1. General information

Before taking up medical training in order to become a general practitioner, respectively a specialist,
or entering independent medical practice, you will have to meet the general legal requirements, as
referred to in point 2, as well as the specific requirements for medical practice, as described in point
3, AND you will have to register with the Austrian Medical Chamber.

Registration is only possible if medical activities are actually taken up. Applications for registration
have to be filed before any medical activities are taken up.

If you are currently not planning any medical activities in Austria, but only wish to have your
medical training obtained in an EEA country or in Switzerland recognised, you may file an
application for recognition of an EEA professional qualification pursuant to § 28 Austrian Medical
Act 1998 (ÄrzteG) Federal Law Gazette I 1998/169 as last revised by Federal Law Gazette I 2022/65.

For further information regarding the application procedure please contact the International Affairs
Team of the Austrian Medical Chamber (international@aerztekammer.at resp. see the contact
details under point 8.). After completion of the recognition procedure, you will receive a certificate
by the Austrian Medical Chamber stating that your professional qualification has been recognised
in Austria.

For information regarding medical activities within the framework of the free movement of services
according to Art. 7 of the Directive 2005/36/EC, respectively § 37 Austrian Medical Act 1998 please
refer to point 5.

2. General legal requirements for medical practice

Before taking up medical practice as a general practitioner or as a specialist, respectively as a doctor

in training in order to become a general practitioner, respectively a specialist, every physician is
required to register with the Austrian Medical Chamber while meeting the general legal
requirements according to § 4 (2) Austrian Medical Act 1998
• full legal capacity with regard to professional practice
• good character and repute required for the fulfilment of professional duties
• fitness to practice required for the fulfilment of professional duties (health condition)
• sufficient knowledge of the German language, as well as
• legal residence giving access to the labour market for the purpose of paid employment and
self-employed economic activities
as well as the specific requirements according to § 4 (3) Austrian Medical Act 1998 (see point 3).

You find a list of supporting documents of general and specific requirements to be provided under
point 4.

3. Specific requirements for medical practice (meeting the requirements of
medical training)

Before taking up medical practice in Austria - in the capacity of a doctor in training, general practitioner
or specialist – you have to register with the Austrian Medical Chamber (see point 4.) for which you
have to meet the general requirements according to § 4 (2) Austrian Medical Act 1998 (see 2.), as well
as the following specific requirements according to § 4 (3) Austrian Medical Act 1998:

3.1. Training undergone within the EEA or in Switzerland

If you have completed your medical training within the EEA or in Switzerland, you have to provide
evidence of your basic medical training (see 3.1.1), as well as of specific training of a general
practitioner (see 3.1.2.), if applicable, and/or specialised training of a specialist (see 3.1.3.), if
applicable:

3.1.1. Medical practice as a doctor in training

• The following supporting documents have to be provided for medical practice under
supervision and direction as a doctor in training:a diploma conferring the academic degree
of „Doktor der gesamten Heilkunde“ acquired upon graduation from medical studies at an
Austrian university or a diploma conferring the academic degree of „Doktor der gesamten
Heilkunde“ received after recognition of a medical university degree acquired abroad by an
Austrian university, oran evidence of formal qualification in basic medical training in
compliance with Annex V point 5.1.1. of the Directive 2005/36/EC issued by an EEA Member
State or Switzerland
• i.e. evidence of completion of medical studies and any certificate(s) accompanying the
qualification listed in Annex V point 5.1.1. and
• a certificate issued by the competent home Member State attesting that the training was
completed in compliance with Article 24 of the Directive or acquired rights in accordance
with Article 23 of the Directive 2005/36/EC.
If your evidence of basic medical training issued by an EEA State or Switzerland is not in compliance
with the rules of the Directive 2005/36/EC, it might be eligible for non-automatic recognition
according to § 5a Austrian Medical Act 1998. In such a case, please contact the International Affairs
Team of the Austrian Medical Chamber via international@aerztekammer.at or see contact details
under point 8.

3.1.2. Medical practice as a general practitioner

• The following supporting documents have to be provided for medical practice as a general
practitioner:basic medical training eligible for recognition in Austria (see 3.1.1.) andan
evidence of formal qualification in general medical practice in compliance with Annex V
point 5.1.4. of the Directive 2005/36/EC issued by an EEA Member State or Switzerland
• i.e. evidence / diploma on the completion of training in general medical practice (general
medical practitioner) and

 • a certificate issued by the competent home Member State attesting that the training was
completed in compliance with Article 28 of the Directive or acquired rights in accordance
with Article 30 of the Directive 2005/36/EC.
If your evidence of qualification in general medical practice issued by an EEA State or Switzerland is
not in compliance with the rules of the Directive 2005/36/EC, it might be eligible for non-automatic
recognition according to § 5a Austrian Medical Act 1998. In such a case, please contact the
International Affairs Team of the Austrian Medical Chamber via international@aerztekammer.at or see
contact details under point 8.

3.1.3. Medical practice as a specialist

• The following supporting documents have to be provided for independent medical

practice as a specialist:basic medical training eligible for recognition in Austria (see 3.1.1.)
andan evidence of specialist medical training in compliance with Annex V point 5.1.2. and
5.1.3. of the Directive 2005/36/EC issued by an EEA Member State or Switzerland
• i.e. evidence / diploma on the completion of specialist medical training and
• a certificate issued by the competent home Member State attesting that the training was
completed in compliance with Article 25 of the Directive or acquired rights in accordance
with Article 23 or Article 27 of the Directive 2005/36/EC.
If your evidence of specialist medical training issued by an EEA State or Switzerland is not in
compliance with the rules of the Directive 2005/36/EC, or is not listed in Annex V point 5.1.3. of the
Directive 2005/36/EC, it might be eligible for non-automatic recognition according to § 5a Austrian
Medical Act 1998. In such a case, please contact the International Affairs Team of the Austrian Medical

3.2. Medical training undergone outside the EEA and recognised in an EEA State or
Switzerland

If you have completed your medical training outside the EEA or Switzerland, and your training has
already been recognised by an EEA State or Switzerland, you have to submit the following supporting
documents on basic medical training (see 3.2.1.), as well on training of a general practitioner and/or
specialist medical training (see 3.2.2.), as applicable:

3.2.1. Medical practice as a doctor in training

If your evidence of basic medical training issued by a non-EEA State has been recognised by an EEA
State or Switzerland according to Article 2(2) of the Directive 2005/36/EC, and if you are authorised
to independent medical practice on the territory of the country of recognition, and if you have at least
three years of actual and lawful professional experience on the territory of the Member State which
recognised your evidence of basic medical training (according to Article 3(3) of the Directive
2005/36/EC, your training might be eligible for recognition according to § 5a subparagraph 6 Austrian
Medical Act 1998 (non-automatic recognition of third country diplomas). In such a case, please contact

or see contact details under point 8.

If you do not fulfil the conditions for recognition according to § 5a subparagraph 6 Austrian Medical
Act 1998, i.e. your diploma has not been recognised by an EEA State or Switzerland, and/or you are
unable to furnish proof of the required three years of medical practice on the territory of the Member
State which recognised your evidence of basic medical training according to Article 3(3) of the Directive
2005/36/EC, you will need to have your university degree recognised as equivalent by an Austrian
university. This recognition procedure is called Nostrifizierung (see 3.3.).

3.2.2. Medical practice as a general practitioner or a specialist

If your evidence of training of a general practitioner or of specialist medical training issued by a non-
EEA State has been recognised by an EEA State or Switzerland, and if you are authorised to
independent medical practice as a general practitioner or as a specialist on the territory of the country
of recognition, and if you are able to furnish proof of at least three years of actual and lawful
professional experience (according to Article 3(3) of the Directive 2005/36/EC), your training might be
eligible for recognition according to § 5a subparagraph 6 Austrian Medical Act 1998 (non-automatic
recognition of third country diplomas). In such a case, please contact the International Affairs Team of
the Austrian Medical Chamber via international@aerztekammer.at or see contact details under point
8.

If you do not fulfil these conditions, and subject to the recognition of your university degree in Austria
(Nostrifizierung) of you the possibility of filing an application for recognition of your training periods
with the Austrian Medical Chamber according to § 14 Austrian Medical Act 1998 (see
https://www.aerztekammer.at/ausbildung-im-ausland-anrechnung).

3.3. Medical training undergone in a third country

If you have completed your medical training in a third country and you do not fulfil the conditions for
recognition according to § 5a subparagraph 6 Austrian Medical Act 1998 described under 3.2., the
following applies for the recognition of evidence of training acquired in a third country (i.e. outside
the EEA/Switzerland):

3.3.1. Nostrifizierung (recognition of a university degree as equivalent to Austrian

standards)

Persons having completed their medical studies outside the EEA, first, will need to have their university
degree recognised as equivalent by an Austrian university (Nostrifizierung), in order to be entitled to
register with the Austrian Medical Chamber and to take up medical practice in Austria.

In Austria, the procedure of Nostrifizierung is within the competence of the medical universities
(Vienna, Graz or Innsbruck). Detailed information on the procedure of Nostrifizierung is provided
on the websites of the medical universities and can be requested from the medical universities
directly (contact details under 10.). The application for recognition (Nostrifizierung) filed with the
Medical University of Vienna has to be accompanied by an evidence that the procedure of
recognition is indispensable according to § 90 subparagraph 1 Austrian Universities Act 2002 (UG
2002) Federal Law Gazette I 2002/120 as last revised by Federal Law Gazette I 2021/93. This certificate
is issued by the Austrian Medical Chamber (see 3.3.2.).

 3.3.2. Certificate confirming that the procedure of Nostrifizierung is indispensable
according to § 90 subparagraph 1 (UG 2002)

For requesting such a certificate to be submitted to the Medical Universit ies, you have to submit
the following supporting documents: evidence of completion of medical studies issued by a third
country in the original language as a certified copy and as a certified translation, a curriculum
vitae (including the current mailing address), as well as a proof of identity (passport) to the
Austrian Medical Chamber, International Affairs Team, via international@aerztekammer.at.

3.3.3. Taking up medical practice

As soon as you have completed the procedure of recognition (Nostrifizierung) and hold the document
issued by the medical university, and provided that the requirements set out in § 4 (2) Austrian
Medical Act 1998 are satisfied, you are entitled to register with the Austrian Medical Chamber and
take up medical practice as a doctor in training (see 4).

3.3.4. Recognition of training periods undergone abroad

If you have already acquired training abroad (for example in the course of specialist training or training
of a general practitioner) you are entitled to file an application for recognition of training periods with
the Training Commission of the Austrian Medical Chamber, after the completion of the procedure of
Nostrifizierung. Your training certificates and supporting documents which you will have to submit in
the original will be examined by the Training Commission as to their equivalence with the Austrian
Medical Training Regulations. In any case, the final examination in general medical practice to
become a general practitioner or in a specialty to become a specialist remains compulsory and has
to be passed before the award of the respective diploma. For general information on the recognition

4. Registration

Before taking up medical practice in Austria, every physician is obliged to register with the Austrian
Medical Chamber according to the provisions set out in § 27 subparagraph 2 Austrian Medical Act
1998.

4.1. Required documents and application

As a rule, the following documents must be provided in the original language or as a certified copy
and as a certified translation, if necessary, for the purpose of registration:

➢ proof of nationality (f.e. proof of citizenship, passport, identity card)

➢ Nationals from non-EU/EEA States (third-country citizens)

➢ Proof of lawful residence on the entire federal territory

 ➢ (residence permit/settlement permit or status of recognized right of asylum or subsidiary
protection status in accordance with the Asylum Act) granting the right to paid employment
and self-employed economic activities (free access to the labour market)

➢ Certificate of marriage, where applicable (in case of name change)

➢ Certificate of Good Standing from countries, where you have practised medicine for more
than 6 months within the last 5 years. As they are only valid for 3 months from the date of
issue, they have to be presented for registration within this 3 month period

➢ Criminal record certificate / attestation of good character from a competent authority from
the home country /country of origin and those countries where you have resided for more
than 6 months within the last 5 years. At the moment of presentation for registration, both
documents must have been issued within the last three months

➢ Medical certificate confirming physical and mental fitness to practise the medical
profession. This certificate has to be made out by a physician who is legally entitled to
exercise the medical profession as a general practitioner, or a specialist in internal
medicine, or a specialist in occupational medicine, or an occupational health physician. If
the certificate was not issued in Austria, it has to be accompanied by a certificate from the
competent authority that the issuing physician is authorised to independent medical
practice. At the moment of presentation for registration, both documents must have been
issued within the last three months

➢ Evidence of training as described under 3. Specific requirements for medical practice (meeting
the requirements of medical training) as listed, Nostrifizierungsbescheid (document of
recognition of medical studies by an Austrian medical university), if applicable

➢ Contract of employment/ written confirmation by the employer / statement guaranteeing

employment or notification of self-employment or of “Wohnsitzarzt” (working at the place of
residence)

➢ 1 passport photograph (please consider the current passport photograph criteria, available
under www.oesterreich.gv.at)

➢ Evidence of sufficient knowledge of the German language (see below)

➢ For medical practice in a self-employed capacity (as well as for an activity as a „Wohnsitzarzt“
i.e. working at your place of residence), it is mandatorily required to provide evidence of a
professional liability insurance policy taken out from a service-provider or body authorised in
Austria according to § 52d Austrian Medical Act 1998 (see also 4.3.)

Application

The application for registration has to be filed with the Austrian Medical Chamber. The Medical
Chamber of the respective province where you plan to exercise the medical profession is available to
further assist with this. Their registration staff are also available for any other general questions
regarding registration as part of their service for members.

 4.2. Evidence of sufficient knowledge of the German language

Evidence of sufficient knowledge of the German language is provided by successfully passing a

language examination.

Physicians providing one of the following evidence, as sufficient proof of German knowledge, are
exempt from the examination:
• Professional activity in a health care system in German over three years
• School leaving examination in German or a similar and equivalent school-leaving
qualification
• Completion of studies in German
• Medical training and final examination of a general practitioner or a specialist in a
German speaking country
• Successful completion of studies of the German language
• German language examination, comparable and equivalent to the Austrian examination,
passed in a country where German is an official language

In absence of any exemptions as indicated above, the language examination has to be passed
mandatorily with the Austrian Academy of Physicians (“Österreichischen Akademie der Ärzte”).

The application for the language examination has to be accompanied by a language certificate
confirming German language proficiency level C1 in accordance with the Common European Framework
of Reference for Language of the Council of Europe. Language certificates are valid for 10 years.

4.3. Professional liability insurance

For medical practice in a self-employed capacity (as a self-employed doctor and as a „Wohnsitzarzt“
i.e. working at the place of residence), it is mandatorily required to provide evidence of a professional
liability insurance policy taken out from a service-provider or body authorised in Austria (according to
§ 52d Austrian Medical Act 1998) before taking up medical activities.

The legally required liability insurance has to provide coverage amounting to the minimum
insurance sum of € 2 million for every insurance claim arising from medical practice.

Group practices under the legal form of a ”GmbH” (limited liability company) a required to have
an insurance providing a maximum liability limit of at least the fivefold amount of the m inimum
insurance sum per one year insurance period.

Physicians practising in a self-employed capacity are required to have an insurance providing a

maximum liability limit of at least the triple amount of the minimum insurance sum per one year
insurance period.

Employed doctors practising medicine (part-time) in a self-employed capacity (e.g. furnishing a
medical opinion, practising on the basis of a free service contract or work contract) are also under
the obligation to provide evidence of a professional liability insurance policy before taking up
medical activities.

An exception applies to physicians who already have a professional liability insurance policy (e.g.
for their activity as court-certified experts.

For written notification of the professional liability insurance policy to the Medical Chamber, the
insurer uses the form „Meldung der Berufshaftpflichtversicherung gemäß § 52d ÄrzteG 1998".

5. Medical activities within the framework of the free movement of services

according to § 37 Austrian Medical Act 1998

5.1 General information and requirements

Citizens of an EEA state or of Switzerland who lawfully practice medicine in one of the EEA states
or Switzerland are allowed to practice medicine in Austria while maintaining their place of
business outside of Austria (under the relevant title “general practitioner” or “specialist”). A
service is considered to be provided when the medical activity is done temporarily and
occasionally. Such cases are to be reviewed individually, in particular based on the duration, the
frequency, the regular return and the continuity of the medical activities (i.e. visits or short -term
replacements of a doctor permitted to practice in Austria).

If a place of business is founded in Austria, it can no longer be presumed that activities are taken
up occasionally or temporarily.

Therefore, the following conditions must apply:

• The planned medical activities do not require a place of business in Austria;
• The activities are not done under the employment of someone else;
• The activities are not intended to be repeated on a regular basis;
• The activities are done from a foreign place of business.

Activities as a freelance practitioner may only be taken up after the planned activities have been
announced to the Austrian Medical Chamber in writing.

The documents listed below are to be attached to this announcement in their original form or as
a certified copy.

Documents that were not awarded in German are to be provided with a certified translation (the
translation must also either be in its original form or a certified copy).

 5.2 Required documents

• A certificate issued by the competent authority of the country of origin, which confirms that you
are established as a general practitioner or specialist who is allowed to practice medicine
independently in this country and that the permission to practice has not been withdrawn, even
temporarily, at the time of issuance of the certificate.
• Police records from the country of origin and from all countries in which you have resided or
practiced medicine for more than six months during the last five years (the records must not be
older than 3 months at the time of application with the Austrian Medical Chamber).
• Certificate of Good Standing from the country in which you are legally established or practice
medicine (the document must not be older than 3 months at the time of application).
• A certificate confirming nationality, passport, personal identity document.
• Proof of professional qualification.
• Proof of professional liability insurance with an insurance company authorized to conduct
business in Austria according to § 52d Austrian Medical Law (see point 4.2.)
• Self-declaration of German language skills that are necessary for the practice of medicine.

5.3 Cross-border activities in Austria as an emergency doctor

Emergency doctors who are planning to take up cross-border activities in Austria are requested to
contact the Austrian Medical Chamber or directly provide their documents to the Austrian Medical
Chamber via h.gruber@aerztekammer.at in order have the equivalence of their medical emergency
training evaluated.

Service providers under § 37 Austrian Medical Law 1998 are registered with the Austrian Medical
Chamber and their medical activities are subject to the regulations of the Austrian Medical Law.
Activities as a freelancer are limited to one year; thereafter you must apply in writing for the
extension of the registration as a freelance service provider with the Austrian Medical Chamber.

Notification of temporary service provision

The announcement of a temporary provision of service must be done via the Austrian Medical
Chamber (ael-recht@aerztekammer.at).

7. Health insurance contracts for established doctors

Health insurance contracts for established doctors: the establishment of a registered office in Austria
does not automatically provide the authorization for direct billing with the Austrian social insurance
providers (so-called compulsory health insurance contracts). Specialists and general practitioners
should register their interest regarding this with the medical chamber of their respective province.
