Decree holder has sought transfer of decree under section 39 of CPC.

2. The Certified copy of decree passed in Spl.C.S. no.51/2012 annexed
with list Exh.3 shows that the defendant which is the registered company
doing its business at Bangalore has been directed to pay an amount of
Rs.13,07,704/- to Decree holder with interest @ 18% p.a. and the cost of the
suit.
3. As the decree has been passed against the Judgment debtor who resides
outside the local limits of the jurisdiction of this court, the transfer application
is to be allowed and the decree is to be transferred in consonance of the
provisions of Section 40 CPC. Thus the following order.
ORDER
1. The decree in Spl.C.S. no. 51/12 shall be transferred to the court
exercising jurisdiction over the place where the judgment debtor is carrying
its business in the manner prescribed by rules in force in the state of
Karnataka under section 39 of CPC.
2. Civil M.A. no. 291/2023 is disposed of accordingly.
