NAIL ENAMEL COMPOSITIONS HAVING A
DECORATIVE COLOR EFFECT
BACKGROUND OF THE INVENTION
{0001} Nail enamel compositions include a class of nail
‘care products regularly used by women a part of their
beauty eare routine, These nal care products are available in
«8 mulitade of product formulations, from clears to infinite
‘colors. Typically, clear nail enamel compositions include a
film forming polymer film forming resin, a plasticizer and
‘one of more solvents. In the ease of a color nail enamel
‘composition, the product may also include a thixotropic
‘compound, suspending agent andl one or more pigments, or
in te alternative, an organic coloring polymer may be used.
Inaddition to these componenis, 2 number of optional and
proprietary components are ofen included sueh as UV light
absorbers, moisturizers, stabilizers, agrances and the lke
[0002] Nail enamel compositions have heretofore been
formulated to satisfy a number of highly desirable film
forming properties. For example, desirable properties often
inchude smoothness of application, rapid dy time, scratch
resistance, detergent and ol resistance, lustrous appearance,
‘wear and chip resistance and the lke. Often most important,
it has boon highly desimbe thatthe resulting nail enamel
film be smooth and uninterrupted by imperfections, for
‘example, orange peel effet, wrinkling, cracking, pitting,
bubbling and the like. To this end, nail enamel compositions
have included many different types of additives in order to
improve the aforementioned desirable properties of the
resulting film,
[0003] Despite the improved properties ofthe nail enamel
film, the aesthetic or decorative appearance differed very
litle. In particular, manufacturer offen times would pro-
duce nail enamel compositions having the same popular
‘colors as their competitors. This provided litle dstintion
berwoen nail enamel products of different manufacturers to
the ultimate consumer. Nail enamel compositions having a
more decorative appearance were prxtuced by including
smal pieces of light reflecting decorative material known as
pliters within the composition, From the foregoing, tan be
appreciated thatthe appearance of nal enamel compositions
has differed very File over the years. To this end, the present
invention provides a nail enamel composition which pro-
duces a film having a decorative effet heretofore unknown,
‘SUMMARY OF THE INVENTION
[0004] Accordingly, in one embodiment, there is
described a base coat nal enamel composition inching. at
least one dye ina suficient amount, such that when a clear,
tinted or pigmented top coat nail enamel composition is
formed thereon, the combined base and topcoat nal enamel
‘compositions will exhibit a decorative effect by virtue of
forming a different color than either the color ofthe base nail
‘enamel composition or the top coat nail enamel compos
(0005) In a prefered embodiment, the dye is add into
the base coat nal enamel composition as & dry dye.
[0006] | In another preferred embodiment, the base coat nail
‘enamel eompostion further comprises atleast one pigment.
[0007] In another embodiment, there is described a nail
‘enamel composition comprising any one of the aforemen-

tioned base nail enamel compositions and a clear or tinted
‘op coat nail enamel composition, in which the clear or
tinted top coat nail enamel composition is formed over the
base coat nai] enamel composition.
[0008] In yet another embodiment, there is described a
‘ail enamel kit for forming a decorative film over tural o
synthetic nails, the kit comprising any ofthe aforementioned
base coat nil enamel compositions, the base coat nail
enamel composition forming frst film having a fist color
‘over the natural or synthetic nails, and top coat nail enamel
composition, the top coat nail enamel composition forming
a second film having a socand color over the is film. The
combination ofthe fist and second films results in a thd
color that is different from both the fist and second colors,
[0009] In yet another embodiment, there is deseribed a
‘method of forming a decorative film over natural or sya-
thetic nals, the method comprising applying any one of the
aforementioned base coat nail enamel compositions over the
natural or syathetic nails to form a fist fila having a fist
color and then, applying atop coat nail enamel composition
‘over the base coat nail enamel composition ta form a second
{lm having a second color. The combination ofthe fist an
second fils results tied color that is different from both
the frst and second colors.
DETAILED DESCRIPTION
[0010] In describing the various embodiments of the
present invention, specific terminology’ will be resorted to
Tor the sake of clarity. However, the present invention is not
intended to be limited to the specific tems so selected, an
is to be understood that each specific term includes all
technical equivalence which operate in a similar manner to
eomplish a similar purpose.
{0011] The present invention broadly disloses hase coat
‘ail enamel compositions (hereinater "base coas") which,
when a clear, tinted or pigmented top coat nail enamel
composition (hereiafer “Yop cua”) is formed thereon, will
eshibita decorative elf by virtue of forming different or
tered color thn both the color ofthe base coat and the
cole ofthe top coat. By the tem “color,” it is meant to
encompass any tone or he In his regard, in dition to any
{nts and pigments, the tem “olor also includes clear nail
enamel compositions, coats and films. Ths, inthe present
invention, “lear” i also a color. By the term “lear” iis
reant that the nail enamel composition doesnot contain a
coloring agent or at most an incidental ameunt ofa colorng
agent. By the tem “int” itis meant hat the ail enamel
Composition contains a minor anouat of a coloring azet,
such thatthe coloring agent inypaats fight hue or shade to
the top coat ail enamel. By the tem “pigmented” itis
‘meant that the nail enamel composition contains more than
minor amount ofa colorant, such as pigment, to impart
a datker hue or shade. In al instanes, the nail enamel
composition may be ether filly or parally transparent
[0012] |The base coats of the present invention are applied
‘o natural or synthetic ails. Afterwards, a clear, tinted oF
pigmented top coat is applied over the base coats.
[0013] Nail enamel compositions can be formulated as
lear or color nail enamel composition. For base coat, they
‘may further be formulated to be suitable for coating natural
‘and syathetic nals. Typically, a clear nail enamel composi-US 2007/0231281 Al
tion contains one or more film forming components,
plasticizer and one or more solvents. Clear nail enamel
‘compositions may also include one or more thixotropic
‘compounds. Inthe ease ofa color nail enamel composition,
the composition will generally include a thixotropic com
Pound, @ suspending agent and one or more colorants, such
as pigments. In addition to these compounds, a number of
‘optionally and proprietary components may be included
such as UV light absorbers, moisturizers, stabilizers, fra-
‘arances and the lke. Typical nail enamel compositions are
disclosed in U.S. Pat. No. 5,977,217, entitled Quick Drying
Nail Enamel Composition, filed on Apr. 7, 1998 inthe name
‘of Socci, et al; US. Pat. No. 5,863,523, entitled Nail
Enamel Composition filed on Dec. 10, 1996 in the name of
Soosi, et al and US. Pat, No, 5,792,447, entitled Nail
Enamel Composition filed on Nov. 1, 1996 in the name of
‘occ, et a, which patents reassigned tothe same assignee
fof the present application, the disclosures of which are
incomporated herein by reference.
[0014] Additionally, dyes have boc used as colorants for
rail enamel compositions. Dyes have long been cline
guished from pigments. In particular, dyes are known as
‘chemical compounds which exhibit thee coloring power or
tinctoril strength when dissolved ina solvent, On the other
hand, pigments ar insoluble colored materials which color
by dispersion. Fr example, while dyes are generally soluble
in solvents, such as water, propylene, glycol, glycerine,
‘esters, alobols and hydrocarbons, pigments and derivatives,
‘of pigments (such as lakes) are generally insoluble ia most
solvents
[0015] In the present invention, one or more dyes are
ddd tothe base coat in an amount sufficient to enable a
decorative elfect when a clear, tinted or pigmented top coat
is applied onto or formed on the base coat. The decorative
effect may be in the form of a different or altered color for
the final ail enamel composition (ie. a hase coat with atop
‘oat formed thereon or film than both the color ofthe Base
‘oat and the color ofthe tp coat. Some characteristics ofthe
color change or effect include, either singly or in some
combination, a different hue, 2 different brighmess, an
increased intensity and higher saturation in color. The inten-
sity and type of the color change or ellect may vary
depending upon various factors, including, but not limited
'o, the aniouat of dye used, the amounts and types of the
‘other ingredients inthe base and top coats, axl whether the
‘op coat is clea, ited or pigmeated. Although not bound by
this theory, itis believed the color effector change is at least
partly artbutable to the extra dye present in the hase coat
With a higher amouat of concentration of dye added to the
base coat, afer the solvent top coat is formed on the base
oat, the solvent in the top coat solubilizes or further
solubilizes the extra dye in the base coat, which results in the
‘colar effector change.
0016} The hase coats according to the present invention
contain one or more dyes, Any dye may be used as long as
they are soluble in any solvent included in the base and top
‘nts The dyes foruse inthe present invention may include
any of those dyes which ae generally known for sein ail
‘enamel compositions. These dyes may be organic or inor-
ganic. Such dyes may include dyes that are crite by the
Division of Color Technology ofthe United Sats Food and
Drug Adminisiration FDA). Drug & Cosmetic (D&C) dyes
are one category of dyes that are cerified by the FDA.

limited to about 0.1% or less by weight of the top coat
0021] When pigments are inchuded in compositions
socording to the present invention, iis useful to include a
suspending agent for enbancing the suspeasion ofthe pig-
rents in the othor components of the nil enamel compo-
sition, Although a aumber of suspending agents which are
generally used ia conventional nail enamel compositions
may be used to produce compositions according 10 the
present invention, prefered suspending agents include col-
Toidal clays, montmorillonite clays, especially stearalko-
nium hectorite, steralkonium bentonite, fumed silica, and
mixtures thereof. The suspending agent is present in the
‘compositions of the present invention ia amounts sullicieat,
to produce a gol, preferably a colloidal gel. In general, the
suspending agent is included in the amount ranging fi
about 0.54% to about 3% by weight of the composition,
[0022] In addition to the above described components, the
nail enamel compositions of the present invention may'also
include additional additives including stabilizers, thixotro-
pie agents, UV light absorbers such a ectoceylene and
benzophenone-I, Iragrances, moisturizers and medians,
depending on the intended result, These components are
‘well known inthe art and may be included in amounts well,

amount and types of colorants (ex, dyes, pigments, solu-
bilized dyes, lakes, ete.) included in the base coat, the
applied base ml enamel compesition will exhibit a cerain
colar. Afterwards, a top coat is applied over the base nail
‘enamel composition. It is contemplated thatthe top eat ean
be applied o also protect the base cot, The top coat may be
citer clear, tinted or pigmented, if so deste. To this end,
there is known from the nail enamel art, as well as the
‘examples disclosed herein, protective clear or tinted top
‘coats which will form a protective continuous fil.
Oct. 4, 2007
[0040] The application of the top coat may take place
immediately after application of the base cout over the
natural or syahetic nail. In other won, the top coat ean be
applied while the base coat is still “wet” Altematively, the
base coat may’ be fully dry prior to application of the top
coat, The base coat may even be allowed to partially dry, for
example, 10 a condition known as “dry to touch.” This
condition arises when the surface of the resulting film may
be touched with ones finger without leaving an impression
of one's fingerprints. However, the film has yet to become
completely dry. The time period to achieve a dry to touch
will depend upon the particular base coat being used, the
thickness of the coat applied, and temperature and huiity
conditions. In short, the tp coat may be applied at any time
lier the application of the base coat, However, preferably,
the application ofthe tap coat takes place wen the base cot
is “dry to touch.”
[0041] The top coat is preferably applied aver the base
‘oat as a single coat, However, atiple coats may also be
applied if so desired. Upon application of the top coat, the
‘nai enamel composition of the combined base and topcoats,
hile wet, when dry to touch and after fully dry, will exhibit
1 color change, in that the reslking color is differeat from
both the color ofthe applied base coat and the color of the
applied top oat. As deseribed above, some characteristics of
this color change or effect may include, either singly or in
some combination different hve, a different brightness, an
increased intensity and higher saturation in color.
