1. The Applicant states that the Hon’ble Presiding Officer DRT-II

had issued Recovery Certificate in favour of the Applicants for

Rs. 10,41,407.02 plus interest of Rs. 9,9,077.02 in O.A. 1891

of 1999.

2. The Applicants states that the Applicants are making this

application seeking attachment of a property viz. Sanghvi

Sadan, on plot No. 57 Near Anupam Cinema, In village

Goregaon, Goregaon (E), Mumbai-400063.

3. The Applicants state that the abovementioned property

previously belonged to the Original Defendant No. 2 (now

deceased). The Applicants state that upon the Death of the

Original Defendant No. 2 Mohanlal Sanghvi, the property

devolved upon his son Mr. Suresh M. Sanghvi being his legal

heir who was Original Defendant No. 3. The Applicants state

that after the death of Suresh M. Sanghvi the property

abovementioned devolved upon his wife Smt. Sumitra Suresh

Sanghvi being his legal heir, Defendant No. 3a.

4. The Applicant states that the Applicants have obtained

property card of above property from the Detective agency

appointed by the Applicant, wherein it is clearly mentioned that

 due to death of Mr. Suresh Sanghvi his name has been

removed from the property card and his legal heir i.e. his wife’s

name Mrs. Sumitra Sanghvi has been added. Hereto annexed

and marked as “Annexure A” is the copy of Property Card of

the said property obtained by the Applicants from Detective

agency appointed by the Applicant.

5. In view of the above the Applicants pray as under:

a. This Hon’ble Court be pleased to pass an order attaching

the property belonging to Original Defendant No. 2 (since

deceased now belonging to Smt. Sumitra Sanghvi) viz.

Sanghvi Sadan, on plot No. 57 Near Anupam Cinema, In

village Goregaon, Goregaon (E), Mumbai-400063;

b. For any such other reliefs as this court may deem fit.
