Facts of the case

There was a dispute between Nabha Power Ltd. (Appellant) and Punjab State Power
Corporation (Respondent) pertaining to the deductions of the monthly tariff by the latter. The
proceedings initiated under the Electricity Act 2003 and consequently reached the Apex
Court.

The Apex Court allowed the appeal and thus directed the respondent to pay the amounts to
the Appellant. The respondent did not pay the required amount and consequently filed various
applications such as miscellaneous application, review application. An application was also
filed by the Appellant pertaining to the contempt and was allowed by the court.

The respondents further filed an application under the Electricity Act, 2003 for seeking the
accounts and other details from the Appellant. The appellant challenged the application by
stating that the issues were already adjudicated.

Judgement of the Supreme Court

The Apex Court observed that the application filed by the Respondent was an attempt to
avoid the obligations. The court further implied costs of Rs. 40 lakhs on the respondent for
raising the issue again which stood decided.
