STATEMENT OF CLAIM

1. Plaintiff is a self-employed and lives at Ofankor, whereas defendants are


siblings from the same parents and living in the same house the subject for
this suit.

2. Plaintiff says she gave Ghc40, 000.00 to the 1st defendant who is her brother
to deposit against a house she has negotiated to buy at Ofankor when she
was away from Accra.

3. Plaintiff avers that three weeks later after she has sent the Ghc40, 000.00 to
the 1st defendant for the initial deposit she came back to Accra and paid the
balance of Ghc23, 000.00 all in 2013.

4. Plaintiff contends that upon final payment of the property she handed over
the house to the defendants to live there on humanitarian grounds because
she was not in Accra.

5. Further to paragraph 4 supra, plaintiff says the house she bought needed
some renovation so she sent money through the 1st defendant bank account
to be used for the renovation work until the major work was done and
plaintiff later moved to the house and was there together with the 1st
defendant.
6. Plaintiff said further that in the course of her stay in the house at Ofankor
there was a misunderstanding between the 1st defendant and the plaintiff so
she left the house to Tamale in 2022 and upon returning back to the house
2nd & 3rd defendants have also relocated to the plaintiff house without her
consent.

7. Plaintiff says she became angry and told defendants to move out from her
house but they refused to go until plaintiff reported the matter for defendants
to be called to order. When the defendants were invited they pleaded for a
short period to prepare and move out from the plaintiff house but defendants
have jointly refused to do so.

8. Plaintiff further contends that she offered to rent an apartment to the 2nd &
3rd defendants for 2 years since 1st defendant has vacated the house to his
own place but they have all refused to accept the offer, meanwhile plaintiff
wants to move in with her family and he premises of the defendants in the
house will not allow her to bring in her family.

9. Plaintiff says the only avenue for the matter to be determined will be this
honourable court hence her decision to bring this instance matter for the
defendants to be evicted so she can take possession of her property and bring
her family to the house.

RELIEFS SOUGHT

i. An order for ejectment of the defendants from the house they are
occupying at Ofankor which is the property of the plaintiff

ii. Further order directed at the defendants to allow the plaintiff to


rent a separate accommodation for them
