ADOPT-A-CREEK/ RIVER/ ESTERO PROGRAM OF THE MUNICIPALITY OF MADDELA

MEMORANDUM OF UNDERSTANDING

By and Between

THE LOCAL GOVERNMENT UNIT OF MADDELA, QUIRINO

and

THE BARANGAY LOCAL GOVERNMENT UNIT OF _______________, MADDELA, QUIRINO

for

Adopting portion of the TUNGCAB Creek/ River/ Estero, covering a stretch of 1,000 linear
meters situated at Purok ____ with geographical coordinates bearing 16°21’40” N (Start) and
121°40’34” E (End)

WITNESSETH:
WHEREAS, Article II, Section 16 of the Philippine Constitution states that, the state shall protect
and advance the right of the people to a balanced and healthful ecology in accord with the
rhythm and harmony of nature;

WHEREAS, Pursuant to the provisions stipulated under the Republic Act No. 9275 also known
as the “Philippine Clean Water Act of 2004.” Sec. 20. Role of Local Government Units (LGUs).
LGUs shall share the responsibility in the management and improvement of water quality within
their territorial jurisdictions;

WHEREAS, There are major creeks and river system found in the municipality. These
comprises the Cagayan River, Ngilinan River, Manglad River, Diduyon River, Dabubu River,
Tungcab & Maldanum Creek, Addalam River of which it is situated along boundaries of Maddela
& Aglipay and other various waterbodies found in the municipality;

WHEREAS; These rivers and creeks are vital to people and nature as most of the major
waterbodies found in the municipality are primarily used for fishing, agricultural irrigation,
transportation, domestic water use, eco-tourism, natural drainage, home of important aquatic
resources and others;

WHEREAS, Based on the initiated clean-up drive conducted along the Cagayan River, the
participating barangays have recovered/ retrieved debris of various waste along the easements/
riverbanks. The retrieved waste materials have undergone waste characterization study
conducted by the MENRO. Wherein, for the 264.20 kgs total of waste recovered, 186.90 kgs or
70.74% are residual waste, 70.80 kgs or 26.79% are recyclables, 6.00 kgs or 2.27% are special
waste and 0.5 kg or .18% COVID 19 related health care waste;

WHEREAS, The Municipal Local Government Unit of Maddela launched an Adopt-a-Creek/


River/ Estero Program in the municipality to address potential negative environmental impact to
our bodies of water and for the purpose of institutionalizing a collaborative effort of the
barangays, communities and other stakeholders towards the conservation, protection and
preservation of major creeks, rivers and esteros in the municipality;

WHEREAS, The Barangay Local Government of ______________________ has expressed its


interest to participate in the Adopt a Creek/ River/ Estero Program of the Municipality by
adopting portion of the _________________Creek/ River/ Estero covering a stretch of ______
linear meters situated in Purok___ with geographical coordinates bearing __________N
___________E (Start) and _____________N ___________E (End);

WHEREAS, Both parties recognize the importance of collaboration and partnership in order to
achieve the objectives of the program and have agreed to work together to improve the present
status of creeks/ rivers in the municipality;

NOW THEREFORE, In consonance of the above premises, these Memorandum of


Understanding (MOU) commits the following terms and conditions to wit:
That the Barangay Local Government of __________________________, Maddela, Quirino
shall:
1. Conduct a quarterly clean-up drive along the adopted creek/ river/ estero.
 The barangay to submit quarterly Accomplishment Report (Attendance, Pictures,
Weight/ Classification of Waste Recovered) to the MENRO for consolidation,
monitoring, research and planning.
2. Participate in the planting of native trees and bamboos during environmental
celebrations such as Arbor Day, Earth Day, World Water Day, World Bamboo Day and
others and in the implementations of various environmental related programs/ projects
conducted in the municipality such as Waterbody/ Easement/ Riverbank Protection
Programs/ Projects, Build Back Program of the DENR, and other environmental related
programs. Thus, includes the protection and maintenance of the planted trees and
bamboos.
 The barangay to submit Accomplishment Report (Attendance, Pictures, Total
Number and Species of Trees/ Bamboo Planted) to the MENRO for consolidation
and monitoring.
3. Adopt barangay ordinances to protect the planted trees/ bamboos as well as provision of
incentives to enhance participations during tree/ bamboo planting and conduct of clean
up drives.
4. Encouraged residents and other stakeholders to join the various environmental activities
within the adopted waterbodies.
5. Assist the MENRO in the conduct of ground survey and mapping of the adopted creek/
river/ estero.
That the Municipal Local Government of Maddela, Quirino shall:
1. Support the barangay in conducting information and education campaigns, community
mobilization activities and orientation/ training programs on the implementation of RA
9003 otherwise known as “Ecolgical Solid Waste Management Act of 2000”, “RA 9275 or
the Philippine Clean Water Act of 2004” and other environmental related laws/ policies.
2. Assign the MENRO to act as the secretariat and assist the barangay by providing the
needed technical assistance (orientation/ trainings) and provide the needed planting
materials (seedlings of native trees/ bamboo) during conduct of tree/ bamboo planting
activities.
3. Conduct survey and mapping of the adopted portion of the creek/ river.
4. Monitor and consolidate accomplishment report of barangays.
That both the Barangay LGU and the Municipal LGU shall maintain close coordination
whenever there are innovations, change in plans and policies, problem encountered and other
matters in relation to the implementation of the adopt a creek/ river program;
This MEMORANDUM OF UNDERSTANDING (MOU) shall be revised or terminated upon
mutual agreement of both parties;
