Industrialization plays a major role in the development of a nation.

Along with providing employment to a large section of people, it improves the standard of living, increases literacy and meets the necessity of day to day requirement of goods and services. But along with the positive effects, it also generates some negative or undesirable effects like environmental pollution, traffic congestion, and coming up of slums, exerts pressure on infrastructure and resources like land, water, air and also human resource. In order to minimize these negative effects, policies and proposals are framed. Delhi, the capital of India provides employment to a large number of populations. MPD 1962 was the first of its kind in the country. It was prepared with a view to sustain the increasing population and efficient utilization of land for different urban activities. Provisions for industry were also mentioned in the chapter on Manufacturing. It suggested that heavy and large industries are not permissible in Delhi and that attempt should be made to shift objectionable industries from congested areas into specified industrial areas. But nothing of this kind was implemented. The plan for Delhi, 2001 is a modification to MPD 1962. In its chapter on Industry, it was stipulated that H category industries are not permissible in Delhi. The existing H category industries were asked to shut down and relocate outside Delhi. It also mentioned that the land that would be available on shifting of industries would be used to meet community needs. If there is no requirement of community services, the land would be used as per the prescribed land use. It was also mentioned that the non conforming industries were to move to specified industrial areas and pollution control norms were to be followed by the polluting industries. But nothing was implemented before the intervention of the Supreme Court. Under the orders of the Supreme Court dated July 8, 1996 and May 10, 1996 H category industries were closed down and the use of land vacated was proposed. Fourteen years have passed since the Supreme Court orders regarding shifting of H category industries and use of land vacated. This study is an attempt to see how far the court orders have been implemented till date. H category industries have shut down as per court order but many of the industries have not surrendered land to DDA for development of green. The part of land retained by the industries is yet to be developed and in most of the cases still lies vacant or unused. Land generates income and keeping the land vacant for a long period by not putting it into any use and that too in a place like Delhi where there is already scarcity of land is not an indication of successful planning. This study is an attempt to look into the issues which have delayed the implementation of court order and also the issues which arise in the surrender of land. Attempt has also been made to provide suggestions and recommendations as per the findings of the case study area which have been selected for this study purpose.
