However, the deal period must not exceed one year which is to be fixed by the branch depending on the nature of item and its movement of disposal. b) TR to be executed by you for each delivery under TR duly supported by your application for TR and you must maintain proper buying and selling of the goods. ©) Inthe event of your failure, we will adjust the investment / dues by selling out your mortgaged properties and by closing liened accounts with us. 9. Other Terms & Conditions: * Islami Bank Bangladesh Limited reserves the right, at its option, to depute Bank Official (s) at the Factory / Site / Office of your business to ensure proper supervision of end- use of the Facilities/Investment, to be extended to you fom time to time, and monitoring of the recovery thereof in time. + Bank may impose any new condition and/or modify any existing condition of the Limit, refuse at any stage allowing/ sanction of any Facility/ Investment under the Limit of cancel the limit at any time without assigning any reason whatsoever and call back/ask for adjustment of the Facilities’ Investments, if any, provided and outstanding under the Limit irrespective of the maturity/expiry date of the Facilities/ Investments. + lfany account/deal becomes overdue you will be circulated as a defaulter client on the following day of due date among local branches as well as our local branches with a request not to extend any_facilities/investment to you. * You will have to permit the Bank and its representative's at all reasonable times to inspect. the premises, facilites, activities, books of account and records of your business to give their full co-operation and assistance in connection with any such inspection, At the inspections, the Bank and its representatives shall be permitted to make photocopies of the books of account and records of your business at the expenses of your firm. You are requested hereby irrevocably and unconditionally authorizes the Bank to contact and deal with their respective auditors direetly for any purpose whatsoever in connection herewith or with any document delivered hereunder, + No disbursement to be made if any deal/ investment become overdue. You shall have to maintain insurance on all its property and assets covering the risk of Fire, RSD, Theft, Burglary, Flood, Cyclone, ete at your own cost with an insurance acceptable to the Bank minimum to the extent of its cost / purchase price plus 10%, © Compensation at the rate of prescribed R.R will be charged on the principal outstanding if any MPI / Murabaha / PSI deal becomes overdue till full adjustment of the deal. } * All transaction under this limit must be done under compliance of Shariah principles. There must not be any fictitious buying and selling of goods by way of creating new investment, " All other usual terms & conditions as detailed in the related Investment Operation. Bai-Murabaha Investment shall be made by ensuring actual buying & selling and ensuring competitiveness of price and effective control of the Bai-Murabaha goods with the prescribed goods security. 4, Bai-Murabaha (TR) Investment facility to be allowed by ensuring actual buying & selling, supervision of end-use, storage, disposal & deposit of sale proceeds with the Branch towards adjustment of the related Investment Account(s) immediately after A sale, 5. isbursement, an UNDERTAKING shall have provide 4o the effect that: - a) You will ensure storage of the entire stock of Bai-Murabaha (TR) goods delivered/to be delivered under deferred payment and/or Bai-Murabaha goods released / to be released against TR. as the case may be, at the place specified by you for storing the said goods. 1) Stock delivered under Bai-Murabaha Investment against Trust Receipt be retained as per Trust Receipt executed by you till disposal & deposit of sale proceeds with the branch towards adjustment of the related Investment Account(s). ©) You must deposit the sale proceeds of the goods towards adjustment of the related Investment Account(s) with the Branch Immediately after sale irrespective of the due date of payment of the investment, 4) You should not divert any sale proceeds of goods against Bank's investment under any circumstance & must not sell the goods on Credit. °) ‘You shall not avail any sort of Iavextmend F ity/Loan etc. from any other Branch of our Bank and/or any other Bank/Financial Institution and shall not any encumber of your immovable/movable properties in any way without prior written == permission from the Bank. 6. There must not be any fictitious buying and selling of goods by way of creating new investment ie. the goods of one sister concem must not be bought by another sister concern for the purpose of adjustment. rarer pti Gert he 7. No Facility! Investment under the limit shall be allowed in case any deal in any mode / account becomes irregular / overdue (Unless otherwise permitted by Head Office under special circumstances). 8 All documentation formalities must be completed and required securities i.e. Primary Security, Cash / Goods Security, Collateral Security, Other Scourity including Mortgage / Charge Registration / Hypothecation / Personal Guarantee etc. be obtained as per Investment Operation Manual & subsequent, amendment, if any , before allowing any disbursement. 9° TR. facility under Bai-Murabaha Investment must be within the total limit. 10, Quality, Quantity, Price & Storage of all the goods against Bank's Investment including Bai-Murabaha goods with prescribed goods security shall be ensured by the Branch duly insured covering the risks of Fire, RSD etc, under Bank's Mortgage Page 4 Bart sates Aeerteoet PCTS eee ace ee Ss Cg et Mate sorts Islami Bank Bangladesh Limited prose 17627380 Sree! All formalities/terms and conditions applicable to such investment as per Investment Operation Manual & Instruction given by the Authority from time to time must be complied with/observed. 13. You must not keep the stock un-disposed for an unreasonable period. 14, In the event of your the failure to make entire payment of sale price on the due date, compensation shall be recovered from you as per Bank's Rule. 15. Daily sale proceeds/Income of the enterprise / firm / company shall have to be deposited to your Current Account with the Branch and the tumover of the Account shall be taken into consideration at the time of enhancement / renewal of the limit in future. 16. Your entire business should be routed through our Bank gradually. 17 You must submit all papers/ document to send your proposal to Head Office for next renewal or enhancément at least 02 (Two) months before its expiry date, 18 If any investment becomes overdue then 2.5% charge will be imposed on profit of overdue outstanding. If the above noted terms and conditions are acceptable to you please sign on each page of the enclosed duplicate copy hereof and return to us within 07 (seven) days in token of your having gone through and accepted the same for further necessary action ‘at our end.
