There are a few key details we need to set out as part of your contract with us: Our offer is subject to receipt of satisfactory references and medical evidence of health and, as you know, completion of a 16 week probationary period. You will be paid at the rate of £10.42 per hour. Salaries are paid four-weekly, by direct credit transfer into a UK bank or building society account. Your first salary payment is due on Friday 4th August 2023 and then four weekly. Yours sincerely STATEMENT OF MAIN TERMS AND CONDITIONS OF EMPLOYMENT Cobra Coffee South West Limited 1000 Lakeside, Western Road, Portsmouth, Hampshire, PO6 3FE ‘Telephone: 02392 222500 Name of Employee: Dhruvakumar Ramesh (‘you’ or ‘your’) Contract effective date: 07/07/2023 Continuous Service date begins: 07/07/2023 Job title: Barista Place of work: Your normal place of work is Exeter We may need you to work at a location other than your normal place of work either on a temporary or permanent basis, Basic rate of pay: £10.42 per hour. You will be paid four weekly directly into your UK bank or building society account. Contracted hours of work: Your normal working hours will total 16 per week in accordance with the rota which will be notified to you on a weekly basis, and will involve day, night and weekend working. At times, we may require you to work hours in excess of your normal working hours. These will be paid at your normal hourly rate. Additional hours are only paid when you are asked to work them by your line manager. If you work a minimum of six hours in a day, you are entitled to a 20 minute unpaid break. You are required to clock in at the beginning and clock out at the end of each working day and before and after breaks, using the Company's clocking system, If you wish to undertake paid work for anyone else whilst employed by Cobra Coffee, you will need prior written permission from Cobra Coffee Probationary period: Your employment is subject to a probationary period of 16 weeks, during which time you will be required to demonstrate your suitability for the position in which you are employed. We may extend this period. Deductions: Cobra Coffee may deduct from your salary, or any other payments due to you, any sums due to it, including but not limited to: overpayments, outstanding loans or advances, sums for unauthorised absences and holiday entitlement taken in excess of entitlement. Any sums due that cannot be recovered at the point your employment ends must be repaid within 14 days of your final date of employment. This includes the cost of any Cobra Coffee property. Holidays: You are entitled to 28 days holiday which is inclusive of the 8 permanent Bank Holidays, When calculating holiday entitlement, a day is equal to one fifth of your weekly contracted hours. The holiday year runs from 1° April to 31° March. Holiday entitlement must be taken within the current holiday year and cannot be carried over. All holiday leave must be approved in advance by your line manager. No more than two weeks annual holiday may normally be taken at any one time. We may require you to take all or part of any outstanding holiday entitlement during a period of notice to terminate your employment. On termination of your employment, you will be paid any holiday accrued and not taken. If you have taken more holiday than you have accrued, this will be deducted from your final pay. Public Holidays: Where a public holiday falls on a normal working day for you and you are required to work, you will be paid as normal at your basic rate of pay. Absence from work: If you are unable to come to work you must telephone your line manager immediately. Details of the full absence procedures are set out in the Sickness Absence Policy. Sick pay: If you are unable to come to work due to sickness or injury you will be entitled to Statutory Sick Pay, provided you meet the qualifying conditions. Other paid leave: You may be eligible for statutory paid leave, including maternity leave, adoption leave, paternity leave, shared parental leave, time off for dependants, bereavement leave. Details are available in the Employee Handbook. ‘Training: You will be required to complete induction and ongoing training in you role. Details of the training you will need to complete will be shared with you through our digital training platform and from your line manager. Confidentiality: You must not use or disclose to any person, either during or at any time after your employment with Cobra Coffee, any confidential information about the business of Cobra Coffee, or about any other matters which may come to your knowledge in the course of your employment. Confidential information means any information or matters not in the public domain (except as a result of your breach of this agreement) and which relates to the business or affairs of Cobra Coffee or any of its business contacts. Right to search: In order to maintain security, uphold policies or if it believes a criminal offence may have been committed, Cobra Coffee may search you or your property held on its premises at any time. Pensions: Where you are eligible, Cobra Coffee will auto-enrol you into a pension scheme, in accordance with its pensions auto-enrolment obligations. Full details of the pension plan available to you will be provided in due course. The operation of any pension plan will be subject to the plan rules and will not form part of your terms and conditions of employment. A contracting-out certificate is not in force in respect of your employment. Notice Period: You are required to give, and entitled to receive one weeks notice to end your employment with Cobra Coffe. After 2 years continuous employment you will be entitled to receive 2 weeks notice. This period will increase by one week for each subsequent year of employment up to a maximum of 12 weeks. Notice to end your employment must be given, in writing, to your line manager. Cobra Coffee may choose to give you payment in lieu of you working your contractual notice, If your employment is terminated on the grounds of gross misconduct you will not be entitled to notice or payment in lieu of notice, Garden Leave: During your notice period, Cobra Coffee may choose to suspend or exclude you from any Cobra Coffee premises if deemed necessary. During this time you must continue to be available to carry out your duties and mustn’t work for any other person or organisation without prior written permission, Disciplinary and Grievance procedures: The disciplinary and grievance rules and procedures are set out in the Employee Handbook and are not contractual. The Disciplinary Procedure does not apply during your probationary period. Any event causing grievance or dispute should be raised immediately with your line ‘manager. Lay off and short-time working: In circumstances when your normal work is not available due to fire, storm damage, strikes, riot or similar causes outside Cobra Coffee’s control, you may be given twenty four hours’ notice that you are being temporarily laid off or placed on short-time working until normal work is again available, You will be laid off without pay, or in the case of short-time working, paid only for hours worked Overseas Employment: You will not be required to work outside of the United Kingdom. Collective Agreements: There are no Collective Agreements affecting the terms of your employment, Data Protection: As your employer, we need to collect, keep and process information about you for normal employment purposes. The details, including your rights, are contained in the Privacy Notice provided with this contract of employment. We will process personal data and special categories of personal data relating to you in accordance with the Privacy Notice and Data Protection Policy. We take the security and privacy of your data seriously and you must understand and keep to our IT Security and Data Protection Policies at all times. Employee Handbook: The Employee Handbook is available for you to consult in store.
