The Appellant above named respectfully submits as under:

1. That, the Second Appeal under Section 100 of the Code of Civil Procedure, 1908 is filed with
reference to the order dated 26/03/2022 passed by Sushil Kumar, 13th District and Sessions
Judge, in Appeal Suit bearing no. 63/2021, and Civil Suit bearing no. 717A/2018. A copy of
Appellate Judgment has been annexed hereto as Annexure ‘A’. and the said impugned order
annexed hereto as Annexure ‘B’.

2. Brief Facts
The plaintiff has presented the case before the trial court as, the plaintiff Satyendra Agarwal
is the Karta of the family and all the properties have been acquired by him. Some properties
were purchased the plaintiff in the name of his son late Abhay Agarwal who has passed
away on 04.07.16. The plaintiff had purchased a house, the address for which is MID MX
Duplex co. 172, E-7 Shahpura from his self-income. The plaintiff had purchased a land
registered as 104/2 situated at Gora Gav from his self-income. The appellant had
purchased 0.42 Biga of Land registered as 104/3 situated at Gora Gav. The appellant had
also purchased 40 acre of land from his self-earned income. The appellant had 5 Tolas of
gold and 20 tolas of silver after his retirement.
3. That the decree of the civil court was passed on the condition that the terms of the
compromise would be followed, and the decree made it clear that the property 104/2 situated
at Gora Gav will be owned and the possession of the same would be with Satyendra Agarwal
that is with the plaintiff and the property 104/2 situated at Gora Gav will be owned and the
possession of the same will be with defendant.
4. That, the plaintiff, therefore, being aggrieved by and dissatisfied with the judgement of the
made by trial court moved to appellate court.
5. That the learned trial court has passed the decision and decree regarding the registration of the
decree contrary to the principle of natural justice which deserves to be upheld. A memorandum
of oral partition of the family was executed on 31.08.2018 between the original plaintiff and
the original defendant and was related to family. For this reason, it is necessary to register the
decree and it is practically to settle the rights without registration of decree. In this regard the
judgement of the hon’ble appellate has relied on the case of Mohd. Yusuf Vs Rajkumar and
ors. but the merits of the case have not been considered, if Mohd. Yusuf Vs Rajkumar is
referred here then it will further complicate the situation.
6. That the original plaintiff contention that the original defendant has violated the terms of
condition of compromise and that a permanent injunction need to be imposed on the

 defendant from selling the property is unjustified, it is clearly stated in the decree made by the
trial court and also said by the appeallat court that the 104/3 situated at Gora Gav will be
owned and the posssion of the same will be with original defendant, hence the original
defendant is free to to use the property the way she desires and the case is only a hindrance in
original defendant fundamental right to enjoyment of property.
7. That the appeallate court has trialed the case from very narrow perspective and has not given
thought on practicality of the case.

 GROUNDS

1. That, the impugned judgment is contrary to the principles of law, justice, equity and good
conscience and the same is to be quashed and set aside. That the impugned judgment and
decree are against the evidence on record and the same should be quashed and set aside.

2. That, the 13th District and Sessions Judge Complex, has failed to take into consideration the
fact that the impugned judgment if given effect to would violate the basic principles of law
and justice.

3. According to the order of the learned District and Sessions Judge, the decree need not be
necessarily registered, but after the death of the husband the wife has rightful claim in the
husband’s property and if the decree is not registered then it will hamper the defendant rights
to use the property.

4. That the impugned order passed by the Appellate court is liable to be set aside for not being
in accordance with the facts and law

5. It is submitted that the Appellant begs the leave of this Hon’ble Court to add, amend or
rescind any of the aforementioned grounds if found necessary.

6. Because the impugned order suffers from the vice of being its excess of jurisdiction and has
been passed of misconstruction and incorrect interpretation of law..

WHEREFORE, it is most respectfully prayed that in view of the above mentioned facts,
reasons and circumstances, this Hon’ble Court may very kindly graciously be pleased to
set aside the impugned order dated 11/10/2021 and 17/08/2022 passed in the court of
Principal District and Sessions Judge Bhopal, Madhya Pradesh in the case of (Mohd
Nafees V. Sunita Balwani & Ors.), to hear the appeal of the appellant on merits within
such day and time to be fixed by this Hon’ble Court for which act of kindness the
appellant shall be grateful. Such other relief or reliefs as this Hon’ble Court may deem
just and proper in the facts and circumstances of the case may also be passed in favour
of the appellant against the respondent.. Cost of the above second appeal may also be
awarded in favour of the appellant against the respondent.
