Talking Points - The Biden-Johnson NDAA


“The House Recedes”

● The FY24 NDAA before the House is an utter disaster for House Republicans and a massive unforced error from
leadership that will cast a looming shadow next year.

● This NDAA did not have a true bicameral conference negotiation — as the House voted to do. Instead, this was a
“four corners” deal struck behind closed doors that effectively denied rank-and-file members a voice in the
process while capitulating on nearly every major House Republican priority.

● It’s no surprise that the Biden Administration has blessed the bill and urged its passage as it surrenders on many of
the policies that House Republicans claim to fight for…
○ There is no prohibition against tax-payer funded abortion and transgender surgeries.
○ It does not eliminate woke policies in the military such as drag shows, chief diversity officers, or racism
in academy admission processes.
○ It doesn't end the Administration's radical climate agenda being pushed onto our military.

● There have been several misleading claims made to the Republican Conference on what is and is not in this bill.
For example, see the “Community Note” attached to Speaker Johnson’s and HASC’s tweet.

● Leadership knows they are in trouble as many conservatives are opposing this bill. That’s why the NDAA, which
authorizes nearly $1 trillion in spending, is being passed under suspension of the rules.
○ This is an obvious play to end-run conservative objections and pass liberal “woke” military policy with
the help of House Democrats — a page ripped from the Boehner playbook.
○ This is the sort of process and tactic that conservatives fought to change in January and it’s what derailed
previous GOP Speakerships.

● Even worse, the NDAA has attached a completely unrelated reauthorization of FISA with zero reforms.
○ The Senate Parliamentarian raised concerns that FISA is non-germane to the bill (which will be overruled
by Democrat and RINO senators), and it is clear that this also violates the House’s “single subject” rule.
○ This reauthorization will effectively extend FISA through April 2025, meaning that the Administration
will be able to continue to weaponize the intelligence community against Americans to spy on them
without warrants through the 2024 elections.

● The FY24 NDAA is a betrayal to the voters who gave Republicans a majority. Americans demand a change in the
status quo in Washington, and yet this bill only enshrines many of the same policies that conservatives across the
country vehemently oppose.
○ The Biden Administration will be popping champagne if it is passed, knowing that Republicans have
accepted their “woke” Pentagon policies and uncontrolled surveillance without resistance.
