REJOINDER TO RESPONDENTS REPLY

That the Appellant hereinabove unto this honorable court most respectfull wishes to respond to
the respondents reply with the following comments by way of rejoinder as herein:-

· that the contents of paragraph one (1) of the respondents reply is extrimely denied since
the proceeding of the primary court was not correctly decided and determined for the
reason that loan contract of Tsh 1,500,000/= belongs to the respondent as per the
watertight evience adduced by the appellant in the court of law.

· that the contents of paragraph two (2) of the Appellant petition of appeal is admitted hence
the trial court did not make a reasonable evidential analysis and evaluation as the result it
led to miscarriage of justice.

· that the contents of paragraph three (3) of respondents reply is totally denied since the
appellant was not involved in the loan contract which claimed to be entered by both Appellant
and respondent so the trial court was wrong to receive the said contractual letter as Exhibit.

· THAT, the contents of paragraph four (4) of respondents reply is mostly disputed because prior
to the case at police station the respondent promised and admitted to have no witness in favour
of his case while afterward he brought two witnesses in the trial court.

WHEREFORE: The Appellant prays to Honorable court for the following orders:-

To allow this appeal with cost,

To quash judgement of the trial court,

Any other reliefs and orders as this Hon court deems fit and equitable to grant.
