This Section consists of provisions that are specific to each procurement and supplement the informa-
tion or requirements included in Section 1 (Instructions to Bidders).

A. General

C. Preparation of Bids

ITB 10.1 The language of the Bid is: English


To facilitate the evaluation of applications, Employer asks the Bidders to submit
one copy of the translation into the Russian language of their application.
However, the lack of translation does not entail rejection of the proposal. In case
of discrepancies between the English version and the translation, the English
version shall prevail.

ITB 11.1 (h) The Bidder shall submit with its Bid the following additional documents: N/A

ITB 12.1 The units and rates in figures entered into the Bill of Quantities and Daywork
Schedule should be typewritten or if written by hand, must be in print form. Bill of
Quantities and Daywork Schedule not presented accordingly may be considered
nonresponsive.

ITB 13.1 Alternative bids shall not be permitted.

ITB 13.2 Alternative times for completion shall not be permitted.

ITB 13.4 Alternative technical solutions shall be permitted for the following parts of the
Works: N/A

ITB 14.5 The prices quoted by the Bidder shall be fixed.

ITB 15.1 (a) The prices shall be quoted by the Bidder in: US Dollars. A Bidder expecting
to incur expenditures in other currencies for inputs to the Works supplied from
outside the Employer’s country (referred to as the “foreign currency
requirements”) and wishing to be paid accordingly, may indicate other foreign
currencies of their choice expressed as a percentage of the bid price, together
with the exchange rates used in the calculations in the Schedule of Payment
Currencies included in Section 4 (Bidding Forms).
(b) The rates of exchange to be used by the Bidder for currency conversion
during bid preparation shall be the selling rates for similar transactions prevailing
on the date 28 days prior to the deadline for submission of Bids published by
Central Bank of Uzbekistan. If exchange rates are not so published for certain
currencies, the Bidder shall state the rates used and the source. Bidders should
note that for the purpose of payments, the exchange rates confirmed by Central
Bank of Uzbekistan, as the selling rates prevailing 28 days prior to the deadline
for submission of bids shall apply for the duration of the Contract so that no
currency exchange risk is borne by the Bidder.
(c) Foreign currency requirements indicated by the Bidders in the Schedule of
Payment Currencies shall include but not limited to the specific requirements for
• expatriate staff and labor employed directly on the Works;
• social, insurance, medical, and other charges relating to such expatriate
staff and labor, and foreign travel expenses;

• imported materials, both temporary and permanent, including fuels, oil and
lubricants required for the Works;
• depreciation and usage of imported Plant and Contractor's Equipment,
including spare parts, required for the Works;
• foreign insurance and freight charges for imported materials, Plant and
Contractor's Equipment, including spare parts; and
• overhead expenses, fees, profit, and financial charges arising outside the
Employer's country in connection with the Works.
(d) Bidders may be required by the Employer to clarify their foreign currency
requirements, and to substantiate that the amounts included in the unit rates and
prices and shown in the Schedule of Payment Currencies are reasonable and
responsive to item (c) above, in which case a detailed breakdown of its foreign
currency requirements shall be provided by the Bidder.
(e) Bidders should note that during the progress of the Works, the foreign
currency requirements of the outstanding balance of the Contract Price may be
adjusted by agreement between the Employer and the Contractor in order to
reflect any changes in foreign currency requirements for the Contract, in
accordance with Sub-clause 54.1of the Conditions of Contract. Any such
adjustment shall be effected by comparing the percentages quoted in the bid with
the amounts already used in the Works and the Contractor's future needs for
imported items.”

ITB 15.4 The rates of exchange shall be the selling rates 28 days prior to the deadline for
submission of bids published by Central Bank of Uzbekistan.

ITB 16.1 Technical Proposal shall also include a Health and Safety COVID-19 Plan, in
accordance with the relevant government regulations and guidelines on COVID-
19 prevention and control available here:

Bidders are requested to follow the sections 1, 2, 3, 4, 5.1.4 and 8 of the
referenced document in developing a project specific Health and Safety COVID-
19 Plan. Bidders may consider the international good practice guidelines to
complement the local regulations and guidelines were deemed necessary [World

Any bid not accompanied by the HS-C19 Plan shall be rejected by the Employer
as nonresponsive. If a Bidder submits a HS-C19 Plan that does not provide
sufficient information in accordance with the required submission information
listed in the bidding document by the Employer, the Employer shall issue a
clarification to request for further information from the Bidder. The Bidder must
submit the requested information within 5 working days of receiving such a
request. Failure to provide a satisfactory response to the request for further
information within the prescribed period of receiving such a request shall cause
the rejection of the Bid.

ITB 18.1 The bid validity period shall be 180 days.

ITB 19.1 The Bidder shall furnish a bid security in the amount of 264,200.0 US dollars

ITB 19.2 The ineligibility period will be N/A

ITB 19.4 Subject to the succeeding sentences, any bid not accompanied by an irrevocable
and callable bid security shall be rejected by the Employer as nonresponsive. If a
Bidder submits a bid security that (i) deviates in form, amount, and/or period of
validity, or (ii) does not provide sufficient identification of the Bidder (including,
without limitation, failure to indicate the name of the Joint Venture or, where the
Joint Venture has not yet been constituted, the names of all future Joint Venture
Partners), the Employer shall request the Bidder to submit a compliant bid
security within 14 days of receiving such a request. Failure to provide a compliant
bid security within the prescribed period of receiving such a request shall cause
the rejection of the Bid.

ITB 20.1 In addition to the original Bid, the number of copies is: three (3) and one (1) soft
copy and BoQ in Excel-format

ITB 20.2 The written confirmation of authorization to sign on behalf of the Bidder shall
consist of:
(а) Power of attorney specifying the representative's authority to sign the Bid on
behalf of, and to legally bind, the Bidder.
(b) If the Bidder is an intended or existing Joint Venture, the power of attorney
should be signed by all partners and specify the authority of the named
representative of the Joint Venture to sign on behalf of, and legally bind, the
intended or existing Joint Venture. If the Joint Venture has not yet been formed,
also include evidence from all proposed Joint Venture partners of their intent to
enter into a Joint Venture in the event of a contract award in accordance with ITB
11.2.

ITB 20.2 The Bidder shall submit an acceptable authorization within 14 days.

E. Evaluation and Comparison of Bids

ITB 32.1 The currency that shall be used for bid evaluation and comparison purposes to
convert all bid prices expressed in various currencies into a single currency is: US
Dollars
The source of the selling exchange rate shall be: rate of the Central Bank of the
Republic of Uzbekistan upon sale of currency 28 days prior to the deadline
for Submission of bids

ITB 33.1 Domestic preference will not apply.

ITB 34.1 The Employer does not intend for the contractor to execute any specific
elements for the Works through nominated subcontractors.

ITB 38.2 Qualifications of other firms such as the Bidder’s subsidiaries, parent entities,
affiliates, subcontractors shall not be permitted.

ITB 40.1 Standstill provisions shall not apply.

F. Award of Contract

ITB 45.1 The procedures for Bidding-Related Complaints are referenced in Appendix 7 of
the Procurement Regulations for ADB Borrowers. The Bidder should submit its
complaint following these procedures, in writing, to:
