In the matter of:-

Petition U/o 39, RULES 1 AND 2 AND SECTION 151 C. P.C

The above named plaintiff beg to state as follows: —

1. That the plaintiff has filed original suit with I.A. petition U/o.39,R-1 & 2 and
Sec.151 of C.P.C above noted suit for possession against the defendant. The
contents of the plaint may be read as part of this application.

2. That the defendants no.2 and 3 had sold some properties on the day of death of
defendant no. 1 on 04-01-2022 to their wife,sons and daughter, so that they can
further sell that property to the outsider showing that properties belong to them .

3. One of that property has been sold on 04-03-2023 by recently add the defendant
no.5 and on the 01-09-2023 some land has been sold by recently add the defendant
no.4 .

4.The defendants are not appearing before the court but they are doing such kind of
illegal stuffs like selling that undivided lands,cutting trees from that lands etc.

5. That the plaintiff has a good prima facie case and the plaintiff is sure to succeed.
6. That the balance of convenience is in favour of the plaintiff that the status quo
may be ordered to be maintained during the pendency of the suit.

7. That the plaintiff will suffer irreparable loss and injury in case the defendant
succeeds in her illegal design.

8. That in these circumstances,the petitioners pray that,your honour may be pleased

to pass that an ex parte ad-interim injunction may be granted in favour of the
plaintiff restraining the defendant to cut-away any valuable trees and prevent to
sell land from out of the suit land till the disposal of this I.A case and any other
relief that this Honble Court deems fit may also be granted to the plaintiff.

AFFIDAVIT

I, Sri Prakash Chandra Mishra, aged about 60yrs., S/o Late Golak Nath Mishra, of
At.Kudei, PO. Kudei Nadigaon, P.S Soro ,Dist. Balasore, do hereby solemnly
affirm and state as follows:-

1.That, I am the petitioner No.1 in this case.

2.That,I am entrusted to looking about the case on behalf of other petitioners.

3.That,the contents of this petition are all true and correct to the best of my
knowledge and belief and hence,I swear this affidavit.
