Regulation: A Review of Steps Taken by the Ministry of


Communication and Information."
Ministry of Communication and Informatics (KOMINFO)
is in charge of communications and informatics affairs. The main task of (KOMINFO) is to formulate
policies in the field of communications and information technology which includes post,
telecommunications, broadcasting, information and communication technology, multimedia
services and information dissemination.
A. Diagnostic
1. Technical challenges
• Cybersecurity: In the field of technology and information, cybersecurity is an
important issue. The Ministry of Communication and Information Technology must
protect the country's information technology infrastructure from cyber threats,
including hacker attacks, malware attacks, and other cyber-related threats.
• Frequency Spectrum Management: The Ministry of Communication and Information
strongly opposes laws and regulations governing the use of frequency spectrum for
telephone communications. Challenges include efficiently balancing the frequency
spectrum, avoiding interference, and setting frequency thresholds for telecom
operators.
• Internet Access and Digital Approval: Ensuring everyone has access to a reliable
internet connection is a top priority. It is considered leading.
2. Adaptive Challenges
• Technology Translation: Information and communication technology continues to
progress rapidly. Comcast must continue to adapt to new technologies such as 5G,
Internet of Things (IoT), artificial intelligence (AI), and others in addition to ensuring
that regulations are appropriate to manage this growth.
• Data Privacy: Due to increasing concerns about data privacy and security, KOMINFO
may need to re-evaluate and tighten the rules governing data privacy in order to
enforce current standards.
• Online Content Regulation: Adaptive strategies include addressing issues related to
online content, such as news, legal content, and satire. KOMINFO must continue to
develop effective strategies and tools to overcome this problem.
• Technological Innovation: Indonesia has carried out technological innovations that
support social and economic growth. This includes promoting technology start-ups
and facilitating technology research and development.
B. Stakeholders
The Ministry of Communication and Information ( KOMINFO ) is the government of the
Republic of Indonesia that is highly dedicated to the regulation and advancement of the
communication and information technology sector in that country. These stakeholders play
a role in formulating policies, monitoring implementation, providing input and providing
input in ensuring that the communications and information technology sector in Indonesia
develops and operates well. The country suffers huge financial losses due to corruption.
Parties involved in corruption divert or steal funds intended for development, public services,
social welfare and other crucial programs. There have been an increasing number of cases of
purported corruption in the purchase of 4G BTS towers for the Bakti project of the Ministry
of Communication and Information. The Attorney General's Office recently listed
Muhammad Yusrizki, the President Director of PT Basis Utama Prima (BUP), as a suspect.
With a promise to erect thousands of BTS towers, the project's primary goal is to offer digital
services in remote, undeveloped, and frontier regions in various Indonesian provinces.
However, based on an audit by the Financial and Development Supervisory Agency (BPKP),
the project did not reach the aim. Losses from the creation of legal studies, price markups,
and payments for BTS towers that weren't yet constructed totaled more than IDR 8 trillion.
This case started in 2023 and had been going on since the year before.
C. Timeline
Until the matter is settled, the following chronology shows how the alleged corruption
issue involving the Ministry of Communication and Information (Kominfo) and the
purchase of 4G BTS towers developed:
1. Beginning in 2021, the Ministry of Communication and Information will construct
7,904 Bakti 4G BTS towers in the frontier, remote, and underdeveloped (3T) regions
of Papua, Sulawesi, Kalimantan, Sumatra, and East Nusa Tenggara. The goal for this
year's BTS construction, which is separated into two phases, is 4,200 towers.
2. 2022: BTS construction is expected to include about 3,700 towers by the end of the
second year. This year, umbrella contracts worth a combined IDR 9.5 trillion for
packages 1 and 2 were negotiated with a number of businesses, including Fiberhome,
Telkom Infra, and Multitrans Data.
3. April 2022: According to Ministry of Communication and Information data, only 1,900
of the 4,200 villages targeted in the first phase have BTS towers as of this month,
representing only 86% of the commitment objective.
4. May 2023: According to the Financial and Development Supervisory Agency (BPKP),
the state has suffered losses totaling more than IDR 8 trillion as a result of this lawsuit,
including costs associated with the creation of legal studies, price markups, and
payments for unfinished BTS towers. Mahfud MD, the co-ordinating minister for
political, legal, and security affairs and acting minister of communication and
information, disclosed that the BTS procurement project's budget should have been
IDR 10 trillion, but that only IDR 2 trillion had been submitted.
5. January 2023: The Main Director of Bakti Kominfo Anang Achmad Latif was one of the
suspects in this case, according to a January 2023 announcement from the Attorney
General's Office (Kejagung).
6. May 2023: Johnny Plate, who at the time was still serving as Minister of
Communication and Information, was named a suspect after previously being a
witness in the investigation, according to the Attorney General's Office's Director of
Investigation for Special Crimes, Kuntadi. Ga Lubang Menak, the 2020 University of
Indonesia Human Development Expert (HUDEV), Yohan Suryanto, the Account
Director of the Integrated Account Department of PT Huawei Tech Investment, and
Sinergy Irwan Hermawan, the Commissioner of PT Solitech Media, are additional
suspects.

D. Alternative Solution
First and foremost, a thorough and transparent inquiry should go on, making sure that
everyone involved is thoroughly investigated and, if found guilty, held accountable through
legal actions. Second, in order to avoid future instances of corruption, the procurement
procedure for government projects needs to be reevaluated with a focus on enhancing
transparency, competition, and oversight. The government may also think about using
outside auditors and anti-corruption organizations to keep an eye on and evaluate big
projects. In order to promote a culture of accountability and integrity within public
institutions, steps should be strengthened to boost whistleblower protection and encourage
the reporting of corrupt behaviors. These actions are necessary to guarantee the effective
use of public funds and the provision of important services, such as digital connectivity.
Remains a top goal while successfully battling corruption in rural locations.
