Game rules for Michelin X Contest

Article 1: Organiser
The French Tyre Manufacturer Michelin, simplified joint-stock company with a capital of €504,000,004,
headquartered at Place des Carmes Déchaux, Clermont- Ferrand (63040) (hereafter referred to as "The
Organiser" and/or "Michelin"), registered with the Registre de Commerce of said town under the number 855
200 507 RCS Clermont-Ferrand, is organising, via the platform X (ex Twitter), a free game with no purchasing
obligations, open from the November 24th 2023 from 02:00 pm GMT to the December 1st 2023 at 11:59 pm
GMT.

This operation is neither sponsored nor organised by X (ex Twitter).

ARTICLE 2 - ACCEPTING THE PRESENT RULES


Participating in the game will be taken as acceptance by participants of the present rules and all provisions
therein, as well as current laws and regulations in force which apply to free games.

ARTICLE 3 - ANNOUNCING THE GAME


The game will be announced on X (ex Twitter), via a post posted on the @Michelin account
(https://twitter.com/Michelin).

ARTICLE 4 – WHO CAN PARTICIPATE?


The Game is open to participation for all physical persons considered adult in their country who have an
Internet connection and a X (ex Twitter) account.
Those who do not meet the forementioned conditions may not participate in the Game, neither may the
following people under any circumstances:
• Members of the Organiser's management or staff who have directly or indirectly been involved in the Game,
• Physical or moral persons who have been involved in the creation, organisation and management of this
Game, directly or indirectly
• Members of their respective families ('family' denotes those living under the same roof, as well as their direct
and/or indirect and/or collateral ancestors and descendants)
The Organiser reserves the right to carry out any checks relating to compliance with the present article as with
the full rules, in particular to exclude any participants who are minors, any participants who have committed
any form of offence or fraud attempt, without, however, being under any obligation to carry out systematic
checks on all participants, but having the right to potentially limit these checks to potential winners.
The same physical person may not take part from a third party player's account, i.e. on behalf of someone
other than themselves. Any proven fraud or attempts to cheat by a participant, including the creation of false
identities allowing for multiple registrations, may be punished by formal and definitive exclusion from receiving
prizes and from being declared a winner.
Participants who do not comply with one or other of the conditions set out in the present article will be
automatically disqualified.

Any participation which is incomplete, illegible and/or which contains inaccurate data will not be accepted.
The Organiser reserves the right to disqualify a player if they post comments which incite:
• discrimination, hate, or violence: those of a racist, xenophobic, sexist, homophobic or revisionist nature.
• Posting messages of a defamatory or derogatory nature
• tobacco consumption, excessive alcohol consumption or the consumption of substances which are banned
under the law
• the committing of a crime and/or infraction, suicide or the consumption or sale of illegal substances
• posting messages which are not within the context of the game: political, religious...
• posting pornographic material (and images containing nudity), paedophilia, violence.

ARTICLE 5 – ACCESS TO THE GAME


The Game will be open from the November 24th 2023 from 02:00 pm GMT to the December 1st 2023 at 11:59
pm GMT, exclusively on the following X (ex Twitter): https://twitter.com/Michelin
In accordance with French date and time.

Throughout this period, the Game will be available by connecting via a standard browser, apart from
interruptions, whether scheduled or not, for maintenance or for any other reason, including to update
databases or host servers.

ARTICLE 6 – TERMS AND CONDITIONS FOR PARTICIPATION IN THE GAME


In order to participate in the game, each participant must answer with a comment to the following question:
“What's so special about our lunar prototype wheel?” that will be posted on the Michelin X (ex Twitter)
account @Michelin.
The answer in the comments must be the following sentence: “It is an airless tire.”
Participants who have not correctly answered in the comments and in English, writing the above sentence, will
not be included in the draw and they will therefore be disqualified from participating. Only one participation per
X (ex twitter) account is authorized.
An electronic draw (with the help of the Pickaw app) will determine the winner on December 4th 2023.

Winner will be contacted in the next 48 hours via private message on X (ex Twitter) platform. If the winner
does not respond within a week this contact, the winner will lose the prize.

Each participant must have a public X (ex Twitter) account in order to allow for the necessary checks.

ARTICLE 7 - TERMS AND CONDITIONS FOR PRIZE ALLOCATION


An electronic random draw will be held to choose the winner from those participants who answered “It is an
airless tire.”

ARTICLE 8 - LIST OF PRIZES


Prize: collection of 6 “Bibendum Pop” figurines - prize value: 120€
The Organiser reserves the right to carry out checks on the conditions for participation for all winners before
distributing their prize.
Prizes cannot be given in any other form than that set out in the present rules. No other prize or cash
equivalent will be given in exchange for prizes won. The Organiser does however reserve the right to replace
these prizes with others of the same value and similar features if circumstances require and will not be held
liable for this.

ARTICLE 9 - CLAIMING PRIZES


The winner will be informed via the X (ex Twitter) account and will receive a private message via X (ex
Twitter).
Instructions for claiming prizes will be given in this message. If the winner does not respond within a week or if
their details are incorrect, incomplete, illegible, counterfeit or do not comply with the present rules, the prize
will not be given to a replacement winner.
The same applies if the winner does not accept the prize: they will not be given to following winners.
Michelin commits to send the prize within 6 months of the closing date of the game.

ARTICLE 10 - LIABILITY IN THE EVENT OF FORCE MAJEURE / RIGHT TO EXTENSION


Michelin cannot be held liable if, due to force majeure or events beyond their control, this Game needs to be
modified, extended, cut short, or cancelled, including if the Game is subject to unforeseen cheating and/or any
form of misuse. The Organiser reserves the right to end this Game without naming a winner and to use prizes
in a subsequent operation.
They reserve the right under all circumstances to extend, modify, cut short, or cancel the Game, and to
postpone any dates set out.
The Organiser will not be held responsible in the event that a winner cannot be reached by email, for reasons
beyond their control (including in the event of technical issues relating to Internet Service Providers, telephone
operators, or where the wrong email address has been provided).
In these cases, winners are not entitled to any form of compensation whatsoever.
The company Michelin will not be held responsible in the event that access to the game is prevented or that it
does not run properly due to problems with the "Internet" network or with X (ex Twitter). In particular, the
company Michelin cannot be held responsible for any external malicious acts. While Michelin makes every
effort to make sure information and tools provided for users are available and checked, they cannot, however,
be held responsible for errors (including posts on game sites, emails sent in error), for information not being
available or for any viruses on the site. Participation in this game implies an understanding and acceptance of
the nature and limits of the Internet, the lack of protection for certain data against misappropriation or piracy,
and the risk of infection by viruses which may be present on the network.
It is the responsibility of each participant to take all appropriate measures to protect their own data and/or
software stored on their IT or telephone equipment against any attacks. Each individual takes full responsibility
for themselves when connecting to the site and participating in the game. Furthermore, the company Michelin
is not responsible in the event of: - Telephone line problems, - Problems with hardware or software, -
Destruction of information provided by participants for reasons which are not attributable to Michelin, - Human
or electronic error, - Disruptions which may prevent the game from running properly or cause the automatic
random draw to malfunction. The company Michelin will not be held responsible for the winner's physical
inability to take a flight or to go to a foreign country as a result of irregularities in their documents (lack of visa,
lack of passport or expired passport, etc... ). Michelin reserves the right to interrupt the game under any
circumstances in the event that it is prevented from running properly due to administrative or technical
disruption for reasons beyond their control. Anyone engaging in fraud or not respecting the present rules may
be excluded from the game, and the company Michelin reserves the right to carry out legal proceedings
against them as necessary.

ARTICLE 11 - PROTECTION OF PERSONAL DATA


The personal data which you may be asked to provide Michelin with in order to receive your prize are limited
to surname, first name, date of birth, email address and postal address. This data is for Michelin's personal
use and not for that of X (ex Twitter), and will be stored for as long as necessary for the purposes of the game
for a maximum period of 6 months, after which it will be destroyed.

In accordance with the modified French law on IT and Freedom of the 6th of January 1978 (loi Informatique et
Libertés du 6 janvier 1978 modifiée) and the General Data Protection Regulation (GDPR) of May 25, 2018,
participants in this Game have the right to access, rectify, contest, or delete data relating to them. These rights
can be exercised by sending a request to the following address: MFP Michelin – Grégoire Teriltzian – 23,

The information provided is to be used by the organising company in order to run the game, and under no
circumstances by X (ex Twitter) services.
The collect of participants' personal data is necessary to participate in the challenge. Consequently, persons
who exercise the right to delete data before the end of the challenge will be deemed to renounce their
participation

ARTICLE 12 - LITERARY AND ARTISTIC PROPERTY RIGHTS


In accordance with French laws governing literary, artistic and industrial property, any reproduction,
representation, or use of all or part of the elements comprising the Game is strictly forbidden. Brands used in
the Game are registered trademarks of their respective owners.

ARTICLE 13 - REIMBURSEMENT
A refund of postage costs for claims (current slowest postal service) can be obtained by sending a written
request to the Organiser's address with an R.I.B. enclosed (or R.I.P. or R.I.C.) (bank account details)
A refund of internet connection costs incurred through participation in the game, up to a maximum of 6 (six)
minutes and not including participation on a mobile device, can be obtained by sending a written request to the
Organiser's address with the following information specified legibly: surname, first name, full postal address,
date and time of participation. Requests for refunds must include a RIB, RIP or RICE and a copy of the bill
from the participant's internet service provider showing: both the exact nature of the service provided by the
ISP and the billing method (unlimited, flat rate...), and also the date and time of connection corresponding to
participation in the Game, clearly underlined or highlighted by the participant. Given that, with current service
offers and technology, some internet service providers offer a free or flat rate connection to internet users, it is
expressly agreed that any access to the site on a free or fixed-rate basis (including acess such as cable,
ADSL or leased line) cannot be refunded, as in these cases the internet user has a contract with the internet
service provider which covers general internet use, and connecting to the site to participate in the Game does
not incur any additional fees or disbursement. Photocopying costs for any documents which have to be
provided will be refunded at 0.15 Euros inc.VAT per sheet.
Fees will be reimbursed via cheque or bank transfer, or by any other means decided upon by the Organiser.

ARTICLE 14 - COPIES OF THE PRESENT RULES


These can be obtained by addressing a request to the organising company, detailed in article 1, throughout
the duration of the Game.
A full version of these rules can be consulted, downloaded and printed without charge by clicking on the link
on the tweet post of the contest, throughout the duration of the game.

ARTICLE 15 - APPLICABLE LAW


The Game as well as the present rules are governed by French law.
In the event of discrepancies between the French version and translations into different languages, the French
version takes precedent.
Any disputes regarding interpretation of the present rules, as well as any unforeseen cases, will be decided
upon by a jury selected by the Organiser. Any queries regarding interpretation of the rules must be made in
writing. There will be no response to queries regarding interpretation of the present rules which reach the
Organiser more than fifteen (15) days after the end of the Game.
Any issues with interpretation and any disputes will as a last resort be decided upon by the courts in Clermont-
Ferrand under French law.
