MAIN CONDITIONS OF AIR TRANSPORTATION AGREEMENT

1. As used in this agreement “ticket” means this passenger ticket and baggage check of which these conditions and the notices form part, “carriage” is equivalent to
“transportation”, “carrier” means air carrier that carries the passenger and his baggage; "Charterer" - a customer who freights an aircraft from a carrier for charter
flights; “charter agreement” means valid aircraft freight agreement between carrier and customer, “carrier’s rules” mean current rules for air transportation of
passenger and baggage established by carrier, “The Montreal Convention” means the Convention for the Unification of certain rules for international carriage by air
signed at Montreal, on the 28th May 1999.
2. Carriage of passengers and baggage, which is performed in accordance with this contract, must be carried out according to conditions of charter agreement, rules of
carrier, regulations relating to liability, established by the Montreal Convention, Rules of air transportation of passengers and baggage, approved by the Order of the
State Aviation Administration of Ukraine №1239 on 26/11/2018,registered in the Ministry of Justice of Ukraine on 08/02/2019 №141/33112 (further in text SAAU
rules).
3. The Carrier undertakes to take all measures necessary to transport the passenger and luggage within a reasonable time. Time shown in timetables or elsewhere, except
tickets, is not guaranteed and is not part of this contract. The carrier may substitute aircraft without notice and may change or cancel landing in the points shown on
the ticket in case of necessity. The carrier has the right to change the time of departure, which shall be promptly informed to the Charterer. In the event of force
majeure the schedule is subject to change without notice. It is the Charterer’s responsibility to notify passengers of schedule change of charter flights.
4. Charterer is liable to inform the passenger of the current carrier's and respective Government Authorities' rules and ensures the observance of these by passengers.
5. The carrier has limited liability for any loss or damage of baggage in an amount established by the Montreal Convention and is not more than 1288 Special Drawing
Rights (SDR) for each passenger.
6. The carrier cannot exclude or restrict his liability for damage that caused death or body injury of the passenger, with a compensation not exceeding 128 821 SDR for
each passenger. The carrier's liability for damage caused by delay in the carriage of passengers on any flight is limited to SDR 5346 for each passenger.
7. Carrier may refuse in carriage:
- For reasons of safety and in the event of a threat to the health of other passengers;
- In order to comply with the laws, rules, regulations and instructions of any authority of the country to or from the transportation is carried out;
- If the passenger refuses to comply with the rules, regulations and instructions of the Carrier;
- Passenger in the state of alcoholic or narcotic intoxication;
- Passenger whose actions violate common rules of air transportation etc.
8. For health and safety reasons smoking on board and the consumption of alcoholic beverages are not permitted unless they have been offered for the service of
passengers.
9. The passenger must arrive for check-in no later than 2 hours 30 minutes before the departure of the aircraft. Check-in closes 45 minutes prior to designated departure
time. Verification of documents, including visas, passenger tickets, etc. is carried out at the airport during the check-in.
10. Please note that boarding is finished 20 minutes before departure.
11. The carriage of sharp objects (knives, scissors, etc.) is prohibited in the cabin. It is also forbidden to carry any liquids, suspensions, creams, pastes in capacity more than
100 ml in one vial (tube) in your hand luggage. Total volume of all containers with those substances in hand baggage shall not exceed 1 liter per passenger. For safety
reasons, dangerous articles such as mentioned below, must not be carried in passenger’s baggage: compressed gases, corrosives, explosives, flammable solids,
radioactive materials, oxidizing materials, poisons, infectious substances, other dangerous articles or substances and briefcases with built-in alarm devices.
12. In case of denial of transportation, cancellation or delay of the flight, the rights of passengers are determined by section XIII of the Air Codes of Ukraine and section XV
of the SAAU rules.
13. A carrier may refuse to carry luggage:
- belongings (suitcases) which, by weight or size or by their nature, may cause discomfort to other passengers and may pose a safety hazard;
- things the transportation of which is prohibited by laws, rules and regulations of the state authorities of any country to or from the territory or through the territory
of which the transportation is carried out.
14. The free baggage allowance (per piece of baggage) on the Carrier's flights is up to 23 kg, with the size of each piece in the sum of three measurements not more than
158 cm, not including hand luggage up to 9 kg. The free baggage allowance does not apply if the passenger has purchased a ticket at a fare which does not provide the
carriage of checked baggage. In this case, the Carrier has the right to set a surcharge for the carriage of checked baggage without the consent of the passenger, as well
as to change the amount of such surcharge. For children under 2 years of age, who are transported without a separate seat, the free baggage allowance is 10kg, the
size of which does not exceed 115 cm in the sum of three dimensions. For older children, the rules apply same as for adults. Please note the maximum weight of
checked baggage cannot exceed 32 kg. Baggage that does not meet the specified requirements must be transported as cargo. Excess baggage, oversized baggage and
baggage weighing more than 23 kg (in one place) is accepted for carriage only with the consent of the Carrier and if there is a capacity available on the aircraft for
transportation, as well as subject to payment by the passenger for such baggage.
15. The checked baggage is handed over to the bearer of the baggage tag. In case of improper baggage transportation, a relevant act is drawn up, on the basis of which a
claim to the Carrier is submitted in writing. In case of improper transportation of checked baggage, the passenger must send to the Carrier a claim immediately after
the damage (loss of part of the baggage) is discovered and not later than within seven calendar days from the date of receipt of checked baggage. In case of delay in
baggage transportation, the claim must be submitted not later than within 21 calendar days from the date when the luggage was handed over to the passenger.
Requests for the loss of luggage shall be brought to the Carrier after the baggage is recognized as lost. Baggage is lost if it is not found by the results of the search
within 21 calendar days from the date following the day on which the luggage was to arrive at its destination. In such a case, the claim to the carrier must be made
within 2 years for international flights and 3 years for domestic flights from the date of arrival of the aircraft to its destination, or from the date when the aircraft was
due to arrive at its destination. Applications are considered in the order established by the Carrier. The carrier is required to consider the claim and notify the applicant
of its satisfaction or rejection within 3 months from the date of its receipt if the carriage was fully carried out by one carrier. If other carriers were involved in
transportation, the period for reviewing the claim may be extended to 6 months.
16. Please note that transportation and other services provided by the Carrier are governed by the Air Transportation Agreement and the Rules of air transportation and
service of passengers and baggage, which you can find on https://skyup.aero/en/rules.
