A San Francisco Superior Court judge on Tuesday dismissed nearly half of the misdemeanor charges prosecutors filed against
Bill Gene Hobbs,
Hobbs, who has been accused of stalking and harassing multiple women in the city.
Prosecutors were permitted to continue pressing a felony charge and 12 other misdemeanors following the judge’s ruling.
Judge Stephen Murphy dismissed seven public nuisance counts and two misdemeanor charges for assault, citing that the
prosecution, led by Deputy District Attorney Colin Alexander, did not provide sufficient evidence.

“I’m pleased,” said Deputy Public Defender Max Breecker, who is representing Hobbs. “I think the judge did a very careful and
thorough job reviewing all the evidence. I look forward to trial.”
In a statement to The Chronicle, San Francisco District Attorney Brooke Jenkins said that her office respects the court’s
decision to dismiss the public nuisance charges and will begin preparing a “vigorous prosecution” on the remaining charges.

The preliminary hearing ruling wrapped up nearly two weeks after Hobbs first appeared in court. The 34-year-old was facing
more than 20 misdemeanor public nuisance, sexual battery and assault charges, as well as one felony count of false
imprisonment for an incident where he allegedly bear-hugged a woman on a San Francisco street and carried her for 15 feet
while she screamed at him to let her go.

The remaining charges Hobbs faces stem from allegations made by numerous women who said he grabbed, chased, leered or
attempted to kiss them, among other claims.
“The defendant argues that none of the victims reported injuries, but all of the victims reported emotional trauma from the
defendant’s conduct,” said Murphy.

The court heard impassioned arguments from Alexander and Breecker on why Hobbs should or shouldn’t stay in custody until
then.
Breecker first asked the court to consider releasing Hobbs to his mother in Bakersfield, or to be released on bail.
“I get the perception, the publicity, the attention that Mr. Hobbs has gotten locally and I am cognizant of that,” said Breecker
while he proposed Hobbs be released to his mother.
Prosecutors argued that Hobbs posed a public safety risk not just to San Francisco residents but also to “the citizens of
Bakersfield” if he was released — given how “serious” the misdemeanors were.
Alexander also highlighted Hobbs’ previous run-ins with the law. In late 2020, he was charged with misdemeanor child
molestation and battery and spent several months in jail before Superior Court Judge Russell Roeca dismissed the case “in the
interest of justice.”
Dating back to 2017, multiple judges had also dismissed other charges against Hobbs including false imprisonment, battery and
trespassing.
“I think it’s a ‘fool-me-once’ scenario, your honor,” said Alexander. “This court now has the value of hindsight. If he is released,
there is nothing that is stopping him.”
Murphy ordered Hobbs to stay detained until his next court date.
“Today’s ruling, granting the detention motion to keep Hobbs in custody pending trial, should help the women of San
Francisco and Bakersfield rest easier knowing that he will be off the streets,” Jenkins said in her statement.

man other women said had assaulted them too. A San Francisco Superior Court judge dismissed all charges, including

She was right. It’s blown up — big time. And Zerega’s family is livid that a criminal justice system big on second chances
appears to be doling out 10th, 11th and 12th chances, too.
This week, numerous young women around San Francisco have shared descriptions on social media of the same distinctive-
looking man — tall, white, short-haired, covered in tattoos — following, grabbing and, in one case, forcibly kissing them as they
walked alone.
Some people have shared photos, and those photos appear to portray Bill Gene Hobbs,
Hobbs, the man arrested in the Zerega case. He’s
roughly 33, stands 6 feet 4, has the letters E-V-I-L inked on his fingers, and has a long record of arrests across California.

Reached Thursday on his cell phone, as police investigated the women’s stalking reports, Hobbs admitted to me that he has
been following women he finds attractive.
“I was just meeting people. That’s all. That’s it. That’s illegal?” he said. “If you’re walking down the street and I see you and I
think that I know you or I find you attractive and I run up to you and I say, ‘Hello,’ is that a crime?”
Hobbs had not been arrested as of Thursday afternoon, and The Chronicle could not verify he was involved in each of the
complaints on social media.
But the saga encapsulates so much of what’s been angering San Franciscans about the state of their city and its criminal justice
system: a seemingly slow police response, an apparent failure by the courts to provide meaningful intervention to people who
clearly need it, and a sense that people simply must live with the clear perils around them.
It’s telling that young women with Nextdoor accounts are crowdsourcing a case against their alleged perpetrator, comparing
notes about what happened in their encounters and encouraging each other to file police reports. On Thursday evening, the
women were due to meet at one of their homes to brainstorm how they can get Hobbs off the street and to form a quasi-support
group.

“What will it take for them to take action to stop this man?” asked Zerega’s husband, Blaise. “He’s dangerous.”
Hobbs came to the public’s attention last year in this column, when the Zeregas shared their story. Hobbs had been charged
with misdemeanor counts of child molestation and battery for allegedly stalking and grabbing the girl, but San Francisco
Superior Court Judge Russell Roeca had dismissed the case, wiping clear a court order that required Hobbs to stay away from
the teenager and releasing him from jail.
After serving time in Ventura County, where he faced a warrant alleging auto theft, Hobbs returned to San Francisco.
The Police Department said Thursday that it had received three recent reports of “a male committing suspicious acts toward
females” and was working to develop probable cause to make an arrest. The department declined to identify the man under
investigation.
The police force is also working with the city’s Crisis Intervention Team on a course of action, said Officer Kathryn Winters, a
department spokesperson. That suggests the possibility of mental health or substance use issues.
Meanwhile, young women have shared reports via Facebook and Nextdoor, saying a man harassed them as they walked alone in
the Marina, near Lone Mountain, in Alamo Square and in other nearby neighborhoods.
One woman shared on social media that she had persuaded Hobbs to leave her alone by asking for his phone number and
saying she’d call him later. She posted that number, and I called it. After identifying myself as a Chronicle journalist, I asked if
the person who answered was Bill Gene Hobbs. He said it was.
He denied that he had kissed or grabbed strangers and likened his behavior to that of a hero in a romantic movie like “Love
Actually” who pursues the girl of his dreams. He didn’t answer questions about whether he’d been contacted by police, where
he lives and whether he has a job.
He said I was the one stalking him — and that he didn’t give me permission to write about him.
What remains clear is that despite his many brushes with the law, he’s not received the intervention — and help — he so clearly
needs, including from San Francisco’s broken criminal justice system.
It was Dec. 8, 2020, when Hobbs allegedly approached Zerega’s daughter in West Portal, touched them, called them his “angel”
and “perfect mate” and told them to come with him.
The teen darted into a nearby store, but when they came back outside, he was waiting for them, grabbed them and wouldn’t let
go, according to the girl. He repeatedly told them to come with him and followed them into another store before a clerk

Back then, after the Zerega family posted its story and a photo of Hobbs on Nextdoor, other women came forward.
The same man, one said, approached her while walking her dog in Glen Canyon, stripped naked and ran after her. Another
woman said she was eating lunch in her parked car when Hobbs tried getting inside it and then stared at her.
City authorities were familiar with Hobbs. The Los Angeles native had been the subject of six previous criminal cases in San
Francisco since 2017, charged with crimes including trespassing, false imprisonment, battery and giving false information to
police. But Superior Court judges had dismissed each one, citing the “interest of justice.”
In the West Portal incident, police arrested him, and the District Attorney’s Office charged him with misdemeanor counts of
child molestation and battering Zerega’s daughter.
A judge at first denied him pretrial release and declared him incompetent to stand trial.
He was incarcerated for several months, reaching the maximum sentence he could have served if convicted of the
misdemeanors he was charged with. And so another judge — Roeca, who was appointed by Gov. Gavin Newsom in 2020 —
dismissed the case, also “in the interest of justice.”
Roeca could have released Hobbs but kept the case pending, allowing the teenager’s stay-away order to remain in place. The
judge could have required that Hobbs plead no contest, meaning the charges could stay on his record. But none of that
happened, and it appears Hobbs received no treatment.
I asked Ken Garcia, a spokesperson for the Superior Court, about Hobbs’ return to San Francisco and whether Roeca had any
comment. He didn’t reply.
So here we are again, dealing with the fallout of our system’s failures.
Among the women now coming forward is Alexandra Anderson, 30, who said she was walking to pick up her kids from school
in the Lone Mountain area on Sept. 16 when a man she believes was Hobbs followed her for a mile, saying, “I think we just fell in
love” and “I think we’re soulmates.”
She told him to go away, and he refused, she said, before finally peeling off after about 20 minutes.
“It was really scary and unnerving,” she said. “I was shaking.”
She filed a police report, but said she hadn’t heard back from officers by Wednesday afternoon. She discussed the matter with
other women via social media and said, “It seems like we’re doing a lot more work than the police.”
A woman named Taylor, 25, who like several other women asked that her last name be withheld to protect her safety, said a man
she thinks was Hobbs followed her near Divisadero and Turk streets on Sept. 16 and jabbed her with a stick. She filed a police
report, as well, and bought pepper spray.

Sara, 25, said she encountered a man she believes was Hobbs on Sept. 19. She was waiting for the walk signal at Chestnut and
Fillmore streets at 9 a.m. when she felt someone grab her from behind. She struggled to get away from the man, but he followed
her.
“I just broke into a full-blown sprint for three blocks to lose him,” she said. “I honestly just couldn’t believe it was happening.”
Madeline, 32, said she was in an outdoor dance class in the Panhandle on Sept. 10 when “a tatted, big, big guy” stared at her
intensely and made a beeline straight at her, disrupting the class. He stopped three feet from her, stared at her some more and
finally left.
“All of the people around me were like, ‘What the heck was that? Do you know that guy? Are you OK?’” she recalled. “I had chills
all over my body.”
Amanda, 26, said she believes she encountered Hobbs several months ago at a dog park. He stared at her intensely and, when
she left, followed her. She was nervous and returned to the dog park, forming a circle with her neighbors in hopes he’d leave.
He approached the group, joined the circle and continued to stare at her. He had “dead eyes,” she said, and she noticed the E-V-
I-L tattoo on his fingers. She called her boyfriend, who dashed over, prompting Hobbs to leave. Two days later, she saw police
officers near the park and told them about the incident. They told her there was nothing they could do, she said.
She kept her curtains closed for two weeks after that and won’t leave her apartment without pepper spray. She spends more
time at her parents’ house in Southern California.
“It made me want to leave San Francisco,” she said. “After that, the bubble burst.”
A 35-year-old woman who asked to go by her middle name, Rose, said she encountered a man she thinks was Hobbs two
months ago when she was walking her dog in the Lone Mountain neighborhood. She said Hobbs stared at her and followed her
as she repeatedly crossed the street in a bid to lose him. He caught up to her and lunged at her dog, she said, before she flagged
down another walker for help and Hobbs left.
On Sept. 19, she saw the same man in the same area. He followed her again, she said, and she approached a mail carrier for help.
She’s been a ringleader for the group trying to get Hobbs off the streets. Other women, she said, told her he’d stalked and
grabbed them and, in one instance, forcibly kissed one of them.
She also made a police report, and said many others have too. It’s unclear why the Police Department says it only has three
reports.
“We have this huge group going,” she said. “There’s a new woman every other day who’s like, ‘Oh my God, that guy did it to me!’
We’re getting very frustrated. We want this guy off the streets.”

On the streets of San Francisco, Bill Gene Hobbs had all the power.
An intimidating figure who stood 6 feet 4, weighed more than 200 pounds and had “EVIL” tattooed on his fingers, he repeatedly
followed, grabbed, groped and chased women, sometimes even forcibly kissing them. Once, he picked up a victim and carried
her down a block. Many women in the city came to know him by sight and fear him for his leering grin and dead eyes.

In Department 19 of San Francisco Superior Court, the power was seized by the women he’d attacked — and Hobbs couldn’t
stand it. Sitting next to Assistant District Attorney Brittney Delgado, who prosecuted their cases, Karina S. and Olivia J. read
damning, eloquent statements detailing the trauma that Hobbs, 34, had inflicted upon them, while demanding he receive a fair
sentence.
“I am one of many, but today I put a stop to many more,” Olivia J. said calmly and pointedly, noting Hobbs would surely attack
other women if released.
After a string of judges failed to take Hobbs’ crimes seriously over several years, Judge Harry Dorfman seemed to see him for
what he is: a pathetic, disturbed man who on Thursday repeatedly screamed at and mocked his victims on his day of judgment.
After banishing a ranting and raving Hobbs to a holding cell, unable to hear his own sentence, Dorfman ordered him to serve
2½ years in county jail for eight misdemeanor crimes including battery, sexual battery and assault, minus credit for time served
since his arrest in October.
October. Then, Hobbs will be moved to state prison for a three-year sentence for felony false imprisonment
related to picking up and carrying a woman down the street as she walked her dog.

He must also register as a sex offender and pay fines and fees totaling $2,930.
Dorfman and a jury that found Hobbs guilty last month on nine counts finally sent the message the women of San Francisco
should have heard a long time ago: You should feel safe walking the city’s streets and running in its parks, by yourself or with
others, in daylight or at night. And anybody who breaks the law and violates your ability to live free of abuse and fear will face
consequences.
“I feel like the judge did a good job,” Karina S. told me after the sentencing hearing. “He was sensitive to what we’ve been going
through.”
During a trial last month, more than a dozen women testified they’d had frightening encounters with Hobbs. Some of them had
shared their stories with me in a series of columns last year asking why the city’s criminal justice system wasn’t taking action.
Finally, as the chorus of outraged women grew louder — and as Hobbs continued to grope, grab and harass strangers — San
Francisco police arrested him. District Attorney Brooke Jenkins bundled the cases together to present one large case the
criminal justice system could no longer ignore.
Jenkins and Delgado asked Dorfman to sentence Hobbs to the maximum term of seven years, but said they were pleased with
the outcome, particularly in a city sometimes known for lenient judges.
“It’s something we combat every day when we walk into the Hall of Justice,” Jenkins told me in an interview after the
sentencing. “We attempt to explain to judges, from our perspective, why certain people present a public safety risk, and the
judges oftentimes do not take those arguments as seriously as we believe they should.
“It does take repeated victimization of our residents and visitors before we get to this point where they see this pattern and do
decide to take it seriously,” Jenkins continued. “We are pleased that the judge saw the seriousness of this conduct.”

Hobbs had six criminal cases against him in San Francisco dating back to 2017, each one dismissed by judges “in the interest of
justice.” In December 2020, he allegedly followed and grabbed a teenager who was walking in West Portal, refusing to let go and
repeatedly telling the child they were “perfect mates.” The teen sought shelter in a bookstore and called 911, prompting police
to arrest Hobbs.
Judge Russell Roeca later dismissed charges of child molestation and battery against Hobbs, again “in the interest of justice,”
because he’d served the maximum time allowed under the law for those crimes before a trial could begin. Erin and Blaise
Zerega, the teen’s parents, were outraged at Roeca’s actions, which included wiping clear a restraining order keeping Hobbs
away from the teen.
The Zeregas tried again earlier this year, asking Judge Michelle Tong to issue another restraining order. According to the family,
Tong said that because the previous charges had been dismissed, there was no basis for the order. Two spokespeople with the
Superior Court did not return requests Thursday for comment.
As the Zerega case wound its way through court, other women came forward, one saying a naked Hobbs had chased her
through Glen Canyon and another saying he’d tried to get into her car as she sat inside.
After Roeca released him, Hobbs briefly served time in Ventura County for auto theft before returning to San Francisco and
restarting his harassment of women and teens — even appearing at the West Portal teenager’s softball practice.
Erin Zerega said Thursday she is relieved Hobbs will be behind bars for years. “I want to say thank you to the judge,” she said.
“This time, the right thing was done.”
The victims of Hobbs who appeared in court for sentencing, Karina S. and Olivia J., read victim-impact statements, asking
Dorfman to consider the pain they had suffered. Karina S. testified last month that Hobbs grabbed and followed her as she
jogged in Golden Gate Park, “smiling like a Cheshire cat, staring me down as I was screaming to get away.” She sought help from
a nearby couple and called 911.
On Thursday, she said the scary encounter had “completely changed her life,” leading her to suffer panic attacks, arm herself
with pepper spray and obtain a guard dog.
Hobbs, dressed in head-to-toe orange and handcuffs, repeatedly interrupted her. “It was not an assault!” he yelled. “Someone
tapped you on the shoulder, and it ruined your life! Wow, get over yourself!” When she said Hobbs treated her like a piece of
prey, he shouted, “I’m a vegetarian!”
Karina S. bravely soldiered on, levying criticism at Hobbs’ public defender, Max Breecker, too. Breecker made several women
cry as they testified, raising his voice at times and pressing them to admit they just wanted Hobbs punished. Karina S. told me
after the sentencing hearing that Breecker had humiliated and dehumanized her. She believes the approach had served no
purpose other than to discourage women from reporting sex crimes in the future.
Olivia J., whom Hobbs grabbed and chased as she walked to her gym, also took Breecker to task, saying, “I felt victimized twice
— on the streets and on the stand.” She dashed out of the courtroom as Hobbs kept yelling at her.
I tried to ask Breecker about the women’s statements after the hearing, but he hustled down the courtroom stairs and said to
ask the Public Defender’s Office spokesperson.

Later, through the spokesperson, Breecker provided a statement reading, “The jury trial system is one of the most basic and
fundamental rights in our society. I am honored to represent those accused of crimes, including Mr. Hobbs. While testifying in
court can be a difficult experience, cross examination is a critical part of the process to protect the rights of the accused.”
Breecker had asked Dorfman to give Hobbs probation and encourage him to seek mental health treatment and take medication.
Hobbs interrupted his own lawyer numerous times, saying he doesn’t have a mental illness and would not take medication.
Hobbs seemed to prove his lawyer’s points with repeated, loud tangents about how it’s hard to meet people in San Francisco
with everybody buried in their phones. All he was trying to do, he said, was meet friends with whom to jog and play basketball.
He appeared to show no remorse and said he’d suffered “cruel and unusual punishment” by being jailed.
After issuing his ruling, Dorfman descended from his bench to the chairs reserved for members of the public and talked to
Karina S., still wearing his black robe.
“I wish you healing. I wish you peace,” Dorfman told her. “I wish you strength so you can return to your normal life. I really wish
that for you.”

The San Francisco District Attorney’s Office added six more charges to the case against alleged stalker Bill Gene Hobbs after six
more women came forward with claims of harassment and assault, prosecutors said Tuesday.
The new allegations add to a lengthy list of charges against Hobbs, whose allegedly aggressive and intrusive encounters with
women were highlighted in a series of Chronicle columns and have sparked outrage across San Francisco. Dozens of women

The newly filed allegations coincided with the start of a preliminary hearing Tuesday in which prosecutors will attempt to
persuade a judge to allow them to move forward with their case against Hobbs, who has pleaded not guilty. The hearing will
likely take days.
The prosecutors attempted to paint a picture of a serial offender whose unwanted encounters with dozens of women followed a
similar pattern and theme — and who has been “terrorizing San Francisco, ” said Deputy District Attorney Colin Alexander.

Alexander brought several San Francisco police officers — Thomas Ly, Martin Kilgariff, Louie Benavidez and Cullen Roache —
to the stand to recall several incidents over the past year in which one woman said Hobbs locked her in a “bear-hug,” and
another said Hobbs grabbed her buttocks. A third said Hobbs attempted to kiss her at a bar and a fourth said Hobbs grabbed her
waist while she was engaged in a Facebook Marketplace transaction on the street.

Hobbs’ attorney, Deputy Public Defender Max Breecker, peppered the witnesses with questions about why their investigative
notes were not more detailed, whether news media reports could have influenced the victims’ reports — and their
identifications of Hobbs — and what positions the victims were in during the encounters. He questioned whether a victim
turned around to see Hobbs, or he turned around to see her, and asked in which hand the victim was holding a bag of dog feces
during her encounter with Hobbs.

The defense also raised questions about why some of the victims had waited almost a year to make their reports about Hobbs to
the police.
A judge previously denied Hobbs’ request to be released from jail to live with his mother in Bakersfield, who was present in
court Tuesday.

During Tuesday’s hearing, Hobbs repeatedly turned around to see the courtroom attendees and appeared to smile several times
throughout the morning’s testimonies. He willingly pulled his mask down to be identified by witnesses several times without
being asked to do so.
Hobbs was arrested two weeks ago near Aquatic Park in San Francisco. His arrest followed a series of articles by Chronicle
columnist Heather Knight, which raised questions about why the city’s law enforcement officials weren’t able to intervene
sooner as allegations against Hobbs mounted.
Hobbs has been the subject of six previous criminal cases in San Francisco since 2017, and has been charged with trespassing,
battery, giving false information to police and false imprisonment. All of those cases had been dismissed by Superior Court
judges.
Hobbs was previously arrested and charged with misdemeanor counts of child molestation and battery by the San Francisco
District Attorney’s Office after he touched a teen, called them his “angel” and “perfect mate” and grabbed them when they came
out of a West Portal store in which they had been hiding from him.
At first, Hobbs was declared incompetent to stand trial, but later was incarcerated for several months. Eventually, San
Francisco Superior Court Judge Russell Roeca dismissed the case and expunged the court order that had mandated Hobbs stay
away from the teenager.
After the details of the West Portal case came to light, scores of women came forward to share their experiences with Hobbs.
Hobbs, who has E-V-I-L tattooed on his fingers, has been accused of stripping naked and running after one woman in Glen
Canyon, and forcibly entering a woman’s parked car and staring at her.

She said she pulled away, but that he grabbed her arm and then her waist. She screamed, “Keep your hands off me!” and turned
around to bolt in the other direction. He chased her. Ann asked a couple walking nearby if she could join them for protection as
she called 911.
She waited for police, answered their questions, identified the man — who lingered nearby — and gave officers photos she’d
taken of him following her on her phone. The man who was part of the couple she’d been walking with talked to police, too,
backing up her account.
In other words, Ann did everything right. Surely, this was a slam-dunk case.

Not in a city where scary, threatening behavior may be deemed OK as long as nobody suffers serious physical injuries. And not
in a city where misdemeanor crimes are rarely prosecuted.
More than three months after police arrested Bill Gene Hobbs, 33, that evening in Golden Gate Park — and weeks after at least
six women filed similar police reports about Hobbs chasing, grabbing and even forcibly kissing them — he remains on the
streets free of consequences, spotted Wednesday in Cow Hollow and Thursday in the Marina.

So far, the city’s criminal justice system seems to be sending Ann and the other women a clear message: You’re on your own.
Buy pepper spray, hustle along and hope for the best.

“I was truly just a piece of prey to this man, and I’ve never been so scared in my entire life,” said Ann, who asked that The
Chronicle identify her by her middle name because she fears for her safety.
After the encounter, she said she got a guard dog, installed more locks on her door, bought pepper spray and saw a therapist.
Those terrifying minutes in the park changed her life.
Police arrested him at 5:37 p.m. June 25 on suspicion of misdemeanor battery for allegedly grabbing Ann, but the office of
District Attorney Brooke Jenkins discharged the case on July 13 for lack of evidence, though it could be revived.
Until I told Ann, she was unaware that her quick actions, cooperation with police, photos of the assailant and the witness’
account hadn’t been enough to charge Hobbs. And she was outraged.
“I don’t know what else I could have done,” she said. “Do they expect every woman in this city to walk around with a GoPro
strapped to their head?”
It’s a fair question. About a dozen women have shared stories in this column about frightening encounters with a man they
believe is Hobbs, who stands 6-feet-4 inches, weighs 210 pounds, sports a buzz cut and has tattoos all over his body including
the letters E-V-I-L inked on his fingers.
Countless more women have said on NextDoor and Facebook that he harassed them too. Still, nothing.
The Chronicle has not been able to verify that Hobbs was involved in each of the complaints about him on social media in
recent weeks, but in a phone interview last month, he admitted he approaches women he finds attractive — while asserting that
he never gets physical. Hobbs did not return phone messages left for him on Thursday and Friday.
Hobbs has a significant criminal record, with numerous past arrests in San Francisco, Los Angeles, Kern and Ventura counties
and convictions for crimes including drunken driving, driving on a suspended license, theft and being under the influence of
drugs.

Hobbs has faced charges in six other cases in San Francisco dating back to 2017, accused of crimes including trespassing, false
imprisonment and battery. All were dismissed by judges.
Police Capt. Tim Falvey told me Thursday that all district captains have been notified about Hobbs and told to be on the alert
for suspicious behavior against women, but that as of Thursday, there was no warrant for his arrest.
A source familiar with the police investigation into Hobbs, but not authorized to speak publicly, said Deputy Chief Raj Vaswani,
who oversees the investigations bureau, is leading the effort to build a solid case against the alleged stalker and is working
closely with the D.A.’s office.
But so far, no individual account rises above a possible charge of misdemeanor battery or assault, according to the source.
Though such a charge would be punishable by up to six months in jail, police have seen their efforts to arrest Hobbs repeatedly
brushed off by the District Attorney’s Office or Superior Court judges and want to ensure their efforts this time stick, the source
said.
Police are encouraging women to seek individual restraining orders against Hobbs — and at least one is known to have been
served to Hobbs by sheriff’s deputies already. Hobbs is no longer staying at an address associated with him near the University
of San Francisco, the source said, and may be trying to dodge police by bouncing around the city.
(Hobbs is no stranger to the concept of restraining orders. This past week, he sought one against me for being a “stalker, cyber
bully and antagonist,” but a Superior Court judge quickly rejected it.)

Emberly Cross, who runs the citywide Cooperative Restraining Order Clinic, which helps people seek protection from their
abusers, said it’s frustrating that police are putting the onus on women to seek their own court orders.
“That’s what the criminal legal system says when they’re punting a case,” Cross said. “It says nothing is going to happen on the
criminal legal side.”
She said women would need to put their full names on requests for restraining orders and attend a court hearing at which
Hobbs could appear, which can be a scary experience.
“To me, this gentleman really highlights the problem with the criminal legal system,” she said. “These women are screaming at
him, screaming at the system, and nothing is happening. He’s just out living his life without a care in the world while women in
the city are scared to go out.”
The city missed yet another chance to get Hobbs off the streets on Aug. 11 when he entered a home on Avila Street in the Marina
while the residents were walking their dog.
Jackson, a man who was renting a room in the home, said he returned from his walk to find that Hobbs had parked his bike in
the garage and placed his backpack on the floor, before announcing that he was moving in. He noted there was an American
flag out front and that he was American.
Jackson’s girlfriend, Riley, listened to the two men’s disturbing conversation from another room and called 911.
“Jackson said, ‘It’s time for you to leave,’ and Bill was shocked,” Riley recalled. “He said, ‘What do you mean? Why would I
leave? This is my home now.’ He was very convinced that we were his new family.”
Jackson and Riley, who asked to withhold their last names because they fear for their safety, said police responded quickly and
were helpful, but seemed frustrated to have repeatedly picked up Hobbs, only to see him repeatedly released.
Police arrested Hobbs that day on suspicion of trespassing and giving false information to police — he claimed to be Scott
Peterson, the name of the California man who notoriously killed his pregnant wife — but Jenkins’ office dismissed that case “in
the interest of justice” because he hadn’t stolen anything.
Jackson said he’d never been told by the D.A.’s office that the case had been dismissed despite a state law requiring crime
victims to be notified of developments in their cases.
When she was pushing to recall her former boss, Chesa Boudin, Jenkins repeatedly said he’d failed to hold repeat offenders
accountable and had dropped the ball in keeping crime victims informed.

I’ve made several requests to interview Jenkins about the Hobbs case, but she has not been made available. Her spokesperson
emailed a statement from her saying the managing attorney for the office’s child abuse and sexual abuse unit is working closely
with the police on its investigation.
“We will take every step possible to hold Hobbs accountable when we’re able to bring forward a case that we can prove beyond a
reasonable doubt,” Jenkins said in the statement. “Multiple incidents can be prosecuted together so the court undertands the
gravity of Hobbs’ conduct.”

Former San Francisco Public Defender Geoff Brown had a lot of thoughts on the episode — and not necessarily ones you’d
expect from a public defender. He said the city has options to deal with Hobbs.
The city could seek a civil injunction against him for disturbing women on a broad scale, serving him papers notifying him to
not engage in grabbing, forcibly kissing or chasing women again. Then if he repeats the behavior, he can be picked up for
violating a court order and jailed, Brown said.
Meanwhile, he said, police and the D.A. should build a broad case and seek multiple consecutive sentences, bringing witnesses
from a variety of incidents before a judge and jury.
“This boils down to one thing we haven’t done in San Francisco — we don’t take misdemeanors seriously,” Brown said. “I
always thought there was a case for a good misdemeanor prosecution that stops particularly bad behavior, but now it’s like they
don’t count.”
Ann, the 24-year-old jogger, believes her encounter with Hobbs should count. But only several days ago did an advocate from
the D.A.’s victim services division call her to see if she needed assistance.
“She was like, ‘Yeah, you’ve probably heard a lot about this guy in the press.’ I said, ‘What?’” Ann recalled, noting that she then
found my columns and scoured NextDoor to learn about the many other alleged incidents.
Ann said she also got a call from a police investigator who told her the department hopes to persuade Jenkins to charge her case
after all and use it as part of a larger case against Hobbs.
For now, Ann waits — and wonders why there have been few repercussions for the alleged attacker who upturned her life.
“How many women have to be traumatized?” she asked. “I just don’t understand how loudly we need to scream to be heard.”

Tuesday’s arraignment follows a preliminary hearing that began in early November and stretched on for weeks.
Hobbs was originally facing more than 20 misdemeanor public nuisance, battery and assault charges, as well as one felony
count of false imprisonment for an encounter where he allegedly bear-hugged a woman on a street in San Francisco and carried
her for 15 feet while she screamed for him to let her go.
After the preliminary hearing, which involved San Francisco police officers taking the stand to recount their encounters with

Regarding “San Francisco is magnificent, and its people are furious,” (Bay Area, Sept. 24): Carl Nolte’s reference to Robert L.
Stevenson’s book Dr. Jekyll and Mr. Hyde, relative to the bright and dark sides of San Francisco made me think of the opening
line in Charles Dickens’ book, a Tale of Two Cities: “It was the best of times, it was the worst of times, it was the age of wisdom,
it was the age of foolishness, it was the epoch of belief, it was the epoch of incredulity, it was the season of light, it was the

We are in a climate crisis and need to move away from burning fossil fuels ASAP. Though small, these traffic closures would be a
step in that direction. The longer we wait to make the transition from burning gas, the worse our climate fares. Further, burning
gas worsens the air quality, and the dirty air is impacting our health and that of our children. As a city, we need to create a
better environment for our children. Families are leaving S.F. in droves; kids need more safe, enjoyable spaces to play, as they
need clean air to thrive.

Let’s work together to make these closures happen. We all agree that we must continue to improve accommodations for those
people for whom the closures are a hardship. But we cannot stall progress.
The whole “we need to punish you” for wearing that T-shirt sure gets old. Why treat firefighters like they’re in grade school?
Just politely ask him to cover it up or change. That’s all it would take. No need to make him stand in a corner or withhold his
meal like mom used to do. All over a T-shirt.

I appreciate Joe Garofoli’s article “There’s little doubt that Prop. 1 will win. But abortion rights advocates need it to win big”
(Sept. 25, 2022) on support for abortion rights. However, I wish the media would stop calling this movement “abortion rights.” It
is actually a long-fought movement to assure women’s citizenship. Now, as it was at the time of the writing of our less-than-
democratic Constitution in 1787, men have sought to control women by not granting them full citizenship.
Men have had near full control over their own persons for over 200 years. I do not recall having to run a gauntlet of protesters
when I got my vasectomy in 1973. Since our discriminatory Constitution made women more or less equal to a cow, women have
been denied an Equal Rights Amendment. It is time to call it an equal rights fight, a right to privacy, a right to liberty and the
pursuit of happiness.

The first
rst gut punch of a phone call came Dec. 8 when Blaise Zerega heard from his 15-year-old daughter. Her voice tearful and
terri ed, she whispered that she was huddled in BookShop West Portal, hiding from a stranger who’d been following her for half
an hour, grabbing her and telling her they belonged together.
Call 911, Zerega told his daughter, as he leaped into his car and raced to the bookstore. The man police identified as Bill Gene
Hobbs, 32, was still on the sidewalk, the letters E-V-I-L tattooed on his fingers. He got in Zerega’s face, the father said, shouting,
“I’m going to f— you up!” Police arrived and took him away in handcuffs.
The second gut punch of a phone call came June 28 when Zerega heard from the assistant district attorney assigned to his
daughter’s case. A San Francisco Superior Court judge had just dismissed the entire matter. Charges of child molestation and
battery? Dropped. A court order to stay away from the girl? Wiped out. Judge Russell Roeca said his ruling was “in the interest
of justice.”
This time, Zerega could do nothing. There was nowhere to race. Nobody to confront. The judge had the final word, and the
father was livid. In the interest of justice? Justice for whom?
“The guy’s a predator,” said Zerega, the managing editor at Alta Journal. “It boggles the mind that the judge failed to account
for the safety of people in San Francisco and girls and women in particular.”

So why did this happen? Figuring out the answer proved difficult, a common experience for journalists and residents alike
when it comes to San Francisco’s opaque criminal justice system.
Ken Garcia, a Superior Court spokesperson, said neither he nor Roeca, appointed to the court by Gov. Gavin Newsom last year,
could comment on an ongoing case, even though the case is no longer ongoing.
Police wouldn’t comment, saying they couldn’t provide records or interviews about any incident that happened more than 90
days ago, under guidance from the City Attorney’s Office.
Hobbs’ public defender, Nitin Sapra, said in a statement that a different judge had denied pretrial release for Hobbs and
declared him incompetent to stand trial.

Erin and Blaise Zerega’s 15-year-old daughter was harassed in West Portal by a man in December who other women said
had assaulted them too.

“He remained in San Francisco county jail for the maximum time allowed under the law for the crimes of which he was
accused, and reached this maximum time before he could be placed at a treatment facility,” Sapra said.
It’s true he’d been held in jail since his arrest Dec. 8, but Thomas Ostly, a former prosecutor in the San Francisco District
Attorney’s Office who is now a California deputy attorney general, reviewed the case for me and said that even if Roeca
determined Hobbs had already served the maximum time, the judge could have released him but kept the case pending. That
way, the stay-away order intended to protect the 15-year-old girl would have remained in place and Hobbs could have been
subject to probation and placement on the state’s sex offender’s registry. Ostly stressed he was speaking in his capacity as a
former city prosecutor and not for the attorney general’s office.

Ostly said the judge could have also required that Hobbs plead guilty or no contest to the charges so they’d stay on his record.
Instead, it’s as if the whole thing never happened.
Ostly also took issue with the District Attorney’s Office charging the child molestation as a misdemeanor instead of a felony. He
said a felony charge would have given the prosecutors more leverage, such as compelling Hobbs to seek treatment rather than
face state prison time. He added the District Attorney’s Office could also have charged Hobbs for threatening Zerega outside the
bookstore.
Ostly, a critic of District Attorney Chesa Boudin, who fired him along with other prosecutors immediately upon taking office,
said the District Attorney’s Office also should have notified Zerega family members of the June 28 hearing so they could have
attended and expressed their objections to the judge, but Blaise Zerega said he didn’t even know it was happening. Zerega said
he’d asked to be kept up to date in the case, which the prosecutor did — at first — before “everything got bogged down in delays
and reschedules.”
“There is nothing I have seen about how this was handled that shows even the bare minimum of competence,” Ostly said,
referring to Roeca and the District Attorney’s Office.
Rachel Marshall, a spokesperson for the District Attorney’s Office, disputed Ostly’s reading of the case. She said the office
elevated the severity of the case by charging child molestation, for which police had not booked Hobbs, but said the facts of the
case didn’t support charging it as a felony.
She said the office objected to Roeca’s dismissal of the case and pointed out he’s still behind bars, though not in San Francisco
— Ventura County picked him up on a felony warrant for auto theft.

Records show Hobbs stands 6 feet 4 and weighs 210 pounds. He has had six criminal cases against him in San Francisco dating
to 2017. They include charges of trespassing, false imprisonment, battery and giving false information to police — they were all
dismissed by judges “in the interest of justice,” according to a clerk at the Superior Court who looked up the cases for me.
Zerega heard from other victims after posting his family’s story and Hobbs’ photo on Nextdoor. One was a woman who was
walking her dog in Glen Canyon in November and encountered a man who was “loud and angry,” according to an email she sent
to the District Attorney’s Office and shared with Zerega.

She rushed past, but Hobbs then stripped naked and ran after her, she wrote. He got very close to her, but she managed to run
to other people in the canyon who helped her get away. She called 911, but it’s unclear what happened from there.
In another instance shortly before Hobbs followed Zerega’s daughter, Erin Griffin was eating lunch in the driver’s seat of her car
parked outside a West Portal church. A man she identified as Hobbs opened her passenger door and appeared about to get
inside.
She said in an interview she jumped out and, “He rested his head on the top of my car and just stared at me.” She kept
screaming at him, she said, until he walked away. She said she called the police nonemergency number, but doesn’t know what
happened after that.
That’s apparently when Hobbs spotted Zerega’s daughter, whom the family asked not be named. She spent her lunch break
from Zoom school walking to West Portal’s main drag to buy paint. She’s an artist and needed new supplies.
She passed by the gas station on Claremont Boulevard when Hobbs approached her, touched her arm, called her his “angel”
and “perfect mate” and told her to come with him. She rushed along, but he followed her. She popped into the art store, but he
was waiting for her when she left.
He grabbed her arm and wouldn’t let go as she struggled to keep walking.

“I’m flipping out, scared out of my mind,” the girl said in an interview, recalling the incident.
She raced into BookShop West Portal and hid in a corner. He followed her inside. A staff member realized what was happening
and ordered Hobbs to leave.
The girl said she had crying jags, panic attacks and nightmares about Hobbs after the incident, particularly about what he
might have done if the bookshop employee hadn’t helped her. She started feeling better, but the nightmares came back after
she learned the judge had dismissed her case.
“I’m just really angry, honestly. A man like this who molests a child should be in jail for that,” she said, tearing up as her dad
reached out to clutch her hand. “I see every person as a threat now. I’m constantly on the lookout for danger now.”
Her mother, Erin Zerega, the creative director at an advertising agency, said she’s “angry, shocked and in disbelief.”
“You do everything you can to keep your kids safe, and I was so powerless over this,” she said.
On June 29, the day after the dismissal, Blaise Zerega wrote a letter to Roeca and copied Presiding Judge Samuel Feng.
“As a citizen of San Francisco, my daughter deserves an explanation from YOU about your decision,” the letter reads in part. “I
hope you are prepared to discuss her trauma, ongoing nightmares and fears about walking the streets of her own neighborhood.
“What you did is unconscionable, and we’re counting on you to fix it,” the letter continued. “We await the courtesy of a reply.”

It was a sunny Friday afternoon, and the grass at Dolores Park beckoned. A 27-year-old woman named Cassidy lay down near
the tennis courts, popped in earbuds to listen to music and began to doze off.
Suddenly, she felt somebody’s breath on her face. She opened her eyes to find a stranger pressing his body against her side, his
arm around her. His eyes were bloodshot, she said, and the veins in his arm bulged. His fingers on her body had the letters E-V-
I-L inked on them.
“Who the f— are you? Get off of me right now!” Cassidy remembers yelling in a panic at about 2 p.m. on July 8. She jumped up,
and the stranger followed her to her car before she managed to get inside and drive away.
Cassidy, who asked to be identified only by her first name because she fears for her safety, is the latest of numerous women to
describe being harassed, touched, assaulted, followed or leered at in San Francisco by a man they believe to be 33-year-old Bill
Gene Hobbs.

In what has become a five-alarm fire for many women in the city — spread on social media — several alleged victims have
posted photos of the distinctive-looking Hobbs, a 6-foot-4 white man with a buzz cut and a body covered in tattoos, including
the E-V-I-L tag on his fingers.

The fact that a San Francisco Superior Court judge dismissed a case against Hobbs in which he was accused of following and
grabbing a 15-year-old girl — first reported in this column — is well known by now. So is the fact that he’s back on the streets
despite a long arrest record in four counties, despite admitting to me in a phone interview that he follows women he finds
attractive, and despite the flood of new complaints.
But it turns out city officials had another chance to intervene on Aug. 11 — and again came up short.
Police arrested Hobbs that morning on suspicion of trespassing and giving officers false information. A police report states that
he entered a home on Avila Street in the Marina while the owner, who left the door unlocked, was out walking his dog. When
the owner returned and found Hobbs standing in his hallway, he called police and told them the intruder kept saying, “I want a
house like this.”

Hobbs, according to the report, initially told officers he was “Scott Peterson,” using the name of the California man who
notoriously killed his pregnant wife.
But the office of District Attorney Brooke Jenkins — who promised to get tough with repeat offenders after replacing her
recalled predecessor, Chesa Boudin — dismissed the case, citing the “interest of justice.” Jenkins said in a statement that the
incident was “harrowing” but that Hobbs did not steal or tamper with anything.
“As more facts and information come to light and we are presented with evidence that we can charge, we will move swiftly to
hold him accountable,” Jenkins said, while advising women who have felt violated by Hobbs to contact police.
On its own, trespassing is a relatively minor offense. But when told of this development, District Attorney Steve Wagstaffe in
neighboring San Mateo County said his prosecutors would have made a different decision. If the Aug. 11 incident would have
taken place in his county, he said, he would have sought a sentence of four to six months in jail with a connection to mental
health services — because Hobbs clearly needs them.
“That’s somebody’s home! That’s our area of security. That’s where we should be able to feel safe,” Wagstaffe said. “If the facts
fit, if the evidence is sufficient, we charge the crime. But it’s a different city up there, isn’t it?”

Cassidy said she knows seven other women who claim to be victims of Hobbs and that they’re buying Mace, pepper spray and
even stun guns because they feel so unsafe walking around in San Francisco.
“I’m pretty pissed that they know as much as they know, and he’s still allowed to walk the streets,” she said of city officials.
“Where is the line?”
That’s a question no one has been able to explain. Police officials said the case is under investigation, but Hobbs would not tell
me whether he had been interviewed when I spoke to him last week. He did deny hurting anyone, explaining, “If you’re walking
down the street, and I see you and I think that I know you or I find you attractive and I run up to you and I say, ‘Hello,’ is that a
crime?”
Meanwhile, young women around San Francisco have created their own community of watchers, crowdsourcing sightings of
Hobbs and circulating his photos as a warning. On Sunday evening, somebody posted a photo on Reddit of a man who
appeared to be Hobbs standing near young women outside a South of Market bar.
Monday evening brought another account. A woman named Cat, a 30-year-old UCSF employee, said she was riding the hospital
shuttle home when it stopped at Seventh and Market streets. A man she’s sure was Hobbs was screaming. She sent photos she
took on her cell phone, and the man appears to be Hobbs.
She called the police nonemergency number and said the dispatcher asked, “What do you want us to do with this information?”
Until last week, Cassidy hadn’t known she might be part of this community. She’d thought her bizarre encounter was a one-off
and tried to forget it rather than go to police. Now, she said she plans to file a report this week. At least six others have already
filed reports about Hobbs’ alleged behavior, according to the women.
Wagstaffe, the San Mateo district attorney, said he would have alerted all of the police chiefs in his county to work hard to build
a case and would have posted some kind of warning to women on social media.
As of Thursday, the San Francisco Police Department had said only that it was investigating three recent reports of “a male
committing suspicious acts toward females” and was working to develop probable cause to make an arrest.
A department spokesperson said Monday there were no updates in the investigation. He declined to answer questions.
Supervisor Catherine Stefani — who represents the Marina and has warned her own 13-year-old daughter about Hobbs — told
me she’s confident police investigators are working up a strong case. She said she discussed the matter multiple times with
Capt. Derrick Jackson, who heads the Northern Station.
“I don’t know what breakdown in communication is happening in the D.A.’s office or the courts or between police,” Stefani said.
She said Jackson told her that Hobbs had allegedly tried to forcibly kiss a female police officer, but police declined to confirm
that.

Hobbs first
rst came to public attention last year after allegedly stalking and grabbing a 15-year-old in West Portal in December
2020. He was charged with misdemeanor counts of child molestation and battery and served several months in jail, reaching
the maximum sentence he could have served if convicted.
Superior Court Judge Russell Roeca dismissed the case in the “interest of justice.” He could have released Hobbs but kept the
case pending, allowing a stay-away order that required Hobbs to keep away from the teenager to remain in place. If Hobbs had
been convicted, the charges could have stayed on his record, and he could have been referred to treatment.
It wasn’t the first time Hobbs had come into contact with authorities in San Francisco. The Los Angeles native was charged with
trespassing, false imprisonment, battery and giving false information to police in six separate cases dating back to 2017. Every
time, judges dismissed them “in the interest of justice.”
He has numerous other arrests in Los Angeles, Kern and Ventura counties and convictions for crimes including drunken
driving, driving on a suspended license, theft and being under the influence of drugs.
A woman who said she allowed Hobbs to live in her apartment in Los Angeles rent-free for a year several years ago, and who
spoke on the condition of anonymity for fear of her safety, said Hobbs had been living on the streets and using heroin when she
met him. She said she felt bad for him — that he’d been in a motorcycle accident and sold the prescribed painkillers for money,
but that he wasn’t creepy or aggressive back then.
The Chronicle has not been able to verify that Hobbs was involved in each of the complaints about him on social media in
recent weeks. But the reports from women continue to roll in.

Tess, 28, said she was running in the Panhandle on Aug. 6 when someone grabbed her from behind, kissed her neck and said,
“It’s so good to see you!” She said she is certain the man was Hobbs. She said she told him she didn’t know who he was and that
he responded, “I’m Jesus Christ.”
She said that after she pushed him away and ran, he called out, “What, Jesus Christ isn’t good enough for you?” She said she
tried to brush it off, but now intends to file a police report.
“It’s really easy as a woman to be like, ‘Maybe I’m making a big deal out of this, and maybe I’m overreacting,’” she said. “But I
would like to be able to feel safe in my own city.”
Olivia, 26, said she was walking to her gym in the Marina on the evening of April 25 when a man she believes was Hobbs
grabbed her from behind and pulled her into his body. He kept telling her she was beautiful, she said, while relating that he was
on his way to an Alcoholics Anonymous meeting as he chugged a bottle of wine. She pulled away and dashed off, but the man
pursued her until she reached her gym, where she burst into tears.
“He had such a strong hold on me, and he was so much bigger than me,” she said.
She said she didn’t notify police, figuring they would not do anything, but said she’s reconsidering.
Isabel, 27, said she was walking through Chinatown a few months ago when a stranger wrapped his arm around her. The man,
who she said she’s sure is Hobbs, told her, “I just want to get to know you better.” She wriggled away and ran, but he pursued her

for multiple blocks. She said she repeatedly yelled, “I don’t know you!” before the man went away. She didn’t file a police report.
It was only after she read about Hobbs in this column, Isabel said, that she realized she’d seen him working as a volleyball
referee at Dolores Park in August through Volo Sports. Isabel said that after one game, as her team formed a huddle, Hobbs
approached the group and forcibly kissed one of the players.
“Our whole team was like, ‘What was that?’” she recalled. “He just laughed and then asked, ‘Do you know where the Golden
Gate Bridge is?’”
Volo Sports confirmed Hobbs worked as a referee, but said he is no longer employed by the company and that it is cooperating
with police. Asked whether it conducts background checks before hiring, the company didn’t respond.
Michael, a small-business owner in the city, said a man he is certain is Hobbs followed his teenage daughter from her bus stop
to his business last Nov. 17 and tried to pin her against a wall. She ran into the business, crying, he said.
Michael said he kicked Hobbs out of his business, but that he has returned several times since. He said he didn’t call the cops
the first time, but when he called another time, officers didn’t respond.
Another day, Hobbs came to the business acting belligerently, Michael said, and officers happened to be outside. The father told
them what had happened. He said the officers asked Hobbs whether he wanted to hurt himself or others and when he said no,
they let him walk away.
Megan, 42, said she was walking home in the Marina on Aug. 10, carrying bags of groceries, when a man she believes was Hobbs
stopped a bicycle inches from her and blocked her path. The maneuver ripped one of her bags, spilling groceries on the
sidewalk. He stared at her intently for about 15 seconds before riding away.
“It’s absolutely the guy in the photos,” she said. “My heart was racing. My heart’s racing now just going through that situation
again.”
Megan said she called the city’s Northern police station Monday morning and tried to file a report, but was told by the person
who answered the call that she’d need to talk to specific investigators and that it might take three hours to make her statement
at the station. Megan said she didn’t have time Monday, but plans to visit in person on Tuesday.
Wagstaffe, the district attorney in San Mateo, said most of the accusations by women amounted to potential misdemeanors,
though some could be felonies — including the alleged battery against Cassidy in Dolores Park. He said it was important for
victims to report every incident and for the criminal justice system to take each one seriously while building as big a case as
possible, rather than treating each case as isolated.

There are 52 superior court judges serving San Francisco. They are elected. Yet most
voters have never heard of them. The judiciary shouldn’t be a mysterious Star Chamber. If
you care about courtroom outcomes, it’s important to know who the judges are when they
appear on the ballot. Join the Court Watch program at Stop Crime SF to get informed. I

Why should we care who the judges are? Consider this recent San Francisco Chronicle
headline: “Half of people released from SF jail before trial were accused of a new crime
while free.”
This headline is jarring to read. And there’s a lot to unpack in the accompanying article.
Here’s what you need to know:
1. A study by the California Policy Lab looked at the number of suspects who committed
a new crime after they were released by San Francisco judges to await trial on the
original crime. The study wanted to gauge the effectiveness of a risk assessment tool
used by judges. Typically, judges hear arguments from the public defender and the
district attorney about whether a suspect should be released or held before trial.
Judges also get a recommendation from the Public Safety Assessment — an
algorithmic tool that measures a suspect’s risk of committing a new crime. In San
Francisco, 73 percent of judges detained the suspect pre-trial when the algorithm
suggested it. But 27 percent did not.

2. The California Policy Lab study looked at re-offenses from 2016 to 2019. But two
high-profile cases this year give added relevance to the report:
— The suspect who stabbed two Asian seniors as they waited for a downtown bus in
May had recently completed a diversion program for an earlier assault charge.
— The suspect who stabbed a 94-year-old Asian woman as she walked outside her
Lower Nob Hill home in June had been released by Judge Richard Darwin weeks
earlier. The suspect was facing burglary charges and Judge Darwin put him back on
the street with an ankle monitor despite an extensive criminal history and a request
by the district attorney’s office to keep him in custody.
3. When a suspect is released before trial, they can be put in a pre-trial diversion
program. This helps reduce the jail population and gives people a chance for
rehabilitation, which is a good goal. But Supervisor Catherine Stefani told ABC-7
News she doesn’t have confidence in the success rate reported by San Francisco’s
Pretrial Diversion Project. “They are masking what is actually happening,” she said.
“The data wasn't matching what we were seeing out on the streets." The Pretrial
Diversion Project only counts re-offenses within San Francisco during a four-month
period. The California Policy Lab study, however, counted all new crimes committed
regardless of location and time. That’s why the numbers posted by the Pretrial
Diversion Project didn’t match. Stefani was the only supervisor to vote against
renewing the Pretrial Diversion Project’s contract. She plans to introduce legislation
to ensure reoffense rates include all crimes committed. Diversion programs are not
the problem. They are preferable to jail and help people turn their lives around. It’s
important to measure every program for success so we can support the ones that
work best.
The story about a 15-year-old girl who was followed and grabbed on West Portal Avenue in
San Francisco and the judge who dismissed all charges against the suspect raises many
unanswered questions.
Why did Judge Russell Roeca drop the child molestation and battery charges? Why did
Judge Roeca end a stay-away order meant to protect the girl from the 6’4 and 210 pound
man with “EVIL” tattooed on his fingers? Why was the child molestation charge filed as a
misdemeanor and not a felony?
Even longtime San Francisco Chronicle reporter Heather Knight couldn't get answers to
those questions.

“So why did this happen? Figuring out the answer proved difficult, a common experience
for journalists and residents alike when it comes to San Francisco’s opaque criminal justice
system,” Knight said in her story about the case.
There were other victims before the 15-year-old girl. Knight reported the same suspect
stripped naked and ran after a woman walking her dog in Glen Canyon. The woman was
able to escape.
The suspect, Bill Gene Hobbs, has faced six criminal cases in San Francisco since 2017 with
charges that include false imprisonment and battery. Each time, judges dismissed the
cases.
Knight’s article quoted a public defender who said Hobbs was “incompetent to stand trial”
but wasn’t able to be placed in a treatment facility. Knight also quoted a former prosecutor
who said that Hobbs could have been compelled to get treatment if the child molestation
was charged as a felony instead of a misdemeanor. Instead, Hobbs is now being held in
Ventura County for another crime.
This case further demonstrates why stronger conservatorship laws are needed to give
severely mentally ill people the treatment they need before they hurt others. Turning jails
into de facto mental institutions is not a solution and neither is letting people go without
treatment.
Judge Roeca wouldn’t comment to the Chronicle on why he dropped the child molestation
charges. The father of the girl who was grabbed, Blaise Zerega, wrote a letter to Judge
Roeca seeking an explanation. There hasn’t been a reply.
Judge Roeca was appointed to the San Francisco Superior Court by Governor Newsom in
August 2020. Roeca is scheduled to face voters in 2022. But judges are often
automatically re-elected. While judges are supposed to be voted on every six years, they
do not appear on the ballot if no one runs against them.

supporters, who were thrown out of court for the outburst.
“I’m so emotional, this is affecting me more than I thought it would,” said April Green,
O’Neil’s aunt who attended Friday’s hearing at the Hall of Justice. “I was believing in a
system that I thought was fair. I don’t know how to respond to this.”
O’Neil’s supporters fear that postponing the matter to July may alter the case, since
District Attorney Chesa Boudin’s office is prosecuting Samayoa, and he faces a recall
election in June.
James Conger, an attorney with the District Attorney’s office who is prosecuting
Samayoa, argued the defense is “doing District Attorney shopping. In other words, the
recall is in June, and they hope it succeeds and they’ll get a better deal with a
different District Attorney,” he said during the hearing.
Julia Fox, the defense attorney for Samayoa, shot back that holding the hearing on
Monday was also a political move. “I’m very comfortable addressing the ‘elephant in
the room.’ It’s very obvious this is a political Hail Mary for Chesa Boudin,” Fox said.
On Dec. 1, 2017, Samayoa shot O’Neil, who was unarmed, video footage showed.
O’Neil was pursued as a potential carjacking suspect. In November 2020, District
Attorney Chesa Boudin filed felony criminal charges against Samayoa for voluntary

and involuntary manslaughter, excessive force, and assault with a firearm. The San
Francisco Board of Supervisors granted O’Neil’s mother a $2.5 million settlement.
Fox said the hearing should be postponed because San Francisco Police Department
Sgt. Mark Hutchings, a key homicide investigator, would be on sick leave until July 14.
Hutchings allegedly took a statement from a witness that O’Neil’s state of mind was
skewed from “smoking crack” that Fox felt was important to the case.
“It would be atypical to not have a lead homicide investigator present at a preliminary
trial,” Fox said. “I think a magistrate would very much like to hear that.” She argued
that this morning that another witness and Hutchings’s partner, Sgt. Scott Warnke,
was involved in another trial that was extended to June 2. As a result, he may be
unavailable for testimony.
Fox also asked for more time so she could file a motion to get access to police
misconduct records on Samayoa’s field training Officer Edric Talusan, who was
present when O’Neil was shot. Talusan is expected to testify for the prosecution.
“It’s unfair” to treat Samayoa differently “because he is a former police officer,” Fox
said. “We ask that he be given the same courtesy as anyone. It’s not just fair to the
victim, but to Samayoa as well.”
Conger argued Hutchings wasn’t needed because in all his investigations, another
person or a recording had also documented that information. He said he could call a
series of other witnesses to make up for Hutchings’s absence and a toxicity report
could serve in place of testimony.
Conger further added that Warnke could attend both trials. “Trials have breaks. He
can come in for a few hours.” He argued continuing the case would cause prejudice
toward O’Neil’s family members and community, who have been waiting almost five
years for this day in court. He argued Fox had sufficient time to file forTalusan’s
personnel records — over a year — but failed to do so, delaying the hearing and
allowing time to “shop around” for a new district attorney.
Presiding Judge Russell S. Roeca granted the continuance, expressing sympathy for
both the family, and acknowledging Samayoa’s due process rights. “This is a tough
one for the court,” the Roeca said adding that he was “troubled” by the delay in filing
for the officer’s personnel records. “But I understand the importance for witnesses to
testify.”

He warned that this would be Fox’s last chance to request one, and if it’s not filed by
the next preliminary hearing the case would still “go forward irrespectively.”
“Oh my God,” Green loudly said from the second row, appearing in disbelief. “Oh my
God, oh my God.”
A sheriff’s deputy on the opposite side of the room told Green to quiet down.
Then, the judge asked Fox if the pretrial hearing could occur on July 14.
“I’ll be out of town that week, so actually, could it be the 21st?” Fox said.
The side of the courtroom where O’Neil’s supporters sat then began speaking
frustratedly. One young man in the third row said something to a deputy, causing a
deputy to approach and chastise him. “Step outside,” he ordered. Green and another
woman seated in the row ahead began calling to the deputy, telling him to bother
them instead of the young man. Suddenly the court erupted in chaos, with O’Neil’s
supporters talking over each other and four deputies swarming the area.
“You’re fucking with us, you fuckin’ pigs,” O’Neil’s supporters said as they left the
courtroom.
“The judge has ordered the court closed,” another deputy yelled. “If you fail to leave,
you will be detained.”
“Are you serious?” O’Neil’s supporters said. One woman at the front said, “You are
evil. Evil. Evil!”
O’Neil’s group walked out, and a deputy locked the door. Meanwhile, Roeca told Fox
the hearing would occur on July 14, the immediate date when Hutchings returns.
Green stood out in the hallway of the Hall of Justice in a ring of supporters with
Conger, looking forlorn. She bemoaned that without a district attorney who presses
charges on police officers, Black and Latino men would be vulnerable to police use-of-
force and killings.
“I believe the judge already made his mind up,” Green told Mission Local. “Did you
notice how extra police officers appeared just before he gave the decision?”
She worries the case will change with the postponement. The first time Boudin called
her to let her know that he pressed charges, she was “in disbelief. A white man in a

You may not but most residents want to prove they are super progressive and
won’t see beyond that. Clearly he’s not a good decision maker but he still got
appointed in the first place. Most don’t understand or care about judge
elections.

Eh...further investigation into the situation shows that the judge let him out
because he had already spent the maximum amount of time locked up if he
HAD been convicted. So, it's not a judicial issue, but a legislative one.
They had him locked up so long to determine his ability to stand trial that he
has to be released.
Still...probably won't vote for someone just because their queer. We did that
with our State Senator and look how that's turned out.

FWIW there was a guy in the E who was creeping on kids at the Excelsior playground like this
about 6 months ago. He was eventually found by the paramedics in need of medical attention.

I think people lose sight of this. Police and the prosecutors only are two parts of the trifecta
needed for effective law enforcement. It is very difficult to get rid of a judge and making bad
decisions on the bench won’t get them removed.

I can see this ending one of two ways. Either the justice system finally does its job and locks this
guy up, or he ends up being SF's version of Ken McElroy.

It would be a huge privacy can of worms but one day I’d love to see mandatory health
screenings become part of the justice system for things like this.
I knew someone whose kid ended on the street as a young adult, angry and unable to behave
appropriately. Harassing girls and women. all of it. Eventually it was discovered that he had a
brain tumor messing with his hormones. He’d never had a chance to be an adjusted person, he’d
just been sent to therapy and then to jail and the street. Once it was removed he started
understanding society and being able to participate.

apparently died of a "penetrating shotgun wound to chest", in the
garage of his residence.
The death was not reported by the local "paper of record"; logged only

We write today in response to Annika Hom’s article of May 6, 2022, in Mission Local,
entitled, “Chaos erupts as judge delays hearing of officer accused of killing Keita O’Neil.”
This article does a disservice to the public, as it grossly misrepresents the actions of
individuals and potentially is even factually fraught. It also completely distorts and distracts
from the main significance of events.
The article purports to report on a court hearing concerning a continuation request by the
defense team of former SFPD officer Christopher Samayoa, the person charged in the
slaying of Keita “Icky” O’Neil, on Dec. 1, 2017. At said hearing, Judge Russell S. Roeca
made the controversial decision after hearing arguments to grant a continuance in the
matter from May 9, 2022, to July 14, 2022, thereby calendaring the pretrial hearing after
the recall election of District Attorney Chesa Boudin. This is certainly newsworthy as it
smacks of judicial activism or lawfare on the part of the judge and portends the possible
derailment of what is believed to be the first homicide prosecution of a law enforcement
officer in San Francisco history.
However, instead of digging into the many facets of public interest implicated here, Ms. Hom
decided to focus on a small amount of heartbroken frustration and restive speech,
embellishing to present the spectacle of “chaos in court,” a counterfactual that makes for a
nice lurid headline but could potentially negatively impact the prosecution’s case.
To begin, let’s address the “chaos” in the title. The Oxford English Dictionary defines chaos
as “Behavior so unpredictable as to appear random, owing to great sensitivity to small
changes in conditions.” Merriam Webster’s definition focuses on disorientation, defining it as
“A state of utter confusion” or “a confused mass or mixture.”
Moving along, Ms. Hom asserts in the second sentence, “The hearing was delayed until July,
