DRBEOs/ Executive Engineers are informed that based on the directions of Hon'ble Supreme Court Committee on Road Safety (SCCoRS), Government has approved a new Road Safety Clause to be incorporated in R&B Standard bid documents in respect of works pertaining to State Highways, Major District Roads and Other roads of R&B Department, imposing penalty for non-compliance of Road Safety Norms. Hence, all the Superintending Engineers’ DRBEOs/ Executive Engineers of (R&B) Department is hereby instructed to incorporate the above new Clause under ‘Safety’ Clause in General Conditions of contract of R&B Standard bid documents in respect of works pertaining to State Highways, Major District Roads and Other roads of R&B Department, imposing penalty for non-compliance of Road Safety Norms, and also to ensure safety. ORDE! 1) Inthe read above the Chief Engineer (R&B) SH & MD, APRDC, AP has reported that as per directions of the Hon'ble Supreme Court Committee on Road Safety, R&B Department shall incorporate penal provisions in contracts or concession agreements where the contractors/concessionaires failed to comply ‘with the prescribed road safety norms . ” 2) In compliance of the above, the Chief Engineer (R&B) SH & MD, APRDC, ‘AP has prepared a new Clause for imposing the penalty in case of failure of the Contractor to comply with the prescribed road safety norms was proposed to be incorporated in R&B Standard bid document and placed before the Committee of Chief Engineers. The Committee has approved the same. Therefore, the Chief Engineer (R&B) SH & MD, APRDC, AP has requested to accord permission to incorporate the new clause in R&B Standard bid documents in respect of works pertaining to SHs, MDRs & Other Roads, imposing penalty for non-compliance of road safely norms, 3) Government after careful examination of the proposal, hereby approved the following new clause to incorporate in R&B Standard bid documents in respect of works pertaining to SHs, MDRs & Other Roads, imposing penalty for non- compliance of road safety norms: 1, Safety: 1.1. The Contractor shall be fully responsible for the adequate safety of all activities on the Site. The Contractor shall prepare and follow a Traffic Management Plan (includes Safety Plan) approved by the Engineer in Charge as per the Clause 112 of MoRTH Specifications for Road and Bridge Works. 1.2. The Contractor shall take all necessary measures for the safety of traffic during construction and provide, erect and maintain such barricades, including signs, marking, flags, lights and flagmen as may be required for the information and protection of traffic approaching or passing through the section of the road under improvement as per the MoRTH Specification and IRC: SP: 55 guidelines and other relevant latest IRC Codes. ‘The provision of traffic safety measures|shall be considered incidental to the work. 1.3. Failure to carry out the clauses mentioned in 1.1 & 1.2 above and prescr road safety norms, contractor shall be liable to be imposed with penalty of ~- per day, per location as decided by the engineer in charge depending pon the importance of item and size of the project, for the first week. The penalty should not be less than Rs.20,000/- per day per location. Beyond first week the abdve road safety activity shall be entrusted to the third party on nomination basis andthe cost shall be deducted from the contractor's bills and appropriate action shall Ie taken oon the contractor 4) The Chief Engineer(R&B) SH & MD, APRDC, Engineer-in-Chief (R|&B) MDR, AP shall take further necessary action in the matter.
