DRYDOCK SPECIFICATION Page: 1Vwinoimsen Ship Management DRYDOCK SPECIFICATION Page AS FELICIA - 2021-3RD SPECIAL SURVEY Invitation to Tender 1.1 Delivery, Berthing and Dues The vessel shall be deemed delivered to the Contra: the port of repair, or nearest safe place as nominated by the Contractor. All general service charges during the yard period including but not limited to berthing and unberthing, docking and undocking, shifting, tovage, mooring and unmooring, fire and security watches, shore power connection and supply, fire hose connection and pressurizing cooling water supply for the refrigeration machinery, supply of domestic fresh water and sanitary water, daily removal of garbage, temporary shifting of bunkers, lub oils and / or slops and shifting back on completion of the work, dry and wet dock dues incurred, and cranage and expenses which may be necessary after delivery of the vessel tors until redelivery to the Owners on completion of repairs must be borne by the Contractors and included in the tendered price. This price will be the final price including all expenses for the period required to carry out all specified repairs. = upon arrival at 1.2 Costs The costs quoted by the Contractor, including quotations for additional and/or extra work, outlined in the specifications and whether or not stated therein include all costs for labour, tools, services, material, equipment, removals, replacements, machining, temporary light, staging, shoring, aids for erection and assembly of any kind, ventilation, removal of item to shop, if necessary, access work, cranage, transport to and from workshop, re-installation, cleaning-up after completion of work, proving tight on test, external blasting of new plating, two coats of approved primer to all new and disturbed work, ramming-out and re-installing keel blocks and any other work or appliances necessary to accomplish the repairs, removing / replacing floor plates and cleaning, and any other work or appliances necessary to accomplish the repairs, Also costs concerning removal, landing ashore, supply and transport of pumping equipment and appliances, connecting up and disconnecting, storage drums, containers and/or lorries, transport, cranage and disposal of all scale, sludge, mud, debris, oil, water etc. shall be itemised and included in che final price. The final price agreed with the Yard shall be gross, thus inclusive of taxes and duties or charges levied by any Governmental body, or authority, including V.A.T. 1.3 Extras Whenever it becomes necessary for the Owners’ Superintendent to call upon the Contractor to carry out work in addition to that specified, or that the Contractor realizes extra work to the guoted items is necessary, the Contractor should, at all urnish the Owners’ Superintendent immediately, but at maximum within 24 hours after receiving the extra work order, in writing with a realistic quotation for each item specified, prior tO the work being put in hand. Such work must be specifically ordered and the quoted price agreed before the said work is assigned. Additional work, ordered during the course of the repairs and not previously Covered in the original specification shall not be at a higher price than the price level of the quoted works and in the event chat the quantity of the work is extensive a new unit price shall be negotiated downwards accordingly. Any deviation from these rates will not be acceptable Owners. Printe 1.4 Progress of Work The repairs etc. to the vessel shall be commenced without delay, and shall be continued diligently and at such a rate of expedition as in the opinion of the Owners’ Superintendent will be necessary © complete the work within the time stated in the Tender. The Yard must issue a diagrammatic schedule of all major works. It is a condition of this Agreement that the Yard redelivers the vessel to the Owners by the agreed delivery date, such date being regarded as the essence of the contract. If, due to pressure of work, labour shortage, late supply of materials, or through other similar causes, delay to the vessel is caused, it shall be incumbent on the Contractors to use every possible means at their disposal to minimise delay by working overtime, double shifts etc. with no extra expense to the Owner. Should such action cause delay then Clause 1.19 will apply. The quotation for tender, as set out under the individual headings, and the time required for repairing and redelivery of the vessel, are to be stated on the basis of consecutive running days. If Saturdays and Sundays are not nozmally worked and there are any national holidays intervening the period then this is to be mentioned in the ndez. No surcharges for work effected on such days will be accepted by che Owner Each day, at a mutually agreed fixed time, the Owners’ Superintendent requires 2 meeting on board said vessel with the Yard's repair manager and appropriate Yard foreman, in order to discuss the progress, problems, future planning etc. of the repairs. Also additional/extra répaire will be ordered and discussed at this meeting. All work must be co-ordinated in such a way that one job does not unduly delay another, such as external work near the propelle: preventing required rotation of main engine, or sand blasting of stern area preventing withdrawal of tailshaft. 1.5 Work carried out by crew The own serve the right to perform normal overhaul on deck and in the engine room by using their own crew whilst the vessel is on the Contractor's premises and / or utilising a riding squad. 1.6 Subcontractors The Owners reserve the right to engage subcontractors to perform work, furnish services and/or material not covered by the Specification. The Contractor shall permit employees of such Subcontractor to have access to the shipyard and the vessel for such purposes. Safety Test ctors must satisfy themselves that the vessel is roughly cleaned and free from all inflammable vapour, and must obtain 2 fully qualified Analyst's Certificate, certifying this, before commencing works in any compartment where any hazardous or noxious substance has been contained. 1.8 Cleaning All compartments have to be cleaned out as required before, duzing and after repairs, and finally left clean and dry. Any engine room floor-plates lifted for access to bilges or other work is to be replaced on completion. During the course of repairs all dirt and refuse have to be landed on shore and disposed of by the Contrac’ The vessel shall be left in good condition throughout. Cleaning ch: will be applied to the individual spaces as listed later. 1.9 Firewatching ize precautions by Contractors’ labourers are to be as follows: Imen are to be provided by Contractors to attend continuously constant patrolling of all spaces for fire hazard daily from commencement until two hours following completion of work (including of sub-contractors employed by Owners’ direct order). At that time the vessel has to be thoroughly inspected together with the ship's Duty Officer to the effect that all is in order and that Fire Fighting Equipment is available for the ship's Duty Officer during the nigh 1.10 Workmanship and Material All workmanship and materials to comply with first class international shipbuilding and marine engineering practice, in compliance with Classification Society's rules as well as to the satisfaction of Owners’ Superintendents. For all items which require Class approval and are under the control of the Yard, the Yard is responsible for arranging the attendance of the Classification Surveyor, or any other society surveyor to effect the necessary surveys in due time. The Yard shall for a period of 6 months after redelivery of the vessel to the shipowner guarantee against any defects in the repair effected due to defects in the materials delivered and / or in the work effected by the Yard, its employees , agents and / or subcontractors. 1.11 Electric Light and Power Electric wires, lamps etc. to be fitted up on board for work inside and outside the vessel, also for lighting accommodation and oth power requizements as necessary. On completion all gear has to be disconnected and removed ashore. Present power supply on board per vessel's particulars as attached. 1.12 Material The Contractor must guarantee that he has the necessary new material and/or parte in stock oz can obtain same without delay, as no extension of time will be allowed in this respect and any delay so caused will fall within the scope of Clause 1.19. All old material shall become the Contractors’ property, excluding heavy machinery pa 1,13 Strikes or Lock-outs The Contzactor shall not be liable for any delay in delivery caused by strikes or lock-outs and/or any delay in delivery by a cause which after all efforts by the Yard, could not have been prevented. In such a case where delay in delivery is foreseeable the Yard is to notify © Owners immediately such delay is inevitable in order that the Owner can take whatever action is available including but not limited co the safeguard of any contractual commitments. In such an instance the Ouners have the option to rescind the agreement in as far as not yt executed and without prejudice to all rights accrued between the parties prior to the date of termination. 1.14 Insurance The Owner shall maintain adequate hull and machinery and crew risk insurance during the period the vessel is in the Yard and whilst y, equipment and / or gear remains on board. It is assumed that the charge under this heading is absorbed by normal overheads. 1.15 Price Correction All the work noted in the attached Specification must be carried out in its entirety and no deviation whatsoever will be allowed, unless mutually agreed. The Owners reserve the right to correct errors or omissions or make deductions from, oz additions to the Specification. However, in such event, the increas¢d or decreased cost, if any, and the time of completion herein specified shall be adjusted accordingly. Acceptance of the tender shall in no way amount to acceptance of any terms and conditions save those contained herein in this Agreement, 1.16 Opening of Tender - (included in Declaration Form Annex A) 1.17 Payment Terms - (included in Declaration Form attached Annex A) 1.18 Yard Representatives In the event that the Yard is represented by an agent, the Owner reserves the right to deal direct with the Yard on all matters associated with this Agreement and expressly states that any dealings associated with the tender negotiations shall be dealt with direct with e Yard and not with the Yard's Representative. The Yard is to remain strictly liable for the actions of the Representative at all times. 1.19 Dispute This contract is governed by English law and all disputes arising under or in connection with it shall be referred to arbitration in London.
