II Childs Rights in Saudi Arabia

1. Legislation
1.1 Basic Law of Governance 1992

Sauidi Arabia is a party to the CRC since 19961. While ratifying the Convention the Kingdom of
Sauid Arabia brought a following reservation to the convention “[The Government of Saudi Arabia
enters] reservations with respect to all such articles as are in conflict with the provisions of Islamic
law.” Saudi Arabia is an Islamic country. Art. 1 of Saudi Basic Law which is serving as a Constitution of
the Country states that: “The Kingdom of Saudi Arabia is a sovereign Arab Islamic State. Its religion is
Islam. Its constitution is Almighty God's Book, The Holy Qur'an, and the Sunna (Traditions) of the
Prophet (PBUH). Arabic is the language of the Kingdom. The City of Riyadh is the capital.”
Please look at Chapter 5 of Basic Law maybe you can connect any of rights and duties with children.
The Basic Law does not refwer diretly to children but following articles protect children rights.
For example Article 26 statest thath The State shall protect human rights in accordance with the
Sharia. Folllowing Article 27 provides thath The State shall guarantee the rights of the citizens and
their families in cases of emergency, illness, disability and old age. The State shall support the So cial
Insurance Law and encourage organizations and individuals to participate in philanthropic activities.
Article 30 states thath”The State shall provide public education and commit itself to the eradication of
illiteracy” while Article 31 states thath “The State shall look after public health and provide health
care for every citizen”

III Universal Human Rights Standard – KSA comparative study

1.1.5. Right to education - Universal human rights standard compare with KSA
Saudi Arabia is not discriminating in the access to education. As mentioned earlier Basic Law
states that citizens shall have access to public education and illiteracy should be combated. Access to
public education is free.2
