In today's digital age, domain names have become valuable assets for businesses, individuals,
and organisations. They serve as gateways to an online presence and identity. It is common to
experience disputes regarding ownership and usage, and online dispute resolution (ODR)
mechanisms have emerged as crucial tools for efficiently addressing domain name disputes.
These mechanisms provide an efficient and convenient way of settling conflicts without the
need for physical presence. This abstract discusses the legal and regulatory aspects of domain
name disputes in India's ODR context. It explores the regulatory framework provided by the
Information Technology Act of 2000 and the Arbitration and Conciliation Act of 1996, which
enable the establishment of ODR mechanisms. The abstract also considers the role of the
National Internet Exchange of India, which administers the.IN domain and offers dispute
resolution services under the Indian Domain Name Dispute Resolution Policy (INDRP). The
focus of this abstract is analysing ODR advantages and challenges in domain name disputes.
It discusses ODR's cost-effectiveness, accessibility, and expeditiousness as dispute resolution
facilitators. The abstract explores possible obstacles to enforcing ODR decisions, including
due process and provider competency. It also examines Indian ODR domain name dispute
case studies and identifies patterns that highlight the effectiveness of the Indian ODR
framework.
