Here after referred to as the Party of the First Part, and _______________________
resident of Barangay __________, Lebak, Sultan Kudarat, Philippines hereafter refers
to as the Second Part,
Witnesseth:
WHEREAS, the Party of the First Part propose to construct/maintained a
waterway from ___________ Municipality of Lebak, Province of Sultan Kudarat to
____________, Municipality of Lebak, Province of Sultan Kudarat, Philippines and the
course of the proposed road will pass over and through land of the party of the second
part situated in the barangay of __________ Municipality of Lebak, Province of Sultan
Kudarat and bounded on the:

Containing area of ________ square meters, and registered in said municipality under
registration of Declaration in the amount of _____________________________.
NOW THEREFORE, in consideration of the construction and maintenance of
said waterway by the party of the First Part, and the benefit accrue there from the party of
the Second Part, of the sum P 1.00 as damages for the use and occupancy of the land
herein after referred to the partied there to agree and covenant follows:
FIRST: The party of the Second part hereby approved and consent to the
construction of said waterway over through his land situated in the barangay of
_____________ and grants and said unto Party of the First part a personal element of
right of waterway purpose and delineation unto the party of the First Part such part of this
land maybe necessary for the use purpose herein set but giving unto said party of the
FIRST PART and right to enter upon said land and make such surveys as maybe
necessary work for the construction and maintenance of said waterway, and so long as
the waterway herein dedicated shall be used for public purposes the party of the First
Part, all exclusively rights within and over the area embraced with the boundary line of
said right-of-way, as shown in the following sketch:
SECOND: The Party of the First Part agrees to remove at this expenses all fence,
houses an similar improvements within the 7 or 15 meters water-of-right-of-way, and to
rebuild some outside the boundary lines of said water-right-of-way in at least a good
condition as they were before being removed, or to make due compensation therefore,
and in the case of fruit bearing trees and growing crops to pay such reasonable damages
as may be agrees upon by the parties thereto.
THIRD: in the event it becomes necessary or advisable to alter or changes the
course of said waterway, the Party of the First part shall have the right to utilize such
other and belonging to the Party of the Second part as maybe necessary for the purpose,
with the same rights and privileges herein set out and upon the said terms and conditions
as set out in the preceding paragraph hereof:
