We are pleased and very glad to got an opportunity to participate in JBCCI-XI after along period with the help of al efforts from
cour front line leaders. In absence of our union during last JBCCI, no one was discussing and putting one burning issue of Diploma
Engineers (E&M, Excy & Civil Discipline) for extension of cut-off date ie. 09.08.1993 before standardization committee of Cl. This case
‘was pending since last 25 years ie. from 1998, So, we expect for inclusion of this case in the Agenda of Standardization Committee, CIL to
bbe discussed in future. As you are well aware ofthat, there are so many Diploma Engineers are holding key posts of our union and working
Sincerely for the interest and growth of our union in different subsidiaries of CIL. Even if, many employees have already been
‘superannuated from their service and Injustice shown by the CIL. Management. To sort out discrepancies and discontentment amongst
Diploma Engineers (E&M, Excv & Civil Discipline), who have assigned in the same nature of works, the extension of cut-off date for
“Notional Seniority” is needed on the basis ofthe following criteria,
1. Kindly, refer letter no. 6/145 dated 16,07.2018 of Shri SQ. Zama, Secretary General, INMF(INTUC) duly addressed to The Chairman,
CCL, Kolkata in which the details of this case mentioned briefly for extension of cut-off date Le. 09.08.1993 to the Diploma Engineers
(E&M, Excv & Civil Disciplines) for the same nature of work (Annexure-A),
Earlier, there are 03 Nos. of Circulars issued from CIL in different dates and the cut-off date of "Notional Seniority” extended for the
‘same nature of work.
In Circular No, 4576 dated 09.08.1993, extended up to 31.12.1988 (Annexure-B)
In Circular No, 2789-98 dated 11.03.1996 ~ extended up to 31.12.1990 (Annexure-C)
In Circular No, 513 dated 13.08.1998 : extended up to 09.08.1993 (Annexure-D)
3. Therg was no diference of work assignment and nature of work between the Diploma Engineers (E&M, Excy& Civil Discipline) wo
haveSfpointed before 09.08.1993 and after 09.08.1993 working in Coal Industry. But, here discrepancies and differential treatment
shown between them, Diploma Engineers (E&M, Evy & Civil Discipline) appointed before the revised cut-off date of 09.08.1993,
‘were extended T&S GrB and T&S GrA notionally from the due date which resulted into timely promotion in T&S GrAl. So, injustice
shown to those who have been appointed after 09.08.1993 for the same nature of Hazardous mine activity works.
You are requested to kindly arrange to include this burning issue pending since more than last 25 years with the CIL.
‘Management and extend this facilty by giving "Notional Seniority” in T&S GrB on the day of their initial appointment date and T&S GrA
just after 03 years of T&S GrB to bring an uniformity amongst appointed after 09.08.1993.

Sub: To Adopt/ Enforce uniformity in career growth of Diploma Holders.
Dear Sir,
A copy of joint representation dated 11.07.2018 addressed to Chairman, CIL,
Kolkata (in Hindi) comprising of 9 pages from Diploma Holders of CIL / Subsidiaries
is enclosed herewith for ready reference. Diploma Holders who have been appointed
aiter cut-off date 9" August, 1993 are striving hard to delete / extend the cut-off date
to enable them to have non-discriminatory eligibility criteria for uniform career growth
including promotions from Non-Executive to Executive Cadre.
After persistent persuasion, in NCWA-VIII a provision was made for one time
promotion of Diploma Holders in Engineering Disciplines i.e. Mining, E&M,
Excavation, Civil, E&T, Industrial Engineering, Coal Preparation etc. who were
stagnating in T&S Gr. A/ A1 for more than 15 years (as on 31.03.2010) to E1 grade
and accordingly CIL issued /circular No. 30-40 dated 16.04.2010 resulting into
thousands of promotions in £1 Grade.
The cut-off date of 9" August, 1993 had emerged out of an Memorandum of
Settlement dated 10.08.1990 signed between RKKMS (INTUC) and WCL over
appointment of Diploma Holders in T&S Gr. C against earlier system of appointment
in T&S grade - B as Trainees in E&M and Excavation Cadre. In terms of said
settlement WCL extended Notional Seniority of T&S Gr.’B' to all such Diploma
Holders who were appointed prior to 31.12.1988. The matter was also raised in other
subsidiaries by Diploma Holders appointed in T&S Gr. ‘C’ prior to 31.12.1988, and
after persistent persuasion, the anomaly in seniority amongst Diploma Holders was
rectified by giving Notional Seniority at par with counter parts appointed in WCL.
Thereafter, CIL further extended the cut-off date of 31.12.1988 to 31.12.1990 and
finally to 09.08.1993 together with extending the same benefit to Diploma Holders in
Civil Engineering which was issued in form of Circular vide letter No. 929 dated 18"
January, 1998. Out of Memorandum of Settlement of WCL dated 10.08.1990, the
cutoff date of 31.12.1988 was extended to 31.12.1990 and finally 09.08.1993 and
hence all Diploma Holders appointed before the revised cut-off date of 09.08.1993
were extended Gr. ‘B’ and Gr. ‘A’ notionally from due date which resulted into timely
promotion in A-1 Gr. thereby qualifying the eligibility criteria of 15 years in T&S Gr
‘4'/ A-1 Grade for promotion to E-1 Grade.

The demand of similar relaxation / benefit by Diploma Holders appointed after
09.08.1993 are quite genuine, legitimate and must be dealt on priority basis. In
future, if occasion arises for similar promotions from Non-Executive to Executive
Cadre in E-1 Grade or even otherwise in E-2 through selection process they will be
mated out with gross injustice and discrimination, if, similar benefit is not extended by
deleting / extending the cut-off date once for all. Needless to add that the Diploma
Holders are middle level managerial functionaries as backbone of the Industry. The
Mining Diploma Holders already exercise special dispensation whose services are
statutorily regulated under Mines Act, 1952
