brahmpuri Road,
Jaipur, was in attendance at Brahmpuri, a communal gathering area within our
vicinity. During that particular moment, I witnessed a fervent dispute involving Mr.
Rajat Kumar, an individual residing in T-33, Nathupur, Gurugram.

Mr. Rajat Kumar was involved in a verbal argument with a group of individuals who
had assembled at the scene. During this altercation, Mr. Rajat Kumar engaged in the
use of exceedingly rude and aggressive words. The individual in question engaged in
purposeful and incendiary behavior by directing insulting remarks and insults towards
the group, specifically attacking their religious beliefs, caste, and personal traits.

The individual's behavior extended beyond simple disagreement or verbal discourse.


Instead, it was apparent that he deliberately utilized insulting words and insults in
order to incite a disruption of public order. The remarks made by Mr. Rajat Kumar,
which were disparaging in nature, were very unpleasant and intended to provoke
feelings of wrath and resentment among the individuals in attendance.

The activities undertaken by Mr. Rajat Kumar had the consequence of significantly
heightening the level of intensity and unease inside the atmosphere of Brahmpuri. The
individuals in close proximity, who were initially participating in a peaceful assembly,
grew increasingly angry and provoked in response to the individual's use of offensive

regarding the potential for a breach of peace or the manifestation of violent behavior.

promptly opted to notify the authorities about this occurrence, with the aim of

that the acts of Mr. Rajat Kumar were not merely a casual exchange of words, but a
purposeful endeavor to disturb public tranquility by the utilization of foul language

INVESTIGATION

 Case Diary under Section 160 of the CrPC

Details of the Case:

The present case concerns the First Information Report (FIR) filed under Section 504
of the Indian Penal Code (IPC), which accuses Mr. Rajat Kumar of deliberately
insulting a collective of individuals with the aim of inciting a disturbance of public
tranquility at the specified location of the incident on the 18th of September, 2023.

Actions taken:

On the 18th of September 2023, at 22:30 PM, I, SHO Dalveer Singh, accompanied by
my team, headed to the location of the occurrence at Brahmpuri subsequent to the
receipt of the First Information Report (FIR).

On the 18th of September 2023, at 23:15 PM, a series of statements were obtained
from the complainant, Mr. Kartik Agarwal, whereby he presented a comprehensive
narrative of the incident as outlined in the First Information Report (FIR). The
statement of the complainant was duly documented in compliance with Section 161 of
the Code of Criminal Procedure (CrPC).

On the 18th of September 2023, at 23:45 PM, testimonies were obtained from two
individuals who were present at the location in question on the aforementioned date.
These statements provided supporting evidence that aligns with the account provided
by the individual who filed the complaint. The statements made by the individuals
were duly documented in compliance with Section 161 of the Code of Criminal
Procedure (CrPC).

On the 19th of September 2023, around 12:30 AM, diligent attempts were undertaken
to identify and apprehend Mr. Rajat Kumar for the purpose of interrogating him in
relation to the aforementioned occurrence.

Statement of Jayesh Kumar Singh (Witness 1)

The undersigned, Jayesh, a 25-year-old individual residing at Subash Chowk, hereby


affirms my presence at Brahmpuri on the 18th of September, 2023, at around 22:09.
During that period, I observed an altercation between Mr. Rajat Kumar, a resident of
T-33 Gurugram, and a collective of individuals, which included Mr. Kartik Agarwal.

During the discourse, Mr. Rajat Kumar employed language that was both highly
disrespectful and provocative, specifically directed towards the religious beliefs,
social stratification, and personal characteristics of the parties concerned. The
individual's objective appeared to be the deliberate instigation of a disturbance in
public order, as evidenced by the strategic use of language intended to elicit feelings
of rage and animosity.

The activities of Mr. Rajat Kumar resulted in a heightened state of tension inside the
Brahmpuri milieu, prompting concerns regarding the potential escalation of the
situation towards violent outcomes. I am able to verify the veracity of the events as
delineated by Mr. Kartik Agarwal in his statement provided to the law enforcement
authorities.

Statement of Witness 2 - Himanshu

The undersigned, Himanshu, a 28-year-old individual residing at Jalmahal, hereby


asserts that I was in attendance at Brahmpuri on the 18th of September, 2023, at
approximately 22:00 hours. I am able to provide support for the assertions put out by
Jayesh with respect to the occurrence involving Mr. Rajat Kumar and Mr. Kartik
Agarwal.

The observer observed Mr. Rajat Kumar employing language that was both very
inflammatory and provocative during the altercation, with a clear intention to incite a
disturbance of public order. The individual's utterances were deemed objectionable as
they specifically aimed at denigrating the religious beliefs, social hierarchy, and
personal characteristics of the parties involved.

I agree with the testimony provided by Witness 1 regarding the sequence of events,
and I am of the opinion that the acts of Mr. Rajat Kumar played a role in exacerbating
the tense and potentially hazardous atmosphere prevailing in Brahmpuri.

well as their involvement in a verbal dispute with a group of others, including the one
who filed the complaint. Nevertheless, he refuted the utilization of exceedingly
unpleasant language or purposefully inciting a disturbance of public order. The
