Guzman v. Court of Appeals

|162 SCRA 88|
December 2, 1988

FACTS:
In this case, petitioner De Guzman disputed the Court of Appeals' decision to grant
possession of a property to private respondents via a preliminary mandatory injunction. De
Guzman appealed on grounds related to jurisdiction, the scope of the court's ruling, and the
use of equity in modifying the decision.

ISSUES:
Whether the Court of Appeals exceeded its authority by returning the property to private
respondents and making rulings beyond the scope of the injunction, while also considering
whether the application of equity in altering its prior decision was justified.

RULINGS:
The Court of Appeals appropriately exercised its authority by restoring possession to private
respondents based on evolving circumstances related to a preliminary injunction, limited its
ruling to the injunction's appropriateness, and justified its modification considering equity
and the fulfillment of the injunction's purpose, leaving room for the Regional Trial Court to
address permanent injunction matters.

CONCLUSION:
The petition by De Guzman was denied, and the Resolutions of the Court of Appeals dated
24 August 1995 and 30 January 1996 were affirmed. The Court upheld the authority of the
Court of Appeals to consider supervening circumstances and invoke equity in modifying its
earlier decision regarding the possession of the disputed property.
