PROVISION OF MOTORCYCLE
HELMETS

A new motorcycle helmet which bears the Philippine


Standard (PS) mark or Import Commodity Clearance
(ICC) of Bureau of Product Standards (BPS) and
complies with the standards set by the BPS shall be
made available by every seller and/or dealer every time
a new motorcycle unit is purchased and which the
purchaser may buy at his option.

Tampering, alteration, forgery and imitation of the PS mark and the ICC
certificates in the helmets shall be punished with a fine of not less than Ten
thousand pesos (Php10,000.00) but not more than Twenty thousand pesos
(Php20,000.00), without prejudice to other penalties imposed in Republic
Act No. 7394 or the "Consumer Act of the Philippines".

R.A. No.10666 – Children’s Safety on Motorcycles Act of 2015

PROHIBITION
It is unlawful for any person to drive a
two-wheeled motorcycle with a child on board
on public roads where:
there is heavy volume of vehicles or,
there is a high density of fast moving vehicles or,
where a speed limit of more than 60/kph is imposed.

Allowed if:
(a) The child’s feet can comfortably reach
the standard foot peg of the motorcycle;
and;
(b) The child's arms can reach around and
grasp the waist of the motorcycle rider;
and;
(c) The child is wearing a standard
protective helmet.

Exception: If the child to be transported needs immediate medical attention.

All motor vehicles (including tricycle) must be registered with LTO and must
be renewed yearly.

The initial registration of Brand New Motorcycles with more than 200cc
engine displacement has three (3) years registration validity.

1. Overcharging / Fare Matrix violation – taking advantage of all types of


situation (heavy traffic, rainy season, night or early morning trips, etc)
2. Overloading of passengers especially K-12 students
3. Driving tricycle with expired registration
4. Driving with invalid license or without license
5. Improper or not wearing TODA uniform
6. Wearing slippers and shorts
7. Open pipe in violation of R.A. No. 4136 for illegal modification
8. Illegal turns resulting to obstruction of traffic or worse road crash
9. Changing lane or turning without using proper signals whether by hand or
switches
10. Disregarding traffic enforcers

11. Improper use of headlights or taillights in violation of R.A. No. 4136 (forward
light – red, rear brake light – blinking red)
12. Travelling on national roads in violation of LGU franchise resulting to

AN ACT PREVENTING AND PENALIZING THE USE OF
MOTORCYCLE IN THE COMMISSION OF CRIMES

Registration by the Owner


The owner of a motorcycle shall register his or her motorcycle with the LTO
within five (5) days from such acquisition of ownership. The owner of a
motorcycle shall also immediately report any sale or disposition of his or her
motorcycle to the LTO.

Bigger, Readable and Color- Coded Number Plates

The LTO shall:

o issue a set of bigger, readable and color-coded number plate for every
motorcycle, which shall consist of a metal number plate to be installed
at the rear of the motorcycle and decal number plate/RFID to be
displayed at the front.

Motorcycle plate must be readable from a distance of at least


fifteen (15) meters. All motorcycles shall have a rear plate light.

Impoundment and Forfeiture of a Motorcycle

A motorcycle used in the commission of a crime or offenses shall be


impounded by the PNP during the pendency of litigation over it in a
secured impounding center provided by the LGU until the
termination of the case.

Such motorcycle shall then be forfeited in favor of the government,


unless the court finds that the defendant is not guilty of the offense
charged or such motorcycle belongs to an innocent third party.

Prohibition on Sale and Importation of


Non-Compliant Motorcycles

No person, natural or juridical, shall be allowed to sell motorcycles,


unless the same has the capability to bear and showcase a
readable number plate.

Owners of existing motorcycle units which do not have space for


front plate are required to provide a bracket or any other provision
where the same shall be installed.

1. A TOP BOX is a storage compartment fitted behind the seat of a motorcycle or
scooter and is considered a motorcycle accessory. A top box that is specifically
designed for motorcycles and scooters and approved by DTI may not be subject
for inspection, registration or apprehension provided that it conforms to the
following:
a. Securely attached to the motorcycle.
b. Maximum capacity of two (2) full-faced helmets.

2. CUSTOM-MADE TOP BOXES (e.g., fast food delivery boxes) must


conform to the following and are subject to inspection and registration:

a. Securely attached to the motorcycle.


b. Dimensions must not exceed two (2) feet in length by two (2) feet
width by two (2) feet in height (2ft x 2ft x 2ft).
c. Must not impede or obstruct the view of the rider of the road from
the side mirrors.

Unregistered custom-made TOP BOXES are subject to apprehension


with a penalty of P5,000.00 pursuant to DOTC Joint Administrative
Order (JAO) 2014-01 Section II-D, Motor Vehicle Operating Without or
With Defective/Improper/Unauthorized Accessories, Devices.

3. SADDLE BAGS or BOXES are storage

4. CUSTOM-MADE SADDLE BAGS or BOXES must conform to the following and


are subject to inspection and registration:

a. Securely attached to the motorcycle.


b. Saddle bags must not be higher than the seat of the motorcycle or
scooter.
c. Shall not exceed fourteen (14} inches from the sides.
d. Length must not exceed the tail end of the motorcycle or scooter.

Unregistered custom-made SADDLE BAGS or BOXES are subject to


apprehension with a penalty of P5,000.00 pursuant to DOTC Joint Administrative
Order (JAO) 2014-01 Section II-D, Motor Vehicle Operating Without or With
Defective/Improper/ Unauthorized Accessories, Devices, Equipment and Parts.
