RE: NOTICE OF ENCROACHMENT

Dear Ms. Capili;

We are the new owners of a parcel of land covered by Transfer Certificate of Title No.
_________________ with an area of _______________________sq.m. located inside
___________________.

We and my wife ____________ bought the said lot from Mr. __________________.
through a Deed of Absolute Sale dated _____________.

Recently, it has come to our attention that the common sidewalk of the said subdivision
has occupied a significant area of our property.

Accordingly, we sought the services of a Geodetic Engineer and was found out that
there was indeed an encroachment of more or less ___________________sq.m. of our
property. Attached herewith is a copy of the Survey Plan for your easy reference.

I understand that this may be an unintentional encroachment, but I would like to request
that the Home Owner’s Association take the necessary steps in order to rectify the issue
considering that what has encroached is a common sidewalk belonging to the
subdivision which occupied a significant size of our lot.

I hope that we can resolve this issue quickly and amicably taking into account that we
are currently in the process of commencing the construction of our house on the subject
lot.
